2. 귀하의 민원은 음식물쓰레기를 개 농장에 제공하는 행위, 개 농장 분뇨로 인한 환경 위해와 재래시장에서 개고기 판매, 개고기 이용한 보신탕 판매에 관한 것으로 판단됩니다.

1. 귀하께서 국민신문고를 통해 신고하신 민원 중 흥덕구 소재 개고기 유통관련시설에 대한 『폐기물관리법』, 『가축분뇨관리 및 이용에 관한 법률』(이하“가축분뇨법”), 『식품위생법』 위반 관련사항에 대해 아래와 같이 답변을 드립니다.
Among the complaints you have reported through the National Newspaper, we reply to the following regarding violation of “the Waste Control Act”, “the Livestock Manure Act”, and “the Food Sanitation Act”.
2. 폐기물관련법 : 관내 음식물을 사료로 하는 개 농장에 대해서는 폐기물처리(재활용) 신고를 완료하였으며, 운영상 위반사항은 없으나 향후 위법사항이 발견될 경우 관련법에 의거 적정 조치하겠습니다.
2. The Waste Control Act : The waste disposal (recycling) report has been completed for dog farms that feed food of jurisdiction, and there are no operational violations, but if any future violations are found, we will take appropriate measures in accordance with the relevant laws.
3. 가축분뇨법 : 가축분뇨법상 신고규모이상의 개농장에 대해서는 가축분뇨배출시설설치신고를 모두 완료 하고 정상운영 중에 있으며, 향후 불법 개 농장 발견 시 관련법에 의거 적정 조치하겠습니다.

Livestock Manure Act： According to the Livestock Manuare Act, We have completed all reports of the installation of livestock excrement facilities for dog farms larger than the reported size and they are operating normally. But we will take proper measures in accordance with the relevant laws if we find illegal dog farms in the future.
4. 식품위생법 : 재래시장에서 개의 지육을 판매하는 행위는 식품위생법에 저촉되는 사항이 아니며, 헌법재판소 판례 중 단지 개 도살과 개고기 유통에 관하여 식품위생법에 근거한 처분이 행하여질 수 있다는 막연한 가능성을 주장하여 행정부작위 위헌확인 청구한 심판을 부적법하다고 판단하여 각하한 판례(2019헌마0418)가 있음을 알려드립니다. 또한 개고기는 축산물 위생관리법의 적용대상에서 제외되어 식품위생법 제44조제1항1호 위반에 해당하지 않음을 안내드립니다.

and that the Constitutional Court rejected the judgment of the administration’s request for unconstitutional confirmation, claiming the vague possibility that only dog slaughter and dog meat distribution could be made based on the Food Sanitation Act.
We also inform you that dog meat excluded from the application of the Sanitary management of Livestock Products Act and does not fall under Article 44 paragraph 1. 1. of the Food Sanitation Act.

1. 귀하께서 국민신문고를 통해 신고하신 민원 중 음식물 폐기물 관련, 가축분뇨 관련에 대하여 아래와 같이 답변 드립니다.

2. 귀하의 질의사항에 대해 검토한 의견은 다음과 같습니다.
->The following comments have been reviewed for your query:
– 음식물 폐기물 관련 :
「청주시 음식물류 폐기물의 발생억제, 수집ㆍ운반 및 재활용에 관한 조례」 제2조 제4호 음식물류 폐기물 재활용이란 음식물류 폐기물을 가축의 먹이로 이용하거나 중간처리를 거쳐 사료, 퇴비, 연료 및 그 밖의 용도로 활용하는 것을 말한다. 와 같은 법 제4조 제2항 발생한 음식물류 폐기물은 가축의 먹이로 재이용되거나 처리를 거쳐 사료, 퇴비, 연료 등으로 재활용하여야 한다. 를 볼 때 「사료관리법」제14조제1항에 대한 위반사항은 발견하지 못하였습니다. 또한 음식물류 폐기물 재활용 신고를 득하지 않고 음식물류 폐기물을 급여하는 개사육시설은 발견하지 못함.
->The term “food waste recycling” referred to in Article 2-4 of the Cheongju-si Ordinance on the Control, Collection, Transportation and Recycling of Food Waste means the use of food waste as food for livestock or for feed, compost, fuel, and other purposes. Food waste generated under Article 4 (2) of the same Act shall be reused as food for livestock or recycled as feed, compost, fuel, etc. after treatment. In view of, no violation of Article 14 (1) of the Food Management Act was found. And no dog breeding facility has been found to pay food waste without obtaining a report on recycling of food waste.
– 가축분뇨 관련 :
본 민원과 관련한 「가축분뇨의 관리 및 이용에 관한 법률」 위반 여부에 대하여 16개소의 필지를 확인한 결과, 일부는 가축분뇨배출시설 폐쇄신고가 완료되어 있었으며, 폐쇄된 가축분뇨배출시설은 개를 사육하고 있지 않음을 확인하였습니다. 더불어 관내 운영 중인 개사육시설 소유주 및 관리자에게 가축분뇨의 관리 및 이용에 관한 법률 제17조에 따른 관리기준을 준수하여 운영할 것을 행정지도 하였습니다.
추후 위반사항 발견 시 관련법에 의거 적법하게 조치토록 하겠으며 앞으로도 가축분뇨배출시설 지도점검에 최선을 다하도록 하겠습니다.
-> Regarding livestock manure: After checking 16 parcels for violations of the Livestock Manure Control and Utilization Act regarding this complaint, some of them were reported to close livestock manure discharge facilities, and closed livestock manure discharge facilities were not raising dogs. In addition, the administrative guidance was given to owners and managers of dog breeding facilities in the jurisdiction to comply with the management standards under Article 17 of the Act on the Management and Use of Livestock Excreta.
If we find any violations in the future, we will take legal action in accordance with the relevant laws, and we will continue to do our best to check the guidance of livestock excrement discharge facilities.
