Sharing for Coexistence of Animal Rights on Earth (CARE)

1. Purpose of the proposal
In 2022, Animal Protection Act Amendment Bill passed the National Assembly and is set to take effect. However, the name “amendment bill” is almost overshadowed, for not only are there still no rules on the food industry or protection against laboratory animals, but regulations on animal abuse are still very deficient. In response, CARE plans to promote a “Project for a Complete Revision of the Animal Protection Act” with citizens who share these concerns. We are recruiting people to plan and conduct this project together.

2. Project guidance
(1) Schedule
① Application due date: November 15, 2022
② Starting date of the project: December 1, 2022
(2) Procedures Overview
① Analysis of domestic laws and sharing perceptions among participants (3 months): we will examine the revised Animal Protection Act, including secondary legislations such as enforcement ordinances, and evaluate laws and the respective provisions.
② Study of foreign cases and share perceptions among participants (1 year): we will examine various animal protection laws (including sub-regulation) and related precedents in countries such as the United Kingdom. We will compare them closely with domestic law at general and specific levels.
③ Preparation of a draft for a complete Amendment bill to the Animal Protection Act, based on the preceding discussions (6 months)
④ Assemble an executive team to formulate a legislative strategy (3 months)
⑤ Execution of legislative strategy (1 year)
*) Based on each course’s research and opinions, we will produce and select the discussion results after an in-depth discussion. The selected discussion results will be published publicly to gather more opinions.
The schedule above may be subject to change, depending on the way the discussion unfolds or on the circumstances.
(3) Participation method
① Participation will be divided into researchers, panels, and advisors, depending on their sustainability of participation and the possibility of presentation. Please refer to the application form for details.
② Participants must faithfully carry out the necessary investigations (literature review and fact-finding)
③ The ‘researcher’ who participated in the process stated above(①~③), will be paid a prescribed research fee.

아침에 메일함을 열어보니 설문조사가 있었습니다. 답을 적어 가다가 한 항목에서 멈칫했습니다. “조직에서의 당신의 역할에 비추어 볼 때, 당신의 직무 중 가장 중요한 부분은 무엇입니까?” 통상적으로 대답하자면 “전략을 만들고 그에 따라 조직을 지휘하는 것” 정도가 될 것입니다만 그렇게 하지 않았습니다.
“동물학대 없는 사회를 만드는데 조직이 결정적인 역할을 하게 하는 것”
동물보호, 동물복지, 동물권, 동물해방, 다 좋은데 그 기본은 동물학대가 없는 상태입니다. 말로서가 아니라 진실로 동물을 위한다면, 동물에게 가장 심각한 문제이고 또 시민역량을 가장 크게 집중해 낼 수 있는 동물학대부터 해결해야 합니다. “여기가 로도스다, 여기서 뛰어라”
케어는 지난 20년간 늘 동물학대 현장으로 달려갔습니다.
학대의 참상을 세상에 보이고, 학대는 해서는 안 될 나쁜 짓이라고 사람들에게 선언하게 하고, 국가로 하여금 학대자를 처벌하고 피학대동물을 격리하게 하였습니다. 개별 학대보다 훨씬 더 중요한 문제인 구조적 학대를 해결하는 첫 걸음으로 개농장철폐활동을 하였습니다.
이제 케어는 동물보호법 전면 개정 운동을 통해 동물학대와 전면전을 벌이려 하고 있습니다.

1. 제안 취지
2022년에 동물보호법 전부 개정안이 국회를 통과해서 시행을 앞두고 있습니다. 그러나 전부 개정이란 이름이 무색할 정도로 식용산업이나 실험에 쓰이는 동물에 대한 보호는 없다시피 하고 동물학대와 구조에 대한 규정도 부실하고 파행적입니다. 이에 케어는 문제의식을 공유하는 시민 여러분과 손잡고 동물보호법 전면 개정을 위한 프로젝트를 추진하려 합니다. 프로젝트를 함께 기획하고 실행할 분들을 모집합니다.
2. 프로젝트 안내
(1) 추진 일정
① 참여 신청: 제안서 게시일 ~ 2022년 11월 15일
② 프로젝트 개시: 2022년 12월 1일
(2) 절차 개관
① 국내법 분석과 참여자 인식 공유(3개월) – 개정 동물보호법을 시행령 등 하위법을 포함해서 읽어온 뒤 법령 전반과 개별 조문에 대해 평가합니다.
② 해외사례 조사와 참여자 인식 공유(1년) – 영국 등 주요국의 동물보호법(하위 규정 포함)과 관련 판례를 읽고 법령 전반 및 개별 조문에 대해 우리법과 세밀히 비교합니다.
③ 동물보호법 전면 개정안 마련(6개월) – 그동안의 논의를 바탕으로 개정안을 마련합니다.
④ 입법 전략 수립과 실행팀 구성(3개월)
⑤ 입법 전략 실행(1년)
*) 각 과정마다 각자 조사한 내용과 의견을 바탕으로 심도있는 토론을 거쳐 토론 결과물을 채택할 예정입니다.
채택된 토론 결과물 등은 외부에 공개하여 의견을 수렴할 예정입니다.
일정은 논의 전개 및 운영상황에 따라 변동될 수 있습니다.

① 참여의 지속성과 발제 가능여부에 따라 연구자, 패널, 자문 역할을 선택하여 참여하게 됩니다. 자세한 내용은 신청서를 참고하세요.
② 참여자는 필요한 조사(문헌 조사와 사실 조사)를 충실히 수행해야 합니다
③ 프로젝트 절차 ①~③에 참여한 ‘연구자’에게 소정의 연구비를 지급합니다.
