We received the below response from Gyeonggi-do Gwangju regarding our campaigns/petitions addressed to the city and each of the townships within the city of Gwangju: Gyeonggi-do Gwangju, South Korea, Shut down the illegal dog meat farms, slaughterhouses and markets. Our campaign is effective because now they are aware that the eyes of the world are watching what’s going on in their city’s dog meat industry and bring this issue the attention and action from their government. Let’s keep up the pressure by taking action!

Below is our comments on the satisfaction survey regarding their response:

We are not satisfied with the response to our petition, due to the following key reasons:

it fails to substantiate and evidence what direct actions the city of Gwangju is taking to enforce existing laws to disrupt the entrenched dog meat trade in South Korea. We have not been provided, in this response, with any evidence of any direct actions taken by the city of Gwangju, such as recorded information relating to inspections, monitoring and actual enforcement action taken against violators, in relation to dog meat farming, slaughterhouses and businesses selling dog meat and dog meat products (such as dog elixir and dog soju);

it fails to show what actions the city of Gwangju is taking with regard to proposing amendments to existing legislation or bringing in new legislation to address and end the dog and cat meat trade, and

it fails to formally acknowledge the existence of the illicit dog and cat meat trade within South Korea and the problems this poses to human health, animal welfare and organized crime, which has been widely documented by both domestic and international NGO’s and animal charities (and has also been raised as an international area of concern by many western governments with South Korea and its diplomatic missions).

[농업정책과]
– 개는 축산물위생관리법 제2조에 의거 축산물의 범위에 해당하지 않아 축산물 위생 관리법으로 행정 조치할 수 있는 사항이 아님을 알려드립니다.
– 아울러, 동물보호법 제10조(동물의 도살방법) 제2항에 의거 축산물위생관리법 또는 가축전염병에 따라 동물을 죽이는 경우 가스법, 전살법 등 가능하여 전기도살은 동물보호법 제8조(동물학대 등의 금지)에 해당하지 않음을 알려드립니다.
– 다만, 동물(개) 사육처에 대하여 「동물보호법」 규정에 의거 동물학대행위 여부 등을 수시 지도 점검하도록 하겠습니다.

[식품위생과]
– 「축산물 위생관리법」에서는 소, 말, 양, 돼지, 닭, 오리 등의 가축을 도살, 처리하고 이를 가공, 보관, 유통, 판매하는 것과 관련된 위생적인 조치 등에 대해 규정하고 있습니다.
– 또한, 「식품위생법 시행규칙」제44조 관련 ［별표 17］식품접객업영업자 등의 준수사항 7.에 따라 “「축산물 위생관리법」제12조에 따라 검사를 받지 아니한 축산물 또는 실험 등의 용도로 사용한 동물은 음식물의 조리에 사용하여서는 아니 된다.”고 규정하고 있습니다.
– 개고기 음식문화는 오랫동안 내려져 온 우리나라의 식문화 식습관인 만큼, 식용금지에 대한 사항은 개의 사육 및 도축에 관한 법령의 정비 등 사회적인 합의가 선행되어야 할 것으로 판단됩니다.
– 다만, 개고기 조리 섭취 시 위생적인 부분에 대하여는 「식품위생법」 규정에 의거 위생적으로 취급 할 수 있도록 지도 및 관리하겠습니다.

[수질정책과]
– 귀하께서 제기하신 경기도 광주시 관내의 “불법 개 사육시설 단속 요청”에 대하여 관내 소재 가축(개)분뇨배출시설에 「가축분뇨의 관리 및 이용에 관한 법률」 제11조 제3항에 의거 개 사육시설인 경우 사육시설 면적 60㎡ 이상 시 지방자치단체에 신고하여야 하며,
– 아울러, 동법 제10조 제1항 및 제2항에 의거 가축분뇨 등으로 인한 생활환경·공공수역의 오염 또는 오염의 우려가 있을 경우 가축분뇨 등의 보관방법 변경·수거 등의 조치를 적극 행정조치 하고 있음을 알려드립니다.
