result 1. 안녕하십니까? 우리 농림축산식품부 업무에 관심을 가져주셔서 감사합니다. 귀하께서 국민신문고를 통해 농림축산식품부 등으로 신청하신 민원(신청번호 1AA-2203-0541868호 등)이 다부처 민원으로 지정됨에 따라 농림축산식품부 소관사항에 대해 답변드리겠습니다.

2. 먼저, 사상 초유의 산불로 많은 주민 분들이 큰 피해를 입고 동물들에게까지 피해가 발생하여 매우 안타깝게 생각합니다.

3. 귀하께서 제출하신 민원의 요지는 ‘동물보호법 관련 질의’로 이해됩니다.

○ 우리 부는 동물의 생명보호, 안전보장 및 복지 증진을 꾀하고 동물의 생명존중 등 국민 정서를 기르기 위하여 「동물보호법」 (이하 “법”)을 운용하고 있고, 법 제8조는 동물을 잔인한 방법으로 죽이거나 정당한 사유 없이 상해를 입히는 등의 학대행위를 금지하고 위반 시 처벌을 부과하고 있습니다.

○ 예컨대 법 제8조(동물학대 등의 금지) 제1항 각 호에서는 동물을 잔인한 방법으로 죽음에 이르게 하는 등의 행위를 금지하고 있으며, 이를 위반한 경우에 법 제46조제1항에 따라 3년 이하의 징역 또는 3천만원 이하의 벌금에 처해질 수 있습니다.

○ 아울러 법 제7조(적정한 사육·관리)에서는 소유자등이 동물에게 적합한 사료와 물을 공급하고, 운동·휴식 및 수면을 보장하며, 동물이 질병에 걸리거나 부상당한 경우에는 신속하게 치료하는 등의 조치를 하도록 권고하고 있기도 합니다.

○ 다만, 민원인께서 말씀하신 처벌, 즉 각 행위들이 해당 동물을 잔인한 방법 등으로 죽음에 이르게 한 행위인지 여부는 당시의 현장 상황, 인과관계, 행위의 양태 등을 종합적으로 감안하여 경찰 수사 및 사법기관 판단을 거쳐야 할 것으로 보입니다.

4. 또한, 우리 부는 ‘재난 시 반려동물 동반 대피 가이드라인’을 각 지자체에 송부하여, 동물보호·복지를 소홀히 하지 않으며 재난에 철저히 대응하도록 조치한 바 있습니다.

5. 끝으로 우리 부는 동물학대행위의 구체화 및 처벌 강화, 동물학대 재발 방지조치 보완 등 다양한 제도 개선방안을 담아 「동물보호법」전부 개정을 추진 중이며, 해당 개정안이 현재 국회 법사위에 계류되어 논의 중에 있음을 알려드립니다. 개정안의 조속한 통과를 위해 노력하겠습니다.

Results 1. Hello, thank you for your interest in the Ministry of Agriculture, Food and Rural Affairs. As the complaint (application no: 1AA-2203-0541868) that you filed to the Ministry of Agriculture, Food and Rural Affairs through the Anti-Corruption and Civil Rights Commission (e-People service) are designated as multi-ministerial complaints, we will respond to matters under the jurisdiction of the Ministry of Agriculture, Food and Rural Affairs.

2. First of all, we are sorry to hear that many residents are suffering from the damage to their homes, and the animals are harmed due to the unprecedented wildfire.

3. We understand the filed complaint as an ‘inquiry related to the Animal Protection Act.’

○ Our division is operating the Animal Protection Act to protect the lives of animals, guarantee safety, promote welfare, and develop respect for the lives of animals in people. Article 8 of the Animal Protection Act prohibits cruelty to animals, such as cruelly killing animals, injuring them without justifiable reasons, etc. Penalties are imposed for violations of the Act.

○ In each clause of Article 8-1 (Prohibition of Animal Abuse) of the Animal Protection Act, acts such as cruelly killing animals are prohibited. Violation of the Act shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 30 million won pursuant to Article 46-1 of the Animal Protection Act.

○ In addition, according to Article 7 (Appropriate Raising and Management) of the Animal Protection Act, the owner or keeper of an animal shall provide the animal with appropriate feed and water and endeavor to ensure that the animal exercises, rests, and sleeps adequately. If an animal suffers from a disease or an injury, the owner or keeper shall endeavor to cure it promptly or take other necessary measures.

○ However, whether each of the acts mentioned in the complaint is an act that caused the animal to death in a cruel way, etc., must be decided through police investigation and judicial authorities in comprehensive consideration of the situation at the time, causal relationship, and aspect of behavior, etc.

4. In relation to the wildfire in Gangwon-do, we have sent the ‘Guidelines for evacuation with companion animals in case of disaster’ to each local government, taking measures to thoroughly respond to disasters without neglecting the protection and welfare of animals.

5. We are promoting a revision of the Animal Protection Act with various system improvement plans, such as making animal cruelty more concrete, reinforcing punishments, and supplementing measures to prevent the recurrence of animal cruelty. The relevant amendment is currently pending discussion in the Legislation and Judiciary Committee. We will do our best to enact the amendment as soon as possible.
