1. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원(신청번호 1AA-2008-0001391 등 2건)이 다부처 민원으로 설정됨에 따라 식품의약품안전처 소관사항에 대한 검토 결과를 다음과 같이 알려드립니다.

2. 귀하께서는 ‘축산물 위생관리법령상 개의 도축 관리, 개의 식용에 관한 사항’에 대하여 질의하신 것으로 이해되어 아래와 같이 답변 드리겠습니다.

<‘축산물 위생관리법령상 개의 도축 관리’ 여부에 대한 답변>

○ 축산물 위생관리법령은 축산물의 위생적인 관리와 그 품질의 향상을 도모하기 위하여 가축의 사육·도살·처리와 축산물의 가공·유통 및 검사에 필요한 사항을 정함으로써 축산업의 건전한 발전과 공중위생의 향상에 이바지함을 목적으로 하고 있습니다.

○ 현행 축산물 위생관리법령에서는 ‘가축’이란 소, 말, 양(염소 등 산양을 포함한다), 돼지(사육하는 멧돼지를 포함한다), 닭, 오리, 그 밖에 식용을 목적으로 하는 동물로서 대통령령으로 정하는 동물(사슴, 토끼, 칠면조, 거위, 메추리, 꿩, 당나귀) 등 13종을 규정하고 있으며, 개는 축산물 위생관리법령상 가축의 범위에 포함하고 있지 않습니다.

○ 따라서, 개를 도축하는 행위는 축산물 위생관리법령의 적용 대상이 아님을 알려 드립니다.

<‘개의 식용에 관한 사항’에 대한 답변>

○ 식품의약품안전처는 국민의 식품안전과 위생을 책임지는 일을 임무로 하고 있으며,식품으로 인하여 생기는 위생상의 위해를 방지하고 식품영양의 질적 향상을 도모하며 식품에 관한 올바른 정보를 제공하기 위하여 최선을 다하고 있습니다.

○ 귀하께서 말씀하신 개고기 식용에 관한 사항은 사회적으로 상반된 견해가 첨예하게 대립되어 있어 국민적 합의가 부족한 현 상황을 감안할 때 이를 법으로 금지하는 것은 현실적으로 어려운 실정입니다.

○ 따라서, 동 사안은 범국민적으로 다양한 측면에서 심도 있는 논의를 통해 사회적 합의가 도출되는 등의 과정을 거친 후에 검토될 수 있을 것으로 판단됨을 알려 드리니 이 점 양해하여 주시기 바랍니다.

Results 1. Thank you for filing a petition to the Ministry of Food and Drug Safety (MFDS) via e-People Korea. Your petition (Application No. 1AA-2008-0001391, 1AA-2008-0002490) includes contents that involve more than one ministry. We would like to provide you with the answer to the part the Ministry of Food and Drug Safety is in charge of.

2. Below is the answer to your inquiry about how slaughter of dogs is controlled under the livestock products sanitary laws and sales of dog meat.

○ The livestock products sanitary control laws aim to contribute to the sound development of the livestock industry and improvement in public health by prescribing the matters necessary for the raising, slaughter and disposal of livestock and the processing, distribution and inspection of livestock products in order to promote the sanitary management of livestock products and improvement in the quality thereof.

○ Under the current laws regarding livestock products sanitary, the term “livestock” indicates 13 species of animals including cattle, horses, sheep (including rock goats, such as goats; hereinafter the same shall apply), swine (including raised wild boars; hereinafter the same shall apply), chickens, ducks, and other animals prescribed by Presidential Decree, as animals for food (deer, rabbits, turkeys, geese, quails, pheasants, and donkeys). Dogs do not fall under the category of livestock.
※ Please refer to Article 2 of the Livestock Products Sanitary Control Act and Article of the Enforcement Decree of the Act.

○ Therefore, the laws mentioned above do not apply to slaughter of dogs.

○ Since this petition includes questions to multiple different ministries, please refer to the response from the Ministry of Agriculture, Food and Rural 7Affairs for information on your claims of animal abuse. The Ministry of Food and Drug Safety addresses your ‘recommendation on the restriction of human consumption of dog meat’ as follows:

A. This particular ministry is responsible for food safety and sanitation. It exerts its best effort to provide correction information concerning food while attempting to prevent hygienic hazards caused by food items and enhance the quality of food nutrition.
B. It is practically difficult to prohibit the human consumption of dog meat by a statute in view of the current situation that a consensus can hardly be reached as social opinions are deeply divided regarding the human consumption of dog meat.
C. Therefore, we hereby inform you that this issue can apparently be
examined after a social consensus is derived through a nationwide in-depth discussion in various different aspects.
