2. 귀하께서 제출하신 민원의 내용은 “동물(개)에 대한 불법 사육 및 도축”에 관한 것으로 이해됩니다.

3. 귀하의 민원에 대한 검토결과는 다음과 같습니다.
가. 귀하께서 지정해주신 농가는 다음과 같습니다.

나. 가축분뇨의 관리 및 이용에 관한 법률에 따른 점검결과는 다음과 같습니다. 승주읍 도정리 421, 424는 2019년 7월 31일 폐업하였습니다. 그 외 농가는 적정한 배출신고 후 운영중입니다. 위와 같은 불법행위로 인해 환경피해가 없도록 지속적으로 지도·점검을 실시하겠으며, 불법행위가 적발될 경우 관련법에 의거 조치할 계획임을 알려 드립니다.
다. 불법 개 도축현장에 대한 답변입니다. 동물보호법 제8조와 관련하여 학대를 수반하는 도축현장을 찾을 수 없었으며, 동법 시행규칙 제4조(학대행위의 금지)에서, 농림축산식품부령으로 정하는 행위에 식용을 위한 개의 도축이 명시되어 있지 않기 때문에 개의 도축 자체를 처벌할 수 있는 근거가 없습니다. 축산물 위생관리법상 “개”는 가축의 범위에 해당하지 않기 때문에 개의 도축방식에 관하여 축산물위생관리법의 규정으로도 처벌이 어렵습니다.
라. 음식물류폐기물과 관련하여 검토한 결과는 다음과 같습니다. 순천시는 음식물류폐기물을 전용용기에 배출 수거하여 음식물자원화시설로 반입 퇴비화 처리하고 있으며, 다량배출사업장(음식점, 급식단체 등)은 위탁처리를 통해 퇴비화 및 사료화 하고 있습니다. 이와 관련하여 불법행위가 이루어지지 않고 있음을 알려드립니다.
마. 가설 건축물과 관련하여 검토한 결과는 다음과 같습니다. 담당부서에서는 위와 같은 불법행위가 없도록 지속적으로 지도·점검을 실시하겠으며, 불법행위가 적발될 경우 관련법에 의거 조치할 계획임을 알려 드립니다.
바. 하수도 오염에 관한 불법행위가 이루어지지 않고 있음을 알려드립니다. 해당 불법행위가 적발될 경우 관련법에 의거 조치하고 있음을 알려드립니다.
사. 생활폐기물 불법 투기 및 적재에 관한 불법행위가 이루어지지 않고 있음을 알려드립니다.

3. The results of the review of your complaint are as follows.

b. We will inform you of the inspection results of the Act on the Management and Use of Livestock Manure. Jeollanam-do Suncheon Seungju-eup Dojeong-ri 424 421 was reported closed on July 31, 2019. Other farms are operating after a proper discharge report. We will continue to conduct guidance and inspections to ensure that there is no environmental damage due to the above illegal activities. We inform you that we plan to take action in accordance with relevant laws if illegal activities are detected.
c. The inspection results for illegal dog slaughter sites are as follows. We have not been able to confirm the illegal slaughter site that was accompanied by abuse related to Article 8 of the Animal Protection Act. Since Article 4 (Prohibition of Abuse) of the enforcement regulations of the same law does not specify dog slaughter, there is no basis for punishing dog slaughter. In addition, in the Livestock Products Sanitation Control Act, because’dogs’ do not belong to the scope of livestock products, it is difficult to punish dogs in relation to the slaughter method according to the Livestock Products Sanitation Control Act.
d. The results of the review regarding food waste are as follows. Suncheon City discharges and collects food waste into exclusive containers and carries them into the food recycling facility for compost treatment, and large-discharge business sites (restaurants, food service organizations, etc.) are composting and converting them into feed through consignment treatment. Please be advised that there is no illegal activity in this regard.
e. The results of the review regarding temporary buildings are as follows. The department in charge will continue to conduct guidance and inspections to ensure that there are no illegal acts as described above, and inform you that if illegal acts are detected, they plan to take measures in accordance with relevant laws.
f. There is no illegal activity related to sewage pollution. If illegal activities are detected, we inform you that we are taking action in accordance with relevant laws.
g. We inform you that there is no illegal dumping or loading of domestic waste. If illegal activities are detected, we inform you that we are taking action in accordance with relevant laws.
