“ 양 쪽 두 농장. 1만 마리 규모? “
와치독은 오늘 평택 개농장에 와 있습니다.
그동안 보지 못했던 공장화된 대형 개농장. 악랄한 이 곳은 일반 뜬장을 3분의 1로 나눠버렸습니다. 뜬장 하나는 플라스틱 이동식 켄넬만 했고 그 안에 큰 도사견 한 마리가 몸을 돌리기도 어려운 공간에서, 딱 자기 몸크기와 비슷한 사이즈의 뜬장에서 사육되고 있었습니다.
와치독은 양 옆 2개의 개농장에 평소 1만 마리 규모. 한 해 최소 3만마리가 사육된 개농장을 고발할 것입니다.
반드시 없애겠습니다.

〇 (Resource Circulation Division)
-In case illegal activities regarding household waste are discovered through inspection of the farm, in accordance with Article 8 of the Waste Management Act (prohibition of dumping, etc.) and Article 9 of the Pyeongtaek City Waste Management Ordinance (Cleanliness Maintenance Measures) We inform you that we plan to take measures to maintain cleanliness and impose fines on the farmer.

〇 (Building Permit Division)
– Regarding the reported matters related to illegal buildings at 360-1 Yong-dong, Pyeongtaek-si, 127-13, Singung-ri, Paengseong-eup, and 198, Wonjeong-ri, Paengseong-eup, Pyeongtaek-si, the violation of the Building Law was confirmed and ordered to be corrected by the owner. We inform you that we will take legal action according to the processing procedure.

〇 (Ecology and Rivers Department)

Accordingly, we inform you that the legislative body needs to enact or amend the law.

– According to the 『Animal Protection Act』, in order to detect wheat slaughter on a dog breeding farm or in a secret place in relation to animal abuse, on-the-spot detection by reporting is important. When complaints are reported, we will actively cooperate and deal with them.

〇 (Environmental Sanitation Division, Anjung Branch)
– We inform you that no violations were found as a result of on-site verification on June 17, 2021 and inspections on the Waste Management Act and Livestock Excreta Act.

〇 (Architectural and Greenery Division, Anjung Branch)
– Buildings above 603-3 Gileum-ri, Oseong-myeon, 157-2,157-3 Anhwa-ri, Oseong-myeon, 1339-3 Gojan-ri, Cheongbuk-eup, 166 Hyeongok-ri, Cheongbuk-eup, and 305-1 Okgil-ri, Cheongbuk-eup We will review and inform you that if there are any violations, we will take administrative action.

〇 (Environmental Sanitation Division, Songtan Branch)
– As a result of inspecting the dog kennel you pointed out, we are notifying you because we did not find any illegal matters such as the Waste Management Act.

〇 (Songtan Branch Office of Architecture and Greenery)
– 762-2, 763-1, Naecheon-ri, Seotan-myeon, 303-2 Maduri, 211, 212, 212-1, 313, 314, Masan-ri, Jinwi-myeon In accordance with Article 79 (Measures for Violating Buildings, etc.), a correction order for restoration to its original state is currently scheduled. We inform you that this is a plan.

– Twelve out of 16 unregistered suspicious dog breeding farm locations you have raised are workplaces that have obtained permission to install (report) discharge facilities in accordance with Article 11 of the Act on the Treatment and Use of Livestock Manure, and 4 of them are dog farms. Please note that this is not a breeding farm.

– For the above dog breeding farms, we will guide and check the operation in compliance with the livestock excreta treatment facility management standards through regular guidance and inspection.

2. 관내에 위치한 주요 개농장을 대상으로 취한 조치에 대하여 아래와 같이 답변드립니다.

〇 (자원순환과)
-해당 농장에 대한 점검을 통해 생활폐기물에 대한 불법행위를 적발할 경우 『폐기물관리법』 제8조(폐기물의 투기 금지 등) 및 「평택시 폐기물 관리 조례」 제9조(청결유지 조치) 규정에 따라 농장주에게 청결유지조치 및 과태료 부과를 할 예정임을 알려드립니다.

〇 (건축허가과)
– 평택시 용이동 360-1번지, 팽성읍 신궁리 127-13번지, 팽성읍 원정리 198번지 상 불법건축물 관련하여 제보하신 사항에 대해서 건축법 위반사항을 확인하여 소유자에게 시정할 것을 명령하였으며, 미 이행 시에는 위반건축물 처리 절차에 따라 의법 조치할 예정임을 알려드립니다.

