Yeonggwang stated that the Yeonggwang Police is investigating the case for the animal abuse but did not indicate whether or not the animal abuser would be prosecuted. The reality is that there are many dog farms and slaughterhouses operating in Yeonggwang, and horrible cruelty and slaughter of dogs occur every day. The only way to prevent this type of horrific abuse is to end dog meat consumption and if their government enforces the law to stop the dog meat industry.

3. 귀하의 민원에 대해 검토한 의견은 다음과 같습니다.

○ 우리 부는 동물의 생명보호, 안전보장 및 복지 증진을 꾀하고, 동물의 생명존중 등 국민의 정서를 함양하기 위해 「동물보호법」(이하 “법”)을 운용하고 있습니다.

○ 법 제8조는 개를 포함한 동물을 비윤리적으로 죽이거나 정당한 사유 없이 상해를 입히는 등의 학대행위를 금지하고 있고, 법 제46조는 동물을 학대하여 죽음에 이르게 한 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처하고, 동물을 상해하는 등의 학대행위를 한 자는 2년이하의 징역 또는 2천만원 이하의 벌금에 처하도록 하고 있습니다. 또한, 상습적으로 해당 죄를 지은 자에 대해서는 가중처벌에 처해질 수 있음을 알려드립니다.

○ 아울러, 소유자등이 반려동물에게 최소한의 사육공간 및 먹이 제공, 적정한 길이의 목줄, 위생·건강 관리를 위한 사항 등 농림축산식품부령으로 정하는 사육·관리 또는 보호의무를 위반하여 상해를 입히거나 질병을 유발하는 행위로 인하여 반려동물을 죽음에 이르게 하는 행위를 금지하고, 위반 시 3년 이하의 징역 또는 3천만원 이하의 벌금에 처하게 하는 개정법률이 2022년 4월 26일 공포되어, 공포 후 일년 뒤인 시행일 전까지 하위법령 등 후속 절차를 진행하고 있음을 알려드립니다.

○ 우리 부는 동물학대 방지 및 동물보호 등을 위하여 지자체·관련 단체 등과 함께 교육·홍보·지도를 지속적으로 추진하도록 하겠습니다.

1. How are you? Thank you for your interest in the work of the Ministry of Agriculture, Food and Rural Affairs. We will respond to complaints (8 cases, including application number 1AA-2204-0657006) submitted to Woori Department through the e-People petition.

2. The gist of your complaint is understood as a ‘request for the prohibition of cruelty to animals’.

3. The comments we have reviewed on your complaint are as follows.

○ The Department is operating the 「Animal Protection Act」 (hereinafter referred to as the “Law”) to protect the lives of animals, ensure safety and promote welfare, and cultivate people’s emotions, such as respect for the lives of animals.

○ Article 8 of the Act prohibits abusive behavior such as unethically killing or injuring animals, including dogs, without justifiable reasons. A fine of not more than 10 million won is punishable by imprisonment for not more than two years or a fine not exceeding 20 million won. In addition, we inform you that habitual offenders may be subject to aggravated punishment.

○ In addition, we prohibit the owner from violating the duties of breeding, management, or protection prescribed by the Ordinance of the Ministry of Agriculture, Food and Rural Affairs, such as providing a minimum breeding space and food to companion animals, a leash of an appropriate length, and matters for hygiene and health management, resulting in injury or disease. On April 26, 2022, the revised law was promulgated on April 26, 2022, prohibiting acts that cause the death of companion animals and punishing them with up to 3 years of imprisonment or a fine of up to 30 million won for violations. We inform you that follow-up procedures such as sub-laws are in progress before the effective date.

○ The Ministry will continue to promote education, publicity, and guidance in cooperation with local governments and related organizations to prevent cruelty to animals and protect animals.
