가. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원에 대하여 다음과 같이 알려드립니다.
나. 귀하의 민원내용은 ‘개 사육시설 불법 영업 확인요청 민원’인 것으로 판단되며 민원내용에 대하여 다음과 같이 답변드립니다.
1) 귀하께서 민원 제기하신 개 사육시설들에 대하여 가축분뇨의 관리 및 이용에 관한 법률에 따른 설치신고 여부 확인결과 설치신고를 득한 시설 49개소, 휴업 시설 9개소, 미사육 또는 멸실된 시설 7개소, 타 축종으로 변경한 시설 6개소인 것으로 확인되었으며 설치신고를 득하지 않고 불법 영업하는 시설은 확인하지 못하였음을 안내해 드립니다.
2) 또한 폐기물관리법에 따른 재활용신고 여부 확인 결과 재활용신고 44개소, 미사육 21개소, 축종 변경 6개소인 것으로 확인되었으며 재활용신고를 득하지 않고 불법 영업하는 시설은 확인하지 못하였습니다.
3) 공공수역 분뇨, 폐수 배출이나 생활폐기물 투기 및 적재에 대한 위반사항은 발견하지 못하였고 추후 위반사항 발생 시 적법 처리토록 하겠습니다.

가. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원에 대하여 검토 결과를 다음과 같이 알려드립니다.
나. 귀하의 민원내용은‘대한민국 정읍, 불법 개고기 농장, 도살장, 시장 폐쇄’에 대한 사안으로 판단이 됩니다.
다. 귀하의 질의 사항에 대해 검토한 의견은 다음과 같습니다.
1) 귀하께서는 애완동물로 여겨지는 개를 식용으로 다루는 것에 대한 불편함을 토로 하시고, 개고기 식용 중지를 요청하신 것으로 요약이 됩니다.
2) 개는 축산법 제2조 및 같은법 시행령 제2조에 따라 가축에 해당되나, 축산물 위생 관리법 제2조 및 같은법 시행령 제2조에서 정한 가축의 범위에는 포함되지 않기 때문에 개 사육은 축산물 위생관리법 제21조 제1항 제1호의 도축업에 대한 영업의 허가 및 신고 대상이 아니어서, 사실상 개 도축에 관해 정해 놓은 규정은 없습니다. 따라서, 요청하신 사안들은 행정 집행기관인 시군구보다 중앙정부에서 정책적으로 다루어져야 할 문제로 판단이 됩니다.
3) 수의학적 치료의 필요성과 같은 정당한 사유없이 개를 도살하는 행위 또는 식용으로 개를 도살하는 행위는 동물보호법 제 8조 1항 4항을 위반하는 행위로제46조(벌칙) 3년 이하의 징역 3천만원 이하의 벌금으로 형사처벌 대상입니다.
4) 우리 시에서도 귀하께서 요청하신 불편사항에 대하여 같은 사례가 되풀이 되지 않도록 지속적으로 현장점검 및 지도해 나가겠습니다.

가. 식품위생법 제4조(위해식품등의 판매 등 금지) 3호와 관련하여 질문해주신 ‘개의 지육이 병을 일으키는 미생물에 오염된 경우’는 병을 일으키는 미생물에 오염되었거나 그러할 염려가 있어 인체의 건강을 해칠 우려가 있는 것으로 보이기 때문에 위법이라 판단할 수 있습니다.
