불법 개고기 농장, 도축장 및 시장 폐쇄
민원에 대한 관련 법률 검토결과

1. 음식물류 폐기물 개사료로 급여
– 관련법에 따라 음식물류 폐기물 배출 및 처리 등에 관한 사항을 규정하고 있는 바, 정기 및 수시점검에 따라 위반 사항 발견 시 적법하게 조치하고 있음
※ 검토법률 :　폐기물관리법（제15조의2, 제25조 및 제46조)
2. 개농장에서 남은 음식물 개에게 급여
– 남은 음식물을 반추동물 이외의 사료 또는 사료원료로 사용하는 경우에는 100℃에서 30분 이상 가열처리해야 함.
※ 검토법률 : 사료관리법(제14조 제1항 및 제2항)
3. 불법 개농장 배설물로 인한 피해
– 개사육시설에서 배출된 분뇨로 인한 환경 위해사항은 확인되지 않았습니다.
※ 검토법률 : 가축분뇨의 관리 및 이용에 관한 법률(제2조 및 제11조)
4. 안락사외 개 도살 행위
– 관련법에 따라 위법시 적법하게조치 하고 있음
※ 검토법률 : 동물보호법(제8조제1항제4호)
5. 개 도살장 운영
– 개도축에 대한 규정은 축산물위생관리법에서 다루고 있지 아니하여 위반사항으로 규정할 수 없음
※ 검토법률 : 축산물위생관리법(제7조제1항)
6. 도축된 개를 전시·판매 행위 / 보신탕으로 판매행위
– 축산물 위생관리법상 가축으로 정하지 않아 식용견 유통 및 고기 위생관리에 따른 규정과 단속사항은 정해지지 않음
– 개고기가 식품의 기준 및 규격에서 식품원료로 인정하지 않아 식품위생법 적용 할 수 없음
※ 검토법률 : 식품위생법(제4조, 제44조제1항제1호)
검토결과 : 동물보호법, 가축분뇨법, 폐기물관리법, 사료관리법내에서 위법시 조치해야하고, 타 법률은 규정에 정해있지 않아 법적용 안됨

1. Food waste waste fee
– In accordance with the relevant laws, matters related to the discharge and disposal of food waste are prescribed, Due to regular and occasional inspections, we are taking legal action when violations are found.
※ Review Law : Waste Management Act(제15조의2, 제25조 및 제46조)
2. Dog food left over from dog farms
– When the remaining food is used as feed or feedstock other than ruminants, it must be heat treated at 100℃ for at least 30 minutes.
※ Review Law : Feed Management Act(제14조 제1항 및 제2항)
3. Damage caused by illegal dog farm excrement – No environmental hazards caused by excrement from dog breeding facilities have been identified.
※ Review Law : Act on the management and use of livestock manure(제2조 및 제11조)
4. Dog slaughter
– In accordance with the relevant law, it is legally taken in case of illegal law.
※ Review Law : Animal Protection Act(제8조제1항제4호)
5. Dog slaughterhouse operation
– The regulations on the opening and closing of livestock are not covered by the Livestock Products Sanitation Control Act and cannot be defined as violations.
※ Review Law : Livestock Sanitation Management Act(제7조제1항)
6. Displaying and selling slaughtered dogs / Sales act as Boshintang
– Due to the livestock hygiene management law, it is not determined to be a livestock, so the regulations and crackdowns for edible dog distribution and meat hygiene management are not determined.
– Food hygiene law cannot be applied because dog meat is not recognized as a food raw material in food standards and specifications.
