[농업정책과]
개 식용 금지 관련하여는 사회적인 합의 및 제도 정비가 필요한 상황이며, 우리시에서는 개 도살 관련 동물학대를 방지하기 위하여 현장지도, 단속을 지속 실시하고 있습니다. 더 많은 문의사항이 있으신 경우 농축산지원과 동물복지팀(031-590-2324)에 연락주시면 성심성의껏 답변하여 드리겠습니다.

[위생과]
○ 민원제기하신 내용대로 개고기를 판매하는 일반음식점 및 무신고 영업장 관련하여 안내드립니다.
○ 안타깝게도 대한민국 법령 상 개고기판매 금지는 법으로 제한할 수 없으나, 식품위생법 상 개고기 등 음식물을 제조, 가공하여 판매하는 일반음식점 중 무신고 영업장은 지속적으로 단속하여 경찰서 고발조치중이며, 영업신고 된 영업장에는 위생 점검 시 관련사항을 영업주에게 고지하고 식품위생법 관련 현장교육 및 계도 조치하여 위생에 최선을 다하고 있습니다.
○ 다시 한 번 민원제기하신 귀하께 진심으로 감사드립니다.

[진건읍 도시건축과]
– 동식물성 잔재물 또는 음식물류 폐기물을 가축의 먹이로 재활용 하려는 자는 폐기물관리법 제46조제1항제1호에 따라 신고를 득하여야하며, 법령을 위반하여 행정기관에 신고를 하지 아니하고 음식물류폐기물을 재활용하는 자에 대하여 관련규정을 준수토록 지도하거나 사법기관에 고발하고 있습니다.

– 가축분뇨배출시설을 무단으로 설치하여 운영하면 가축분뇨법 제11조(배출시설의 설치)에 위반되며, 발생하는 가축분뇨를 무단으로 배출하면 같은 법 제17조(배출시설 및 처리시설의 관리 등)에 위반됩니다. 위 법령이 정한 절차를 위반한 자에 대해서는 법제도 내에서 관련규정에 대한 행정조치 예정임을 알려드립니다. 또한, 우리 시에서는 지속적으로 가축분뇨배출시설에 대해 지도·점검을 실시하여 환경 피해를 줄이도록 노력하겠으며, 불법 개농장에 대해서 중점관리토록 하겠습니다. (도시건축과 031-590-3983)

Thank you for your petition on illegal dog farms, slaughterhouses, markets, and dog meat restaurants. The following is the response to your petition which is provided by related divisions.

As for the request to take an immediate action to crack down on the illegal dog farms, slaughterhouses, markets, and restaurants that serve dog meat,

→ Response by Agriculture and Livestock Support Division, Agricultural Technology Center :
With regard to the banning of eating dog meat, further social consensus and institutional arrangements are necessary in South Korea. In the meantime, Namyangju City has been continuously implementing crackdowns and guidance in the field to prevent animal abuse including dog slaughtering. → Response by Sanitation Policy Division :
Unfortunately, according to national relevant laws in South Korea, we cannot prohibit the sale of dog meat. And pursuant to Korea’s food hygiene regulations, we have been constantly cracking down on and reporting to the police restaurants which illegally produce, process, and sell foods including dog meat. For licensed restaurants, we have been doing our best to instruct and provide owners of restaurants with relevant information and guidelines during a sanitary inspection in order to comply with the field instruction and guidance for sanitary control pursuant to Food Sanitation Act.

Feeding food waste to dogs in dog meat farms is deemed as the act of recycling food waste by feeding their own livestock in accordance to Article 46, Paragraph 1 of the Waste Control Act, and Article 66 (asterisk 16) of its Enforcement Decree, It is specified in the law that waste food shall be registered in advance to recycle food waste as a livestock feed. As for those who illegally recycle food waste in violation of relevant regulations and procedures and without reporting to a relevant administrative agency, we will continue to clamp down on and instruct to ensure that they obey the regulations.

As for those who install and operate dog breeding facilities with the size of 60㎡ or more, Article 11 (the Installation of Discharge Facilities of Livestock Waste) of the Act on the Management and Use of Livestock Excrement stipulates that they should report the installation of discharge facilities of livestock waste to a relevant agency. The city of Namyangju will continue to thoroughly crack down on and instruct those who illegally install and operate dog breeding facilities without reporting in order to make them comply with the relevant regulations.
