1. 귀하께서 국민신문고를 통해 제기하신 민원에 대한 처리 결과를 다음과 같이 알려드립니다.

가. 동물학대 정황이 발생하였을 경우 동불보호법 제8조(동물학대의 금지) 위반행위로 보아 처벌대상이 되나 동물의 도축에 대한 조항이 명시되어 있지 아니하므로 행정적 처분은 “불가”하다고 판단되고,

나. 또한 동물의 도축 및 도살방법은 축산물 위생관리법에 의거 적용되나, 축산물 위생관리법에서 지정하는 가축으로는 소, 말, 양(염소 등 산양을 포함), 돼지(사육하는 멧돼지), 닭, 오리, 사슴, 토끼, 칠면조, 거위, 메추리, 꿩, 당나귀이며 개는 축산물 위생관리법 상 가축에 포함되지 아니하여 불법성이 있다고 판단할 법령상 근거가 불충분 하다고 판단됩니다.

2. 하지만 관련 분야의 지속적인 관심과 관리를 통해 동물복지 향상에 노력하겠습니다. 이와 관련하여 추가 문의사항이 있는 경우 함안군농업기술센터 농축산과 축산자원담당(055-580-4394)으로 연락주시면 친절히 안내해 드리겠습니다. 끝.

In addition, the slaughter and slaughter method of animals is governed by the Livestock Sanitation Management Act, but livestock designated by the Livestock Sanitation Management Act include cattle, horses, sheep (including goats such as goats), pigs (wild boar breeding), chickens, ducks, deer, rabbits, turkeys, geese, quails, pheasants, donkeys, and dogs are deemed to be unlawful under the Livestock Sanitation Management Act.
