2. 귀하의 민원내용은 ‘강원도 춘천시 사북면 지암리 156번지 외 14개소’의 ‘불법 개농장 신고’에 관한 것으로 이해됩니다.

3. 귀하의 질의사항에 대한 민원장소별 부서 검토의견은 다음과 같습니다.
1) 강원도 춘천시 사북면 지암리 156번지 외1(254)
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 해당 주소 내 가축사육이 없음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 민원장소는 현재 ‘사북면 지암리 155번지’로 합병되었으며 「건축법」 위반사항은 없음을 알려드립니다.
라. 또한, 「폐기물 관리법」 위반사항 및 하수도 관련 위반사항도 없음을 알려드립니다.
2) 강원도 춘천시 동면 평촌리 372
가. 상기 민원장소 내 개 사육장은 현재 도축관련 시설이 없는 것으로 확인되어, 「동물보호법」 제8조 및 「동물보호법」 제10조 위반사항은 적발할 수 없었으며,
나. 또한, 해당 사육장은 신고규모 미만의 시설로 확인되어 「가축분뇨관리법」 위반사항도 없음을 알려드립니다.
다. 또한, 해당 사육장에서 사업주의 사업장 내 발생되는 음식물류 폐기물과 사료를 섞어 급여하고 있는 것으로 확인되어 「폐기물 관리법」위반사항도 없음을 알려드리며,
라. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
3) 강원도 춘천시 동면 소양강로 452
가. 상기 민원장소는 주소가 부존재 함을 알려드리며, 민원발생지 부근에서도 개 사육장을 확인할 수 없었음을 알려드립니다.
4) 강원도 춘천시 신동면 한치로 755
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 사육장도 철거되었음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
나. 상기 장소 내 개 사육장은 철거되었으며 건축물이 신축되어 다른 용도로 사용 중임을 알려드립니다.
다. 또한, 건물(또는 시설)등에서 배출되는 오수를 처리하기 위한 개인하수처리시설을 설치하였으며, 하수도 관련 위반사항이 없음을 알려드립니다.
5) 강원도 춘천시 동내면 원창고개길 165-1
가. 상기 민원장소는 2020년9월 「동물보호법」 제8조 및 「동물보호법」 제10조 위반사항이 적발되어 고발조치된 상태이며,
나. 또한, 해당 사육장은 가축분뇨배출시설 신고 후 운영중이며 「가축분뇨관리법」 위반사항이 없음을 알려드립니다.
다. 또한, 해당 사육장은 음식물류 폐기물 재활용 신고 후 운영중이며 「폐기물 관리법」 위반사항도 없음을 알려드립니다.
라. 그러나, 상기 장소는 2020년9월 「건축법」 제11조를 위반한 불법건축물이 있음을 확인하였으며 현재 시정조치 중임을 알려드립니다.
마. 또한, 건물(또는 시설)등에서 배출되는 오수를 처리하기 위하여 공공하수처리시설로 연계처리하고 있어, 하수도 관련 위반사항이 없음을 알려드립니다.
6) 강원도 춘천시 서면 방동리 378
가. 상기 민원장소 내 개 사육장은 현재 도축관련 시설이 없는 것으로 확인되어, 「동물보호법」 제8조 및 「동물보호법」 제10조 위반사항은 적발할 수 없었으며,
나. 또한, 해당 사육장은 가축분뇨배출시설 신고 후 운영중이며 「가축분뇨관리법」 위반사항이 없음을 알려드립니다.
다. 또한, 해당 사육장은 음식물류 폐기물 재활용 신고 후 운영중이며 「폐기물 관리법」 위반사항도 없음을 알려드립니다.
라. 그러나, 상기 장소 내 「건축법」 제14조를 위반한 불법건축물이 있음을 확인하여 시정조치할 예정이며, 시정기간 내 원상복구(철거 등) 되지 않을 시 매년 이행강제금을 부과함을 알려드립니다.
마. 또한, 하수도 관련 위반사항은 없음을 알려드립니다.
7) 강원도 춘천시 사북면 영서로 4604-6
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 과거 가축분뇨배출시설 폐업신고도 수리하였음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
