2. 귀하의 민원 내용은 청주시 가덕면 삼항리 490-1번지 등 상당구 소재의 10개소에 대한 가축분뇨법 미신고에 대한 처분, 음식물폐기물 관련 신고, 하수도 오염, 생활폐기물 위반 행위 등에 대한 것으로 이해하였습니다.
2. I understand that your complaint is about the disposal of the livestock manure law, the report on food waste, the pollution of sewage, and the violation of domestic waste at 10 locations in Sangdang-gu, including 490-1, Samhang-ri, Gadeok-myeon, Cheongju.
3. 「가축분뇨의 관리 및 이용에 관한 법률」과 관련하여 현장을 확인한 결과, 가축분뇨배출시설 신고에 대해 기 폐쇄신고한 사업장이 4개소이며, 폐쇄신고된 주소지에서 개사육을 하지 않는것으로 확인하였으며, 그 외 6개 시설은 신고를 득하여 운영하는 사업장 임을 알려드립니다.
※ 폐쇄신고 된 사업장 소재지 : 상당구 가덕면 490-1번지, 남일면 가산리 734번지, 낭성면 문박리 1번지, 낭성면 문박리 2번지 총 4개소

4. 음식물폐기물 재활용에 대해서 확인한 결과 기 신고를 득하고 운영 중으로 위반사항을 발견하지 못하였습니다.

6. 생활폐기물의 투기 및 적재에 대한 위반 사항에 관련하여서는 폐기물 관리법 제 8조(폐기물의 투기 금지 등) 1항에 해당하는 내용으로 “누구든지 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장이나 공원ㆍ도로 등 시설의 관리자가 폐기물의 수집을 위하여 마련한 장소나 설비 외의 장소에 폐기물을 버려서는 아니 된다.” 고 규정하고 있습니다. 단, 해당 내용은 개인소유 건축물 내에서 적치에 대해서는 규제하고 있지 않기 때문에, 요청해주신 지역이 개인소유 건축물의 내부에 적치된 폐기물인 경우 쓰레기 불법투기 또는 적재관련 행정적인 조치가 진행되기 어려움을 안내해드립니다.

Regarding violations of the dumping and loading of domestic wastes, Article 8 (1) of the Waste Management Act (Prohibition of the dumping of wastes, etc.) stipulates that “no one shall throw waste away in any place other than the facilities or facilities prepared by the manager of facilities, such as the Mayor, the County governer(Gun), the head of the Gu, or the park or road.”

– 1번(가축분뇨 관련) : 「가축분뇨의 관리 및 이용에 관한 법률」 위반 여부에 대하여 현지 확인 결과 서원구 소재 3개 농장이 모두 가축분뇨배출시설 설치신고를 완료한 사업장으로 확인 되었읍니다.
– 1Number 1(Related to livestock excreta): All three farms in Seowon-gu have been confirmed as sites that have completed the report on the installation of livestock excreta discharge facilities as a result of on-site inspection of violations of the Act on the Management and Use of Livestock Excreta.
– 13번(음식물 폐기물 관련) : 음식물류 폐기물 재활용에 대하여 확인 결과 3개소 모두 폐기물 처리(재활용) 신고를 완료하고 운영중으로 위반사항은 없습니다.

