2.「민원 처리에 관한 법률」 제2조제2호(정의)에는 민원인이란 행정기관에 제기하는 개인·법인 또는 단체를 말하며, 성명·주소 등이 불명확한 자는 제외토록 규정하고 있습니다.

3.「민원 처리에 관한 법률」 에는 외국인이 민원인에 해당하는지 여부에 대하여 명확히 규정되어 있지 않으나, 민원처리에 관한 법령 해설(2017.03월 행정안전부 발간)에는 ‘국내에 주소 혹은 거소를 두고 있는 외국인이나, 외국 법인 또는 단체는 민원인에 포함된다’고 해설하고 있습니다.

4. 따라서 귀하께서는 외국인으로써 국내에 주소 혹은 거소를 두고 있다고 판단할 수 없어 민원인에 해당 되지 않기에 민원을 처리할 수 없어 종결 처리하였음을 알려드립니다.

5. 아울러 민원 제기하신 개사육시설은 2019년 동일한 민원이 있어 현지 확인 결과 대부분 미사육이었으며 그 외는 「가축분뇨의 관리 및 이용에 관한 법률」에 따라 적법하게 신고하여 관리되는 사업장으로 불법 사항을 발견할 수 없었음을 알려드립니다.

A civil petitioner is an individual, corporation or organization that files a civil petition to an administrative agency pursuant to Article 2 subparagraph 2 (Justification) of the Civil Petitions Treatment Act, and those whose names, addresses, etc. are unclear are excluded from civil petitions.

3. According to the Act on Civil Petitions Treatment, the Act does not specify whether a foreigner is a civil petitioner, but the Act published by the Ministry of Public Administration and Security in March 2017 states that foreigners, foreign corporations or organizations with addresses or residences in Korea are included in the civil petitioner.

4. Therefore, we would like to inform you, due to the acts stated above, we will close your complaints because we cannot determine if you have a legal residence in Korea as a foreigner.

5. In addition, the dog farm that filed the complaint had the same complaint in 2019, and most of the sites were not dog farm. the rest were reported and managed under the Act on the Management and Use of Livestock Manure, and no illegal matter could be found.

1. 안녕하십니까. 귀하께서 국민신문고를 통해 신청하신 민원(신청번호 1AA-2108-0215897)이 다부처 민원으로 지정됨에 따라, 축산과 소관사항에 대한 검토 결과를 다음과 같이 알려드립니다.

2. 귀하께서 제출하신 민원의 내용은 “불법적인 개농장 운영 및 개고기 판매 반대”에 관한 것으로 판단됩니다.

3. 귀하의 민원에 대한 검토 결과는 다음과 같습니다.
가. 「민원처리법」 제2조제2호에 따라 민원인이란 행정기관에 민원을 제기하는 개인·법인·단체라고 명시되어 있고, 같은 법 시행령 제2조제1항제3호(민원 및 공공기관의 범위)에 따라 성명,주소 등이 불명확한 자는 민원 대상에서 제외됩니다.
나. 「민원 처리에 관한 법률」(2017년 3월 행정안전부 고시)에 따르면 외국인이 민원인인지 아닌지에 대해서는 명시하고 있지 않지만, 국내에 주소나 거주지를 둔 외국인, 외국법인 또는 단체가 민원에 포함된다고 설명되어 있습니다. 따라서, 우리부서는 위에 언급된 민원인이 외국인으로서 한국에 합법적인 거주지를 가지고 있는지 판단하지 못하기 때문에 귀하의 민원 사항을 종결할 것임을 알려드립니다.

1. Good afternoon. As your application (Application No. 1AA-2108-0215897) has been designated as a multi-ministerial complaint through the e-People, I would like to inform you of the results of the review of livestock and related matters as follows.

2. The details of your complaint are judged to be about “aggressing illegal operation of dog farms and the sale of dog meat.”

3. The review results of your complaint are as follows.
A. According to subparagraph 2 of Article 2 of the Civil Petition Processing Act, civil petitioners are specified as individuals, corporations and organizations filing complaints to administrative agencies, and those whose names, addresses, etc. are unclear are excluded from civil petitions.
B. According to the Civil Petitions Act (notified by the Ministry of Public Administration and Security in March 2017) it does not specify whether a foreigner is a civil petition or not, but it is explained that a civil petition includes a foreigner, a foreign corporation, or an organization with an address or residence. Therefore, we would like to inform you that we will close your complaint because we cannot determine whether the above-mentioned civil petitioner has a legitimate residence in Korea as a foreigner.