8) 강원도 춘천시 신동면 의암리 157-1
가. 상기 민원장소 내 개 사육장은 반려 목적으로 개를 사육·관리하고 있는 것으로 확인되어 「동물보호법」 제7조(적정한 사육·관리) 점검을 추진하였음을 알려드리며,
나. 또한, 해당 사육장은 가축분뇨배출시설 신고 후 운영중이며 「가축분뇨관리법」 위반사항이 없음을 알려드립니다.
다. 또한, 해당 사육장에서 개먹이로 사료를 급여하고 있어 음식물류 폐기물 재활용 사실이 없음을 알려드립니다.
라. 그러나, 상기 장소는 2019년12월 「건축법」 제11조 위반으로 적발되어 현재 이행강제금 부과 중임을 알려드립니다.
마. 그리고, 하수도 관련 위반사항은 없음을 알려드립니다.
9) 강원도 춘천시 동내면 사암리 409
가. 상기 민원장소 내 개 사육장은 현재 도축관련 시설이 없는 것으로 확인되어, 「동물보호법」 제8조 및 「동물보호법」 제10조 위반사항은 적발할 수 없었으며,
나. 또한, 해당 사육장은 신고규모 미만의 시설로 확인되어 「가축분뇨관리법」 위반사항도 없었음을 알려드립니다.
다. 그러나, 해당 사육장은 음식물류 폐기물 재활용 신고서를 제출한 상태로 신고서 수리 후 적법하게 운영하도록 지도·점검할 것입니다.
라. 또한, 상기 장소는 2019년12월 「건축법」 제11조 위반으로 적발되어 현재 이행감제금 부과 중임을 알려드립니다.
마. 또한, 하수도 관련 위반사항은 없음을 알려드립니다.
10) 강원도 춘천시 동면 장학리 418-1
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 사육장도 철거되었음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
11) 강원도 춘천시 동면 장학리 970
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 사육장도 철거되었음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
12) 강원도 춘천시 사농동 437-26
가. 상기 민원장소 내 개 사육장은 반려 목적으로 개를 사육·관리하고 있는 것으로 확인되어 「동물보호법」 제7조(적정한 사육·관리) 점검을 추진하였음을 알려드리며,
나. 또한, 해당 사육장은 신고규모 미만의 시설로 확인되어 「가축분뇨관리법」 위반사항이 없음을 알려드립니다.
다. 또한, 해당 사육장에서 개먹이로 사료를 급여하고 있어 음식물류 폐기물 재활용 사실이 없음을 알려드립니다.
라. 또한, 상기 장소 부근 개 약10마리를 사육하고 있는 사육장이 있으나 이는 건축물이 아니므로 「건축법」상 위반사항이 없음을 알려드립니다.
마. 또한, 건물(또는 시설)등에서 배출되는 오수를 처리하기 위한 개인하수처리시설을 설치하였으며, 하수도 관련 위반사항이 없음을 알려드립니다.
13) 강원도 춘천시 동면 장학리 641
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 과거 가축분뇨배출시설 폐업신고까지 수리하였음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
14) 강원도 춘천시 서면 오월리 산 12-27
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 사육장도 철거되었음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.
15) 강원도 춘천시 사북면 지촌리 367-2
가. 상기 민원장소 내 개 사육장은 과거에 이미 폐업한 것으로 확인되었으며, 사육장도 철거되었음을 알려드립니다.
나. 또한, 현재 해당 장소 내 개 사육 사실이 확인되지 않아 「폐기물 관리법」 위반사항이 없음을 알려드리며,
다. 상기 장소는 현재 「건축법」 위반사항이 없으며, 하수도 관련 위반사항도 없음을 알려드립니다.

