Below is our translation of Daegu’s response to our petition.

We will respond as follows to your request for the ‘Implementation of the closure of Chilseong Dog Market’.

The fundamental problems of the Chilseong Dog Market are the fact that the dog meat, in reality, is being accepted (the Livestock law defines dogs as livestock), and the fact that while the Livestock Products Sanitation Control Act, which stipulates how dog is slaughtered, distributed, or eaten, is not taking a clear position at law as to whether to ban or allow dog meat production for human consumption, due to the conflicting position held by the Meat Dog Association and animal protection groups, dog meat sales have been conducted for decades.

The Animal Protection Act states that the act of killing a dog for food may be subject to criminal punishment (up to 3 years in prison or a fine of not more than 30 million won) but only under certain conditions. When it comes to dog slaughterhouses, the fact is that they are slaughtering dogs using methods that avoid direct violation of the Animal Protection Act. Therefore, it’s incredibly difficult to obtain evidence to bring a conviction, coupled with the fact that dog slaughter itself takes place in remote hidden places. Therefore, even if an investigation is raised and conducted by a police station in local jurisdiction, the internal investigation often ends up closing without any administrative measures or actions. Dog meat sale, consumption and related businesses are often seen as out of touch with modern thinking and its an emotive issue. But as there are no firm laws or other regulations that directly regulate, restrict or prohibit the business activities of the people working in this industry, we are experiencing considerable difficulties in restricting these businesses.

Furthermore, in the case of Chilseong-dong Dog Meat Alley, unlike the Busan Gupo Livestock Market and Seongnam Moran Livestock Market, in addition to the area registered as Chilseong Market, many dog meat businesses are scattered outside of the traditional market, so no formal merchants’ association has been formed. ‘Market registration’ is also impossible, and even if compensation for closure is paid to induce the closure of existing dog meat-related businesses and the existing businesses are closed, without any fundamental legal regulations on dog meat consumption and with no administrative regulations to prevent the influx of business owners into the ‘dog meat alley’ in Chilseong Market then the ‘existing dog meat business owners will just relocate to other regions and operating the same industry’. So, there are limitations in conducting the maintenance with financial compensation for livelihoods and business closures.

However, in the case of Chilseong Market, which includes some dog meat-related businesses, merchants in adjacent markets such as Chilseongwon, Gyeongmyeong Market, and nearby shopping districts established a market maintenance business association through agreement and in October 2019, it received approval for market maintenance business implementation. If they prioritize the closure of dog slaughterhouses, it is expected that dog meat distribution and supply and demand problems will be eradicated naturally. Also, as dog meat industry is a declining industry, we expect that the reduction in the dog meat markets and the voluntary conversion of the dog meat businesses will take place.

Therefore, considering the fact that it took several years to carry out the Seongnam Moran Dog Market maintenance, when implementing Chilseong-dong Dog Meat Alley Maintenance Project, through a collaboration with the Buk-gu Office and related departments, along with the Chilseong Market Maintenance Project, we are working on the reduction of dog meat market, reduction and eradicating business activities through a phased plan (the closing of the dog slaughterhouse first, expected completion in early March 2021). We ask for the participation and cooperation to help timely enactment of legislation and amendments to laws related to dog meat consumption.

Sanitation Policy Division: The Daegu City Sanitation Policy Division and Buk-gu Sanitation Division conducted a sanitation inspection on dog meat handling establishments in Chilseong Market several times in accordance with the Chilseong Dog Meat Market maintenance project plan, and uncovered and imposed fines on the two establishments that did not have a health examination for the operator. We would like to inform you that we will continue to strengthen inspections and take decisive action in case of violations of the Food Sanitation Act in our City Sanitation Policy Division and Buk-gu Sanitation Division. However, in accordance with the dog slaughterhouse maintenance plan, we inform you that we plan to close one dog slaughterhouse by inducing the voluntary closure of establishment and we plan to support the closure of the remaining one establishment by removing the facilities and checking the equipment in early March. Architectural and Housing Division: It is very regrettable that the dog slaughterhouse and dog meat restaurants in Chilseong Market in Daegu are having a bad effect on the aesthetics and civic sentiment and this is presenting an ongoing issue. The dog slaughterhouses in Chilseong Market will be closing down through a joint inspection between the city of Daegu and the Daegu Buk-gu District (expected completion in early March of 2021), and we will work closely with the Buk-gu Office (Architectural & Housing Division) against illegal construction in the future to resolve such issues in the near future. 〇 칠성개시장의 근본적인 문제는 사실상 개고기 식용을 용인(축산법은 개를 가축으로 정의)하고 있는 상황과 개고기 도축 및 유통‧식용 여부를 규정해야할 축산물위생관리법이 육견협회 및 동물보호단체 등의 극명한 갈등 등으로 개고기를 금지할지 용인할지를 정하지 못한 상태(관련법이 명확하지 않음)에서 개고기 영업이 수십 년 동안 지속적으로 이루어진 점입니다.