The District Office acknowledges the receipt of your petition made through the ‘e-people’ for administrative measures against the specified dog farms located in Heungdeok-gu regarding the item no.1-livestock manure, no.3-food waste, no.5-sewerage, and no.6-household waste. Following is the site investigation result and decision of the District Office as per your petition.
2. 1번『가축분뇨의 관리 및 이용에 관한 법률』위반사항 여부에 대해 확인결과 흥덕구 소재 11개소 개 농장이 모두 가축분뇨배출시설 설치신고를 득한 사업장으로 확인되었음을 알려드립니다.
2. Petition no. 1: violation of the Act on the Management and Use of Livestock ExcretaThe District Office confirms that all eleven (11) dog farms located in Heungdeok-gu and specified in the petition acquired proper registration on livestock excreta discharge facilities.
3. 3번 『폐기물관리법』에 따른 음식물류 폐기물관련은 개 농장 중 4개소가 폐기물처리신고를 하고 운영 중에 있으며, 확인결과 신고되지 않은 농장에서는 음식물류폐기물을 사료로 사용하는 등 불법사항을 발견하지 못하였음을 알려드립니다.
3. Petition no. 3: violation of the Waste Control Act
The District Office confirmed that four (4) dog farms acquired proper registration on waste treatment facility.
A separate site inspection was conducted on the remaining dog farms without the authorized waste treatment facility, and we did not find any illegal practices or violation against the Act including food waste feed.
4. 5번 하수도등 오염여부를 확인한 결과 하수도(배수로)등 오염현황을 발견하지 못하였으며 추후 위반사항이 발견될 시 조치하겠습니다.

A site inspection is conducted to check the contamination of public sewage and drainage.
The District Office confirms that we could not locate any contamination, however, should any unlawful waste water discharge or contamination of the public sewerage are identified in the future, the District Office will take appropriate administrative actions.

A site inspection is conducted to check illegal dumping and loading of household waste in the vicinity of the dog farms. The District Office confirms that we did not find any unlawful household wastes disposal or dumping outside the dog farm’s property.

<가축분뇨의 관리 및 이용에 관한 법률 관련>
– 본 민원과 관련하여 신고해주신 16개소의 필지를 확인한 결과, 일부는 가축분뇨배출시설 폐쇄신고가 완료되어 있었으며, 폐쇄된 가축분뇨배출시설은 개를 사육하고 있지 않음을 확인하였습니다. 더불어 관내 운영 중인 개사육시설 소유주 및 관리자에게 가축분뇨의 관리 및 이용에 관한 법률 제17조에 따른 관리기준을 준수하여 운영할 것을 행정지도 하였습니다. 추후 위반사항 발견 시 관련법에 의거 적법하게 조치토록 하겠으며 앞으로도 가축분뇨배출시설 지도점검에 최선을 다하도록 하겠습니다.
<폐기물 관리법 관련>
– 생활폐기물의 투기 및 적재에 대한 위반 사항에 관련하여서는 폐기물 관리법 제 8조(폐기물의 투기 금지 등) 1항에 해당하는 내용으로 “누구든지 특별자치시장, 특별자치도지사, 시장ㆍ군수ㆍ구청장이나 공원ㆍ도로 등 시설의 관리자가 폐기물의 수집을 위하여 마련한 장소나 설비 외의 장소에 폐기물을 버려서는 아니 된다.” 고 규정하고 있습니다.
– 단, 해당 내용은 개인소유 건축물 내에서 적치에 대해서는 규제하고 있지 않기 때문에, 요청해주신 지역이 개인소유 건축물의 내부에 적치된 폐기물인 경우 쓰레기 불법투기 또는 적재관련 행정적인 조치가 진행되기 어려움을 안내해드립니다.
– 음식물류 폐기물 재활용 신고를 득하지 않은 개사육시설에서 음식물류를 급여하고 있는 곳은 발견하지 못하였습니다.

– If any violations are found later, we will take proper action in accordance with the relevant laws, and we will continue to do our best to guide and inspect livestock excrement facilities.

– Regarding violations of the dumping and loading of domestic wastes, Article 8 (Prohibition of the dumping of wastes, etc.) (1) of the Waste Management Act stipulates that “any person shall not throw waste away at any place other than the facilities or facilities prepared by the manager of facilities, such as the Mayor, the Gun Magistrate, the head of the Gu, or the park or road.“
– However, since the relevant information does not regulate the appropriateness within a privately owned building, it will inform you of the difficulty of administrative measures related to illegal dumping or loading of waste if the area you requested is waste deposited inside a privately owned building.
– No place has been found where food is being paid at dog meat facilities that have not been reported for recycling food waste.
