2. 동물보호에 대한 귀하의 관심에 감사드립니다.
귀하께서 제기하신 ‘동물보호법제8조제1항제1호 및 제4호, 같은 법 제10조’의 규정 위반 건에 대하여 검토한 결과,
통영시는 동물학대 등 동물보호법 위반 사항이 발생하지 않도록 홍보 및 지도를 위하여 노력하고 있으며, 동물을 불가피하게 죽여야 하는 경우에는 고통을 최소화하는 방법으로 안락사에 의하여 처리하고 있습니다.
개고기 거래에서 개에게 공급되는 음식물 쓰레기는 축산물 및 어류 사료 관리법 제14조 제1항 및 제2항, 식품폐기물 무단 수거 및 사료 제공 행위를 위반한 사항, 육류 무역에 종사하는 개들은 이 규정을 위반한 사항건에 대하여 검토한 결과
사료관리법 제14조제1항제7호 및 제2항에 따라 “인체 또는 농림축산식품부장관이 정하여 고시한 동물등의 질병원인이 우려되어 사료로 사용하는 것을 금지한 동물등의 부산물ㆍ남은 음식물 등 농림축산식품부장관이 정하여 고시한 것” 으로 “누구든지 이를 사료로 사용하여서는 아니 된다.”로 규정하고 있는 바
농림축산식품부장관이 고시한
“1. 소해면상뇌증 등과 관련이 되는 소·사슴·양(면양·염소) 등 반추동물
2. 조류인플루엔자(AI)와 관련이 되는 닭·오리·꿩·거위·메추리·칠면조·타조
등 가금류”의 부산물?남은 음식물을 사료로 사용하여서는 아니 되며,
이를 위반시 같은 법 제33조제2항의 규정에 따라 3년 이하의 징역 또는 3천만원 이하의 벌금에 처하게 됨을 알려드립니다.
한편, 개 관련한 육류 무역과 유통의 형태가 매우 다양하여 각각의 상황이나 형태에 따라 법적인 검토가 필요할 것으로 판단됩니다.
축산물위생관리법 제7조에서 “가축”의 도살처리에 관하여 규정하고 있으나 본 법에서의 “가축”의 정의는 제2조 제1호에 의거 소, 말, 양, 돼지, 닭, 오리와 대통령령으로 정하는 동물(사슴, 토끼, 칠면조, 거위, 메추리, 꿩, 당나귀)로 한정하고 있으므로 개는 축산물위생관리법의 적용을 받지 않습니다. 따라서 개 도살장을 운영하는 상인에 대하여 축산물위생관리법을 적용할 수 없는 것으로 판단됩니다.
우리시는 가축사육시설이 『가축분뇨의 관리 및 이용에 관한 법률』 규정에 의거 배출시설에 해당 될 경우 배출시설 설치허가 또는 설치신고를 득하도록 하고 있으며,
이를 위반할 경우 관련 법령에 따라 행정처분하고 있습니다.
우리시는 음식물류폐기물을 자신의 가축의 먹이로 재활용하고자 할 경우 「폐기물관리법」규정에 의거 폐기물재활용신고를 하도록 하고 있으며, 이를 위반할 경우 관련 법령에 따라 행정처분하고 있습니다
귀하께서 제기하신 ‘개고기를 제공하는 식당을 단속하기 위한 즉각적인 조치를 취하기 바란다’는 내용 및 ‘식품위생법 제44조제1항제1호’의 규정 위반 건에 대하여 검토한 결과,
현행법 상 식당에서 제공되는 개고기는「축산법」으로 정의되는 가축이 아니며, 식품위생법 제44조제1항제1호 규정과 관련하여「축산물위생관리법」에 적용되지 않는 먹거리로 해당 업소에 대한 조치는 불가할 것으로 판단됨을 알려드립니다.
우리시에서는 반려동물을 기르는 반려인들이 증가함에 따라 반려동물 등록, 반려동물 관련 홍보 추진, 반려동물놀이터 조성(예정) 등 반려동물과 반려인, 비 반려인이 함께하는 사회적 분위기를 조성하기 위하여 노력하고 있습니다.
아울러 동물보호에 대한 지속적인 문제제기에 의하여 사회적 문제로 대두됨에 따라 관련 법령의 개정 등 새로운 환경이 조성될 시, 이에 따른 적법한 조치를 하고자 함을 알려드립니다.

As a result of your review of your violation of the provisions of Article 8 (1) 1 and 4, Article 10 of the same Act,

Tongyeong City strives to promote and guide the animal protection law, such as animal abuse, and if it is inevitable to kill animals, it is handled by euthanasia by minimizing pain.

Food waste supplied to dogs in dog meat transactions was reviewed under Articles 14 (1) and (2) of the Livestock Products and Fish Feed Management Act, violation of unauthorized collection and feed provision of food waste, and violation of these regulations by dogs engaged in meat trade.

According to Article 14 (1) 7 and 2 of the Feed Management Act, “Any by-product of animals, such as by-products and leftovers, that are prohibited from being used as feed due to concerns over the cause of disease in animals, etc. determined and publicly notified by the Minister of Agriculture, Food and Rural Affairs.”

On the other hand, the forms of meat trade and distribution related to dogs vary so much that legal review is required depending on the circumstances or types of meat.

Article 7 of the Livestock Products Sanitation Control Act provides for the culling of “livestock,” but the definition of “livestock” in this Act is limited to cattle, horses, sheep, pigs, chickens, ducks, and animals (deers, rabbits, turkeys, geese, quails, pheasants, donkeys) prescribed by Presidential Decree pursuant to Article 2, so dogs are not subject to the Livestock Sanitation Control Act. Therefore, it is judged that the Livestock Product Sanitation Control Act cannot be applied to merchants who operate dog slaughterhouses.

In accordance with the Regulations of the Act on the Management and Use of Livestock Excreta, the Korean Government is required to obtain permission to install or report the installation of livestock breeding facilities if they fall under the regulations of the Act on the Management and Utilization of Livestock Excreta.
In case of violation, administrative disposition is made in accordance with the relevant statutes.

If we want to recycle food waste as food for our own livestock, we are required to report the recycling of waste under the Wastes Control Act. If we violate the regulations, we are taking administrative measures in accordance with the relevant statutes.

As a result of your review of the content of ‘immediate measures to crack down on restaurants serving dog meat’ and the violation of the provisions of Article 44 (1) 1 of the Food Sanitation Act,

According to the current law, dog meat provided in restaurants is not a livestock defined by the Livestock Act, and in connection with the provisions of Article 44 (1) 1 of the Food Sanitation Act, food is not applicable to the Livestock Sanitation Control Act, so it is deemed impossible to take action against the restaurant.

As the number of pet owners increases, we are striving to create a social atmosphere in which pets, pets, and non-pets join, such as registration of pets, promotion of pet-related promotion, and creation of pet playgrounds.

In addition, we would like to inform you that we will take legal action if a new environment is created, such as the revision of the relevant statutes, due to the continuous raising of the issue of animal protection.
