3. 귀하의 민원에 대한 검토한 의견은 다음과 같습니다.
가. 건축과
1) 동내면 원창고개길 165-1번지 및 신동면 의암리 157-1번지 상 건축물은 건축법 위반 건축물로 기 적발되어 시정명령하였으나, 이를 이행하지 않아 건축법 제80조에 따라 이행강제금 부과하고 있습니다.
2) 동면 평촌리 243-1번지 상 건축물은 건축법 위반사항 확인차 현장 근처에 방문하였으나 결빙문제로 조사하지 못하였습니다. 건축주에게 현장 확인 협조를 요청하여, 추후 건축법 위반사항 확인 시 하단의 행정절차에 따라 시정명령 처분할 예정입니다.

나. 자원순환과
1) 민원 제기한 동내면 원창고개길 165-1번지 소재지에는 가축으로서 사육 중인 개가 없음을 확인하였으며,
2) 신동면 의암리 157-1번지 소재지에는 사육 중인 개가 20여마리 있으나, 사료 급여를 하고 있었으며, 음식물류폐기물 재활용으로 인한 폐기물관리법 위반사항 없음을 알려드립니다.
3) 아울러, 동면 평촌리 372번지의 경우 대설주의보로 인해 해당 장소까지의 진입이 어려워 추후 확인 예정임을 알려드립니다.

다. 환경정책과
1) 동내면 원창고개길 165-1 (학곡리 91)
– 가축분뇨배출시설 허가받은 사업장으로 사육축종을 변경신고(염소,개→소)한 이력이 있습니다.
– 현재 개사육을 중단하고 사육하던 시설은 철거완료한 것을 확인하였고 다른 위반사항은 확인하지 못하였습니다.
2) 신동면 의암리 157-1
– 가축분뇨배출시설 신고된 사업장이며 사육축종을 변경신고(소→개)한 이력이 있으며 현재 개 32마리를 뜬장이 아닌 사육시설에서 취미 및 반려의 목적으로 사육하고 있습니다. 다른 위반사항은 확인하지 못하였음을 알려드립니다.
3) 동면 평촌리 372
– 2/22 해당사업장을 방문하고자 하였으나 소재지가 산속에 위치해 있고 전날 내린 폭설로 인하여 진입로가 막혀 접근할 수가 없었습니다. 3월 이후 재방문하여 점검을 진행할 예정임을 알려드립니다.

마. 하수시설과
1) 신동면 의암리 157-1 외 2필지에 대하여 확인한 결과, 하수도법 관련 위반 사항이 발견되지 않아 해당사항 없음을 알려드립니다.

바. 반려동물과

– 반려목적의 반려견 32마리로 일부가 동물등록 미등록
– 미등록 개체에 대해서 동물등록하도록 계도조치
– 뜬장은 없으며 건강상의 문제를 보이는 개체는 없음

2) 동내면 원창고개길 165-1 (☎033-250-3757, 김홍래 주무관)
– 동내면 원창고개길 165-1 현장확인 결과, 허가를 받은 축사 증축공사가 진행중이었으며 「국토의 계획 및 이용에 관한 법률」에 따른 개발행위 관련 위반사항은 없음을 알려드립니다.
3) 신동면 의암리 157-1 (☎033-250-3178, 김다겸 주무관)
– 대상지의 용도지역은 자연녹지지역으로 동물 및 식물관련시설의 입지는 가능하며, 국토의 계획 및 이용에 관한 법률 제56조의 행위 중 건축법의 적용을 받는 건축물의 건축, 공작물의 설치는 건축신고 시, 건축법에서 정하는 절차에 따라 협의된 사항임을 알려드립니다.

아. 민원담당관실 농지전용팀(농지법)
1) 동면 평촌리 372 (☎033-250-3774, 김다정 주무관)
– 현장확인 및 농지법 검토 결과, 동면 평촌리 372번지 내 동식물관련시설-축사부속시설은 「농지법 시행규칙 제3조제2항제1호」 규정에 의거 농지의 범위에 포함되어 농지법 상 저촉되는 행위는 없었음을 알려드립니다.

– 현장확인 및 농지법 검토 결과, 동내면 학곡리 91번지 내 동식물관련시설-축사「농지법 시행령」 제2조제3항제2호나목 규정에 의거 농지의 범위에 포함되어 농지법 상 저촉되는 행위는 없었음을 알려드립니다.

2) 동내면 학곡리 91번지 관련 국유재산 불법 점용 관련
– 동내면 학곡리 91번지 내 불법신고(개농장 관련) 건은 같은리 567번지(구거/건설부)에 대해 인근 토지주가 소하천점용허가(공작물 설치)를 득한 사항임