〇 (생태하천과)
– 서탄면 내천리 762-2, 서탄면 마두리 303-2, 지제동 572-13, 진위면 마산리 211, 팽성읍 신궁리 127-13, 팽성읍 원정리 198번지는 「하수도법」제34조에 따른 개인하수처리시설 설치 대상이 아니며,
– 평택시 서탄면 마두리 45-2, 오성면 길음리 603-3, 용이동 360-1, 진위면 야막리 349-1, 진위면 하북리 628-2, 628-6, 청북읍 옥길리 305-1, 청북읍 현곡리 166번지는 현재 개농장을 운영하지 않는 것으로 확인되었으며,

– 오성면 안화리 157-2, 157-3, 진위면 마산리 313, 314, 청북읍 고잔리 1339-3번지는「하수도법」제34조 및 제37조에 따라 개인하수처리시설을 적법하게 설치 및 신고하여 사용 중인 곳으로 저촉사항이 없음을 알려드리며, 기타 다른 사항의 경우 “가축분뇨의 관리 및 이용에 관한 법률 등”에 따라 처리할 사항으로 판단됩니다.

〇 (축산과)
-『축산물위생관리법』제2조의 규정에 따르면 개는 가축에 해당하지 않아 현재 개고기의 유통 및 판매에 대하여 처벌할 수 있는 규정이 별도로 없으며, 개고기의 섭취와 관련하여 법률로 금지하는 것은 사회적 합의에 따라 입법기관에서 법률 제정 또는 개정이 필요한 사항임을 알려드립니다.

-『동물보호법』상 동물학대와 관련하여 개 사육농장 또는 은밀한 장소에서의 밀(密)도살행위를 적발하기 위해서는 제보에 의한 현장적발이 중요하므로 수사권한이 있는 사법기관과의 공조가 필요하며, 민원제보 시 적극 공조하여 처리토록 하겠습니다.

〇 (안중출장소 환경위생과)
– 2021. 6. 17. 현장확인 및 폐기물관리법 및 가축분뇨법 등에 대한 점검결과 위반사항은 발견치 못하였음을 알려드립니다.

〇 (안중출장소 건축녹지과)
– 오성면 길음리 603-3번지, 오성면 안화리 157-2,157-3번지, 청북읍 고잔리 1339-3번지, 청북읍 현곡리 166번지, 청북읍 옥길리 305-1번지 상 건축물에 대하여는 「건축법」에 따른 위반여부를 검토하여 위반사항이 있을 경우 행정조치할 예정임을 알려드립니다.

〇 (송탄출장소 환경위생과)
– 지적하신 해당 개사육장을 점검한 결과 폐기물관리법 등 위법사항을 발견치 못하였기에 알려드립니다.

〇 (송탄출장소 건축녹지과)
– 서탄면 내천리 762-2, 763-1, 마두리 303-2, 진위면 마산리 211, 212, 212-1, 313, 314 대지에 대한 불법사항 [건축법 제11조(건축허가)]이 적발되어 건축주에게 건축법 제79조(위반건축물 등에 대한 조치 등) 규정에 의거 현재 원상복구 시정명령 예정이며, 추후 불법 관련 원상복구 등 시정조치를 이행하지 아니할 경우 건축법 제80조에 따라 이행강제금 부과 및 고발 등 행정조치 할 계획임을 알려드립니다.

– 또한 서탄면 마두리 45-2, 진위면 야막리 349-1, 진위면 하북리 628-2, 628-6 대지에 대한 건축물은 농사작물 재배시설로 이용하는 등 개사육 농장시설은 없었음을 알려드립니다.

〇 (환경지도과)
– 귀하께서 제기하신 미등록 의심 개 사육 농장 소재지 16개소 중 12개소는「가축분뇨의 처리 및 이용에 관한 법률」 제11조의 규정에 따라 배출시설 설치허가(신고)를 득한 사업장이며, 4개소는 개사육 농장이 아님을 알려드립니다.

– 위 개 사육 농장에 대하여는 정기적인 지도 점검을 통하여 가축분뇨처리시설 관리기준을 준수하여 운영하도록 지도 점검하겠습니다.
