result 1. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원에 대하여 다음과 같이 안내드립니다.
2. 귀하의 민원은 우리시에서 운영중인 불법 개농장,도살장,식당 등에 대한 즉각적인 중단 조치와 공식문서의 발급 요청인 것으로 판단되며 법적·행정적 검토 결과를 다음과 같이 안내드립니다.
첫째, 귀하의 민원 지적사항인 음식물류 폐기물을 재사용하여 개 사육시설을 운영하고 있는 사업장을 점검하였습니다. 해당 시설은 「폐기물관리법」 제46조에 따라 폐기물처리 신고를 득하여 사료화하고 있었습니다. 또한, 적정하게 발급받은 수집?운반증을 소지하여 음식물류 폐기물을 운송하여 재활용하고 있었으며, 위반사항은 발견하지 못했습니다.
둘째, 「동물보호법」 제7조와 제8조에 따라 확인한 결과 동물의 학대와 동물사육,관리에 대하여 위반사항이 없음을 알려드립니다.
셋째, 「가축분뇨의 관리 및 이용에 관한 법률」 제11조에 따라 일정 규모 이상의 배출시설을 설치하려거나 설치·운영 중인 자는 배출시설의 설치계획을 갖추어 허가·신고를 해야 합니다. 불법으로 운영되는 가축분뇨배출시설 발견 시 관련 법에 의거 조치할 예정입니다. 「가축분뇨의 관리 및 이용에 관한 법률」 및 관련 규정에 의거 지속적인 점겅르 하고시설을 관리하도록 하겠습니다.
넷째, 「식품위생법」 제4조(위해식품등의 판매 등 금지)제5호에 따른 식품은 유전자변형식품으로 귀하께서 제기하신 민원 내용과는 상이한 부분입니다.
또한 「식품위생법」 제44조(영업자 등의 준수사항) 제1항 제1호에 따라 「축산물 위생 관리법」에 의거 가축의 범위에 개는 포함되지 않으므로 「식품위생법」 위반으로 판단하기 어렵습니다.
다섯째, 귀하께서 우리 시 장목면 옥포대첩로 1454 외 10개소의 개 사육농장에 대한 「건축법」상 불법여부 확인 확인 결과, 건축법 위반사항이 확인되지 않았음을 알려드립니다.

2. We guess your petition is immediately administrative measures that stop to run the illegal dog farms, slaughterhouses, markets, and restraurants serving dog meat in my city. You want us to issue a document enforcing fulfill laws legally
First, we inspected the facility that operates dog breeding by reusing food waste, which was pointed out in your complaint. In accordance with Article 46 of the 「Waste Management Act」, the facility has reported for waste treatment for using it as feed. In addition, In addition, the facility possesses an appropriately issued collection and transportation permit for food waste transportation and recycling, and no violations were found.
Second, as a result of checking in accordance with Articles 7 and 8 of the 「Animal Protection Act」, we inform you that there are no violations regarding animal abuse, animal breeding, and management.
Third, in accordance with Article 11 of the 「Act on the Management and Use of Livestock Manure」, those who intend to install or are installing or operating a discharge facility of a certain size or higher must prepare a plan for the installation of the discharge facility and submit permission and report. In case of discovering an illegally operated livestock manure discharge facility, measures will be taken in accordance with the relevant laws. In accordance with the 「Act on the Management and Use of Livestock Manure」 and related regulations, we will continue to check this facility.
Fourth, the foods specified in Article 4 (Prohibition of Sale of Hazardous Food) and Item 5 of the 「Food Sanitation Act」 are genetically modified foods, which are different from the complaints filed by you.
In addition, in accordance with Article 44 of the 「Food Sanitation Act」 (Compliance Matters for Business Entrepreneurs) Paragraph 1 Subparagraph 1, dogs are not included in the scope of livestock in accordance with the Livestock Products Sanitary Control Act, therefore, it is difficult to judge as a violation of the 「Food Sanitation Act」.
Fifth, a result of checking whether the dog breeding farms at 1454, Okpodaecheop-ro, Jangmok-myeon, and 10 other places in our city are illegal under the 「Building Act」, no building law violations have been found.
