result 1. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원에 대한 검토 결과를 다음과 같이 알려드립니다.

2. 귀하의 질의 내용을 종합하여 볼 때, 귀하께서는 ‘개의 도축 관리, 개의 식용에 관한 사항’에 관하여 질의하신 것으로 판단됩니다.

○ 개는 현행 축산물 위생관리법령상 가축의 범위에 포함하고 있지 않으므로, 개의 사육·도축 및 개고기 유통·판매 등 개고기 식용 관련 사항은 축산물 위생관리법령의 적용 대상이 아닙니다.

※ 「축산물 위생관리법」 제2조 및 같은 법 시행령 제2조 참고

○ 개고기는 식품으로서의 건전성에 대한 사회적 합의가 이루어지지 않아 식품원료로 인정하고 있지 않으나, 우리나라에서 예전부터 오랫동안 섭취하여 오고 있는 식문화로 현재까지 식용으로 소비되고 있습니다.

– 이러한 상황에서 개고기 식용을 금지시키기 위해서는 사회적 합의가 선행될 필요가 있습니다.

○ 개고기 식용과 관련한 사항은 농식품부, 환경부 등 관련 부처간 협의와 국민의 대표기관인 국회 등 여러 분야의 의견을 수렴하여 충분한 논의가 필요한 사항으로 판단하고 있으며,

– 정부는 각계에서 제시하는 의견을 지속적으로 경청하여 사회적 합의 형성 과정에 적극 참여하겠습니다.

Summary of requested petition sales of dog meat, how slaughter of dogs is controlled under the Livestock Products Sanitary Control Act
Results 1. Thank you for filing a petition to the Ministry of Food and Drug Safety (MFDS) via e-People Korea. We would like to provide you with the answer to your petitions.

2. Below is the answer to your inquiry about how slaughter of dogs is controlled under the Livestock Products Sanitary Control Act and sales of dog meat.

○ Dogs do not fall in the category of livestock under the current Livestock Products Sanitary Control Act. Thus, raising and slaughtering of dogs or distribution and sales of dog meat are not subject to the Livestock Products Sanitary Control Act.
※ Please refer to Article 2 of the Livestock Products Sanitary Control Act and Article of the Enforcement Decree of the Act.

○ Dog meat is not deemed as food ingredients since there is no social consensus on its integrity as food. However, it has been consumed as food in Korea for a long time.
– In this concept, to ban consumption of dog meat requires social consensus in advance. Until then, the Ministry of Food and Drug Safety(MFDS) monitors this issue as to food sanitation.

○ In addition, dog meat is an issue requiring further discussion between relevant ministries such as the Ministry of Agriculture, Food and Rural Affairs and the Ministry of Environment, and the National Assembly should gather public opinions to represent the public sentiment.
– The government will make sure to listen to opinions from as many stakeholders as possible and to actively participate in creating a social consensus.

○ For your reference, In the present Assembly, amendment on the Animal Protection Act(within the remit of the Ministry of Agriculture, Food and Rural Affairs) to include the ban of the use and sale of dog and cat meat as a food after slaughter and processing and related penalty was proposed(in 30th December 2020) and discussed(in 16th February 2021) at the Agriculture, Food and Fisheries Committee, and is currently tried by Legislation Review Subcommittee.
– In the 20th Assembly(2016-2020), several amendments about dog meat were proposed such as amendment to the Animal Protection Act(within the remit of the Ministry of Agriculture, Food and Rural Affairs) to include the ban of the arbitrary slaughter of dogs(proposed by 10 lawmakers), a new Livestock Industry Act(within the remit of the Ministry of Agriculture, Food and Rural Affairs) to exclude dogs from livestock under the Act(proposed by 10 lawmakers), and an amendment to the Wastes Control Act(within the remit of the Ministry of Environment), and failed to pass the Assembly due to the closure of the session.
