1. 안녕하십니까? 환경보전에 대한 귀하의 관심에 감사드립니다. 귀하의 민원이 다부처 민원으로 지정됨에 따라 환경부 검토결과를 다음과 같이 알려드립니다.
2. 귀하께서 문의하신 내용은 ‘음식물류폐기물 개 먹이 금지’에 관한 것으로 이해됩니다.
3. 귀하의 질의사항에 대해 검토한 의견은 다음과 같습니다.
가. 음식물류폐기물을 사료로 재활용할 경우에는 「폐기물관리법」 제25조 또는 제46조에 따라 해당 지자체에 인허가를 받거나 신고하여야 합니다.
나. 음식물류폐기물은 농림축산식품부 소관의 「사료관리법」 및 관련 고시에 근거하여 단미사료로 사용할 수 있는 물질로 포함되어 있으며, 이를 재활용하기 위해서는 「폐기물관리법」 제13조의2 및 시행규칙 [별표 5의3]에 따라 가축의 먹이로 사용하고자 하는 경우 「사료관리법 시행규칙」 제30조에 따른 검정방법에 따라 검정한 결과가 「사료관리법」 제11조제1항에 따른 사료공정 및 같은 법 제14조제3항에 따른 유해물질의 범위 및 허용기준을 충족하여야 합니다.
다. 폐기물처리업체 및 폐기물 처리신고 시설은 「환경오염물질배출시설 등에 관한 통합지도점검 규정」에 따라 해당 지자체장이 지도·점검하므로 음식물류폐기물 재활용 업체의 부적정 처리 사례 발견 시 관련 업체의 정보와 자료를 해당 지자체 등으로 신고 또는 제보하여 주시기 바랍니다.

1) Request for administrative action for an unlicensed dog farm as per the Act on the Management and Use of Livestock Excreta
– Please note that, as per Article 11 of the Act on the Management and Use of Livestock Excreta, we are enhancing control of any illegal facility without appropriate facility for discharging waste by imposing administrative action such as order for shutdown or suspension of access.
– Facilities with license or registration will be subject to control and investigation to ensure compliance with all the relevant laws and regulations. Those that illegally dump or neglect livestock excreta will be ordered to prevent pollution or punished (criminal charge) as per Article 10 of the Act on the Management and Use of Livestock Excreta to minimize adverse effects on the surroundings.

2. Petition Descriptions
Under the current Act on the Management and Use of Livestock Excreta, any dog farm larger than 60 square meters is subject to registration as a waste emission facility. Any illegal dog farms operating without proper registration must be subject to suspension of operations and order of closure in accordance with Article 17 of the Enforcement Regulations. The farm specified below is suspected to be an unregistered facility and has been contributing to pollution of the environment and thus requires urgent administrative measures!

1. Greetings! Please note that the inquiry you posted on e-People (1AA-2103-0458182) has been designated as a “Multi-department inquiry,” and hereunder is the reply of the Ministry of Environment:

1) Request for administrative action for an unlicensed dog farm as per the Act on the Management and Use of Livestock Excreta

– Please note that, as per Article 11 of the Act on the Management and Use of Livestock Excreta, we are enhancing control of any illegal facility without appropriate facility for discharging waste by imposing administrative action such as order for shutdown or suspension of access.
– Facilities with license or registration will be subject to control and investigation to ensure compliance with all the relevant laws and regulations. Those that illegally dump or neglect livestock excreta will be ordered to prevent pollution or punished (criminal charge) as per Article 10 of the Act on the Management and Use of Livestock Excreta to minimize adverse effects on the surroundings.

3) Request administrative action for using food waste as dog feed

– Facilities using food waste as dog feed are required to obtain a corresponding license or register with the local government as per Articles 25 (Business of Food Waste Treatment) and 46 (Reporting of Waste Treatment) of the Wastes Control Act while complying with the criteria for recycling/reusing waste as per Clause 2, Article 13 of said law (Principles and Instructions for Reusing Waste).
– In addition, facilities or businesses treating waste or those with license to treat waste are subject to control and investigation by the head of the local governments as per the 「Regulations on Integrated Guidance and Investigation for Facilities Discharging Pollutants」; thus, you can freely report any facility that illegally treats food waste without due license to the corresponding local government with specific information and details on the facility/business.

5) Request administrative action for polluting sewage

– As per Clause 1, Article 34 of the Sewage Act, those intending to install a facility or construct a building discharging wastewater are required to install a personal wastewater treatment facility, which is subject to inspection for installation report completion and maintenance. Likewise, please note that those discharging wastewater exceeding the quality criteria for water discharged into public waters will be slapped with administrative actions including penalty.

6) Request for investigation for illegally dumped waste around dog farms

– The responsibility of addressing daily life waste falls on the corresponding local government as per Article 14 of the 「Wastes Control Act」, which also authorizes the local government to check for any illegally dumped waste.
– Thus, you can contact the local government of the area where the dog farm is located if you suspect that the farm is illegally dumping its daily life waste.

2. As far as we understand, you inquired about a ban on the use of food wastes as dog food.
3. Below are the results of our review of your petition.
1) Under Article 25 or 46 of the Wastes Control Act, a person who intends to use food wastes as livestock and fish feed shall get permission or approval from or report such use to the relevant local government.
2) Pursuant to the Control of Livestock and Fish Feed Act and relevant notifications, which fall within the remit of the Ministry of Agriculture, Food and Rural Affairs, food wastes are deemed to be substances that can be used as single-compound feed. When trying to use food wastes as livestock and fish feed under Article 13 (2) of the Wastes Control Act and attached Table 5-3 of the Enforcement Rule of the Act, such food wastes shall be tested according to the testing methods specified in Article 30 of the Enforcement Rule of the Control of Livestock and Fish Feed Act. The testing results shall meet the manufacturing process of Article 11 (1) and the permissible limits under Article 14 (3) of the Control of Livestock and Fish Feed Act.
3) Waste treatment companies and waste treatment facilities are guided and examined by the head of the local government under the Regulation on Comprehensive Guidance and Examination of Environmental Pollutant Discharge Facilities. If you spot a food wastes recycling company treating food wastes in an inappropriate way, please report the case to the relevant local government, etc. with such
company’s information and relevant materials.