1. This is to respond to your petition you filed on ‘e-people’, the followings are the results from our inspection on 15 sites.

2. I understand your petition is about ‘report on illegal dog farms’ which are/were located in “156 Jiam-ri, Sabuk-myeon, Chuncheon-si, Gangwon-do plus 14 other sites’

3. Followings are the outcomes of review of relevant departments in the city government on the matter, site by site.

1) 156 Jiamri, Sabuk-myeon, Chuncheon-si, Gangwon-do, Republic of Korea and 254 Jiamri, Sabuk-myeon, Chuncheon-si
ⓐ It is identified that the dog farm registered above address is no longer in business, hence no breeding of any sort of livestock on that premises.
ⓑ Additionally, no dog-breeding/farming is detected at the moment, hence there is no violation of 「Wastes Control Act」.
ⓒ The site addressed above has been merged into the site of 155 Jiam-ri, Sabuk-myeon, I would like to inform you that there is no violation of 「Building Act」.
ⓓ Besides, there is no violation of 「Wastes Control Act」 or Sewage related violation of the law.

2) 372 Pyeongchon-ri, Chnuncheon–si, Gangwon-do
ⓐ The dog farm in the site addressed above have no slaughtering facility at the moment, we could not identify any violation pursuant to articles 8 (Prohibition of Animal Abuse) and 10 (Methods of Slaughtering Animals) 「Animal Protection Act」.
ⓑ The dog farm is less than 60 square metres in size hence it is not subject to registration as a waste emission facility, so 「Act on the Management and Use of Livestock Excreta」 is not applicable.
ⓒ We would like to inform you that there is no violation of 「Waste Management Act」 since dogs are fed with dog feed mixed with food wastes produced from the farm.
ⓓ There was no violation of 「Building Act」 or Sewage related violation of the law.

3) 452 Soyangro, Dong-myeon, Chuncheon-si, Gangwon-do
ⓐ We regret to tell you that above address is not valid, and we could not find any dog farm in the vicinity of the place addressed above.

4) 755 Hanchiro Sindong-myeon, Chuncheon-si, Gangwon-do
ⓐ It is identified that the dog farm registered above address is no longer in business, and the dog farm has been demolished.
ⓑ There is no violation of 「Waste Control Act」 since we could not find any evidence of dog’s breeding in the site.
ⓒ The dog farm has been demolished and a new building has been constructed and is being used for other purposes.
ⓓ Besides, a private sewage treatment facility has been installed in the site to treat wastewater from the building/facility, hence there is no sewage related violation.

5) 165-1 Wonchanggogaegil, Dongnae-myeon, Chuncheon-si, Gangwon-do
ⓐ The dog farm addressed above was caught for the violation of articles 8 (Prohibition of Animal Abuse) and 10 (Methods of Slaughtering Animals) of 「Animal Protection Act」 and reported in September 2020
ⓑ However the dog farm has registered as a farm with livestock excreta process facility, violation of 「Act on the Management and Use of Livestock Excreta」 is not applicable to this case.
ⓒ No violation of 「Act on Waste Management」 is identified since the farm has registered as a facility which can recycling of food waste and been running their business as such.
ⓓ However, an correction order has been issued since we identified an illegal building according to article 11 (Building Permission) of 「Building Act」 in September 2020 on the premises.
ⓔ No violation of sewage process has been found since the wastewater from the building(or facility) is connected to public sewage facility

6) 378 Bangdong-ri Seo-myeon, Chuncheon-si, Gangwon-do
ⓐ No violation of Articles 8 (Prohibition of Animal Abuse) and 10 (Methods of Slaughtering Animals) of 「Animal Protection Act」 since we could not find any slaughtering related facility in the dog farm located above address.
ⓑ Additionally the dog farm has registered as a farm with livestock excreta emission facility, violation of 「Act on the Management and Use of Livestock Excreta」 is not applicable.
ⓒ No violation of 「Waste Control Act」 is identified since the farm has registered as a facility which can recycling of food waste.
ⓓ However we have identified an illegal building infringing Article 14 (Notification of Building Construction) of 「Building Act」 in the site, we are planning to issue correction order and to impose compelling the execution charge every year until it is done.
ⓔ And there is no sewage related violation.

7) 4604-6 Youngseoro, Sabuk-myeon, Chuncheon-si, Gangwon-do
ⓐ The dog farm in the site has been closed down, it reported of closing-down of a livestock excreta emission facility.
ⓑ And we could not identified if the place once used as dog farm or not, hence no violation of 「Waste Management Act」 was identified.
ⓒ The site located at the address above has not infringed neither 「Building Act」 or Sewage related law.