〇 이러한 사정 등으로 동물보호법상 개를 식용으로 죽이는 행위에 대해서 일정한 요건 하에 형사 처벌(3년이하의 징역 또는 3천만원 이하의 벌금)이 될 수 있지만, 이미 관련 종사자들은 동물보호법 상 위반사항이 될 만한 학대행위를 피해서 도살을 하고 있을 뿐 아니라 개 도살 자체가 음지에서 행해지는 행위로 처벌을 하기 위한 증거 확보가 어려워 관할 경찰서에 수사의뢰 등을 하더라도 내사종결 처리되는 등 실제 적극적인 행정적 조치가 힘든 상황입니다.
그 외 개고기 판매 등 관련 영업에 대해서도 정서적, 통념적으로만 시대에 맞지 않는 영업 행위로 인식될 뿐, 관련업 종사자들의 영업행위 자체를 직접적으로 규제할 수 있는 관련 법 등 행정 규제 방안이 없어 관련 정비사업 추진에 상당한 어려움을 겪고 있습니다.

○ 더욱이, 칠성동 개고기 골목의 경우 부산 구포가축시장, 성남 모란가축시장과 다르게 전통시장이 아닌 구역, 즉 칠성시장으로 등록된 구역이외에 대부분의 업소가 광범위하게 산재되어 있어 상인회 등이 구성되어 있지 않으며, ‘시장 등록’ 또한 불가능한 상태로, 개고기 관련 기존 영업자의 폐업 유도를 위하여 폐업 보상금 등을 지급한다고 하더라도 근본적인 개고기 식용에 대한 법적 규제가 없는 상태에서 기존 영업자에 대한 폐업이 이루어져도 칠성동 개고기 골목 내 ‘신규 영업자의 유입’ 및 ‘기존 영업자의 타지역 등 동일업종 이전 영업‘을 막을 행정적 규제 방안이 없어 생계 및 폐업에 따른 금전적 보상으로 정비 사업을 추진하는 것에도 한계점이 있습니다.

○ 다만, 일부 개고기 관련 영업장이 포함되어 있는 칠성시장의 경우, 칠성원, 경명시장 및 주변 상점가 등 인접시장 상인들이 합의를 통해 정비사업조합을 설립하여 2019.10월에 시장정비사업시행인가를 받아 재건축을 계획하고 있어, 이들 사업과 함께 개도살장 우선 폐쇄가 추진되면 개고기 유통 및 수급 문제 등이 자연스럽게 근절될 것으로 판단되어지며, 관련 업종이 또한 사양업종으로 관련 시장 축소 및 자진 업종 전환 등이 이루어질 것으로 예상합니다.

○ 따라서, 칠성동 개고기 골목 정비사업 추진 시 성남모란개시장 정비에 수년이 걸린 점을 고려하여 관할 지자체인 북구청과 관련 부서들과의 협업*을 통해 칠성시장 정비사업과 함께 단계적 계획(개 도살장 우선 폐쇄(‘21.3월초 최종 완료) 및 관련 시장 축소에 따른 개식용 관련 영업행위 축소·근절 도모)을 마련하여 순차적으로 추진하고 있음을 알려드리며, 개고기 식용과 관련된 법 제·개정 마련이 조속히 이루어질 수 있도록 귀하를 비롯한 많은 시민들께서 동참 및 협조해 주시길 부탁드립니다.
