Busan KAPCA went out early one morning with the police and came upon a scene of dogs being killed with sledgehammers and then burned with blowtorches! Click for previous report! http://koreandogs.org/busan-gijanggun-sledge-hammer-blow-not-cruel-english/

Busan KAPCA pressed charges against the perpetrator. However, at that time, Gijang Police Station made a ludicrous statement that killing by means of sledgehammers is not a cruel but rather a great way to kill since it inflicts “no pain” and it is considered as “blow killing” under the Animal Protection Act Enforcement Rule. And now the man is acquitted on all charges!

Please note that dogs are not subjected to the “blow killing” prescription under the Animal Protection Act Enforcement Rule.

Nevertheless, the police and the prosecutor have incorrectly applied this law and granted the man acquittal arguing that the killing was not cruel. This is clearly a wrong decision resulting in the perpetuation of animal cruelty.

The man killed dogs with sledgehammer blows and then blow-torched their bodies…!
How can this not be considered cruel and how could they have acquitted this man?
Have they really reviewed the law carefully…
This is so unfair and deplorable that we are outraged.

Therefore, Busan KAPCA filed an appeal again along with the data from other similar cases.
Korean Animal Welfare Association (KAWA) sent us a petition and Korea Animal Rights Advocates(KARA) sent us a written opinion so we attached these documents to our appeal.

Please send your message to the prosecutor’s office asking for a proper investigation so that appropriate action will be taken in this case and that this case will serve as an opportunity to eradicate animal cruelty.

We have heard that in the case of this appeal, the chances of it being dismissed is high.

Before the prosecutor dismisses it we must inform him that this acquittal was wrong and proper action needs to take place.

Don’t let this man continue to torture dogs with a sledgehammer! Please sign and share this petition!

If we just give up now, similar cases will be acquitted as well.
This case must be treated as a violation of animal cruelty.
We need your help to get this case handled properly not only for the dogs that are already killed but for those that will be killed in the future.

부산동학방에서 경찰과 검찰에 고발하였으나…
기장 경찰서에서 망치로 때려죽인 것이 타격법에 해당되어 잔인하게 죽이는 것이 아니라 오히려 고통을 없에 잘 죽여주는 방법이라는 망언을 하더니…
결국 무혐의 판결이 나왔습니다.

참고로 ‘개’는 타격법 대상이 아닙니다.

그런데도 경찰과 검찰에서 이렇듯 잘못 적용하여 잔인한 방법이 아니라고 무협의를 내린 것은 그야말로 동물학대를 방치하는 잘못된 처분이 분명합니다.

어떻게 망치로 때려죽이고 불에 그을리고 있었는데도…
이것이 잔인하지 않다고 무혐의 처분을 한다는 말입니까?
제대로 법이나 보셨는지…
너무나 억울하고 분노스럽고 통탄할 처분입니다.

이에 부산동학방은 다시 항고장을 접수했습니다.
다른 사건 자료를 첨부했고…
동물자유연대에서는 진정서를, 카라에서는 의견서를 보내주시어 함께 첨부했습니다.

여려 회원님들께서도 이번에야말로 올바른 처분이 내려져 동물학대를 근절하는 계기가 되도록 검찰에 제대로된 수사를 위한 의견을 보내주시기 바랍니다.