8) 157-1 Uiamri, Sindong-myeon, Chuncheon-si, Gangwon-do
ⓐ The place addressed above is for raising dogs for companion animals, hence we inspect the place in accordance with Article 7 (Appropriate Raising and Management) of 「Animal Protection Act」.
ⓑ and there is no violation of 「Act on the Management and Use of Livestock Excreta」 since it has been registered as a livestock excreta emission facility.
ⓒ Since dogs are fed by (dog) feed, there is no recycling of food waste for dog feed in the site.
ⓓ We have imposed ‘compelling the execution charge’ (for demolition of an illegal building) since we have found the illegal building pursuant to article 11 (Building Permission) of 「Building Act」 in December 2019
ⓔ and there is no sewage related violation.

9) 409 Saam-ri, Dongnae-myeon, Chuncheon-si, Gangwon-do.
ⓐ Since we could not find any slaughtering related facility in the dog farm located in the address above, Articles 8 (Prohibition of Animal Abuse) and 10 (Methods of Slaughtering Animals) of 「Animal Protection Act」 are not applicable.
ⓑ The dog farm is less than 60 square metres in size hence it is not subject to registration as a waste emission facility, so 「Act on the Management and Use of Livestock Excreta」 is not applicable.
ⓒ However the farm has submitted their intention of recycling food-kind waste, after registration we will supervise/inspect it in according with the relevant and applicable law.
ⓓ We have imposed ‘compelling the execution charge’ (for demolition of the illegal building) since we have found an illegal building pursuant to Article 11 (Building Permission) of 「Building Act」 in December 2019.
ⓔ The site addressed above has not infringed Sewage related law.
10) 418-1 Dong-myeon Chuncheon-si, Gangwon-do
ⓐ The dog farm in the site closed down in the past, and the dog farm has already been demolished.
ⓑ Since there is no evidence of raising dogs in the site, 「Waste Management Act」 is not applicable.
ⓒ The site located at the address above has not infringed neither 「Building Act」 or Sewage related law.

11) 70 Janghakri, Dong-myeon Chuncheon-si, Gangwon-do
ⓐ The dog farm addressed above closed down in the past, and the dog farm has already been demolished.
ⓑ Since there is no evidence of raising dogs in the site, 「Waste Management Act」 is not applicable.
ⓒ The site addressed above has not violated neither 「Building Act」 nor Sewage related law.

12) 437-26 Sanongdong Chuncheon-si, Gangwon-do
ⓐ The place addressed above is for raising dogs for companion animals, hence we inspected the place in accordance with Article 7 (Appropriate Raising and Management) of 「Animal Protection Act」.
ⓑ and there is no violation of 「Act on the Management and Use of Livestock Excreta」 since it is not big enough for registration.
ⓒ Since dogs are fed by feed, there is no recycling of food waste for dog feed in the site.
ⓓ Additionally, approximately ten dogs are being raised in the dog farm in the vicinity of the place, however it is not categrised as a building, hence violation of 「Building Act」 is not applicable.
ⓔ Besides, a private sewage treatment facility has been installed in the site to treat wastewater from the building/facility, hence there is no sewage related violation.

13) 641 Janghakri, Dong-myeon, Chuncheon-si, Gangwon-do
ⓐ We identified that a dog farm on the premises addressed above has closed down, and it has reported of close-down of livestock excreta emission facility.
ⓑ There is no breeding/farming of dogs on that premises, hence there is no violation of 「Waste Management Act」.
ⓒ There is no violation of 「Building Act」 or sewage related infringement of the law in the site addressed above.

14) 12-27 San Seo-myeon, Chuncheon-si, Gangwon-do
ⓐ The dog farm on that address, closed down in the past, and the place has been demolished.
ⓑ We are informing that we could not identified any evident of breeding/farming of dogs on that premises, hence there is no violation of 「Waste Management Act」
ⓒ The site located at the address above has not infringed neither 「Building Act」 nor Sewage related law.
15) 367-2 Jichonri, Sabuk-myeon, Chuncheon-si, Gangwon-do
ⓐ The dog farm in the site closed down in the past, and the dog farm has already been demolished.
ⓑ There is no violation of 「Waste Control Act」 Since we could not find any evidence of dog breeding in the site.
ⓒ The site located at the address above has not infringed neither 「Building Act」 nor Sewage related law.
