Hongseong County refuses to respond to our petition, claiming they are not obligated to respond to a petition from a foreigner with a foreign address. Their response is not based on fact. Korea’s Civil Petitions Treatment Act which governs civil petition processing does not state that foreigners in foreign countries are excluded from filing petitions to the Korean government using the e-People petition site. On 12/31/2022, we filed an e-People petition for the dereliction of duty by Hongseong County to respond to our petition.

〇 귀하께서 제기하신 민원에 대하여 검토한 결과 ｢민원 처리에 관한 법률｣ 제2조제2호(정의)에 따라 민원인이란 행정기관에 제기하는 개인･법인 또는 단체이며, 같은 법 시행령 제2조제1항제3호(민원인 및 공공기관의 범위)에 따라 성명･주소 등이 불명확한 자는 민원인에서 제외되며
〇 민원처리에 관한 법령 해설(2017년 03월 행정안전부 발간)에 따르며, 법령에는 외국인이 민원인에 해당하는지 여부에 대하여 명확히 규정되어 있지 않으나, 상기 법에 따라 국내에 주소 혹은 거소를 두고 있는 외국인이나, 외국 법인 또는 단체는 민원인에 포함된다라고 해설하고 있습니다.
〇 따라서, 상기 상담민원은 외국인으로써 국내에 주소 혹은 거소를 두고 있다고 판단할 수 없고 위 해설의 요건을 충족하지 못하므로 민원인에 해당된다고 볼 수 없기에 상기 민원에 대하여 종결하도록 하겠음을 알려드립니다.

〇 As a result of reviewing the civil petitions you have filed, a civil petitioner is an individual, corporation or organization that files a civil petition to an administrative agency pursuant to Article 2 subparagraph 2 (Justification) of the Civil Petitions Treatment Act, and those whose names, addresses, etc. are unclear under Article 2 (1) 3 (Civil Petitions and the scope of public institutions) of the Enforcement Decree of the same Act are excluded from civil petitions.
〇 According to the Act on Civil Petitions Treatment (published by the Ministry of Public Administration and Security in March 2017), the Act does not specify whether a foreigner is a civil petitioner, but the Act states that foreigners, foreign corporations or organizations with addresses or residences in Korea are included in the civil petitioner.
〇 Therefore, we would like to inform you that the above complaints will be closed because the above complaints do not apply to the complainants because they cannot be determined to have an address or residence in Korea.
