1. 안녕하십니까? 귀하께서 국민신문고에 신청하신 민원(1AA-2109-2227491) 외 3건에 대한 축산과 및 관련 부서 법률 검토결과를 다음과 같이 안내해드립니다.

2. 귀하의 민원내용은 “불법개농장 및 판매업소 조치요청”에 관한 것으로 이해(또는 판단) 됩니다.

3. 귀하의 질의사항에 대해 검토한 의견은 다음과 같습니다.
가. 축산과
1) 「동물보호법」 제8조제1항4호 위반여부
– 해당 조항은 동물학대 금지 관련 내용으로써 식용을 위한 도축 불법여부 확인에 적용하는 것은 다소 어려움이 있습니다. 식용을 금지하는 관련법이 제정될 시 위반여부 확인 및 처벌이 가능할 것으로 판단됩니다.

2) 「동물보호법」 제8조1항1호 및 제10조 위반여부
– 축산물위생관리법 상 가축의 도살방법 중 전살법이 존재하나 가축에 개가 포함되지 않아 도축방법에 대해 불법여부를 확인하기가 어렵습니다. 다만, 다른 개들이 보고 있는 환경에서 도축이 이루어질 시 이는 명백한 동물학대에 해당됩니다. 또한 고통을 최소화 할 수 있는 방법을 사용하지 않고 지속적인 고통을 줄 시 동물의 도살방법에 위반된다는 말씀을 드립니다.

2. Your complaints are understood (or judged) to be about “Request for action at illegal dog farms and retailers”.
3. Your comments on your questions are as follows:
A. Livestock production
1. Violation of Article 8 (1) 4 of the Animal Protection Act
– The provision is related to the prohibition of animal abuse, and it is somewhat difficult to apply it to the verification of illegal slaughter for food. It is judged that if a related law banning the use of food is enacted, it will be possible to check for violations and punish them.
2. Violation of Article 8 (1) 1 and 10 of the Animal Protection Act
– Under the Livestock Sanitation Control Act, there is a slaughter method for livestock, but it is difficult to check whether the slaughter method is illegal because the livestock does not include dogs. However, if slaughter is carried out in the environment that other dogs are looking at, this is clearly animal abuse. Also, I would like to say that continuous pain without using a method to minimize pain violates animal slaughter methods.

B. Environmental Management
4. I read your complaint letter about illegal dog meat farms, slaughterhouses, markets. As man in charge of environmental management department, I answer your complain.
5. As you write on your complaint letter, livestock excretions from illegal dog meat farms are violation of regulation on Livestock Excreta Act 11.
6. We crackdown illegal dog meat farms, if you know, please let us know.
7. Our city is cracking down on illegal dog farms, and if you have any information about the related farms, please contact the Environmental Management Department. In addition, there are legal dog farms in Naju, which are protected by Korean law.

C. Cleaning resources

10. In response to your complaint about closing illegal dog farms, slaughterhouses, markets, and bosintang restaurants in Naju, we will respond to the Waste Management Act as follows.
11. If animal and vegetable residues and food wastes are recycled as food for their livestock (dogs) pursuant to Article 46 of the Waste Management Act, they are subject to waste disposal (recycling) report.
12. There is no current identification of farms that do not implement waste disposal (recycling) reports and recycle animal and vegetable residues and food waste as food for their own livestock (dogs).

D. Health and hygiene
14. It shall not be regarded as an act of selling food or selling sick animal meat for the act of displaying and selling dogs as food in traditional markets or dog soup handling businesses, etc.
15. General restaurant operators who handle and sell dogs as food are obliged to comply with hygiene standards prescribed by the Food Sanitation Act, and if they violate such regulations, they may be subject to disposition under the relevant statutes.
16. According to Article 44 (1) 1 of the Food Sanitation Act, animals used for livestock products or experiments that have not been inspected under Article 12 of the Livestock Sanitation Control Act shall not be transported, stored, displayed, sold, or used for food preparation or processing.
17. In cases not included in livestock under the Livestock Sanitation Control Act, livestock inspection, etc. are not subject to management.
18. Dog meat is not recognized as a food ingredient by the Food Standards and Standards because there is no social consensus on its soundness as food, but prohibiting matters related to consumption is a priority for social consensus.
