2. Our department is operating the “Animal Protection Act”, which is aimed at protecting the life of animals, promoting safety and welfare of animals, and raising the public’s awareness of the importance of the life of animals.

3. The article 8 of the 「Animal Protection Act」 prohibits animal abuse such as killing animals including dogs unethically or injuring them without justifiable reasons. A person who result in the deaths of animals according to the article 46 can be imprisoned for up to three years or be fined up to 30 million won. Also, the article 46 says that a person who abuse animals such as injuring them can be imprisoned for up to two years or be fined up to 20 million won. In addition, a person who repeat these criminal activities can get a cumulative punishment.

대한민국은 불법 개농장, 도축장, 시장, 보신탕집을 폐쇄하라!!!

대한민국 정부에게 청원합니다!

우선 “대한의 육견인들 (https://youtu.be/cCdTceduKcY)”이라는 다큐멘터리를 참고로 봐주시기 바랍니다.

대한민국정부가 개고기를 다루는 불법 개농장, 도살장, 시장, 보신탕집, 건강원을 단속하는 즉각적 조치를 취하기를 촉구합니다. 또한 한국정부, 경찰청, 사법기관이 아래와 같은 기존 한국법 시행을 요구하는 공식문서를 발급할 것을 요청합니다.

– 개의 사육단계에서 식용견 사료용으로 음식쓰레기를 무단처리하는 것은 폐기물 관리법 제 15조의 2, 제 25조 3항 위반입니다. 음식물쓰레기 배출자와 운반자들은 이 의무규정을 위반하고 개농장주에게 음식쓰레기를 제공하고 있습니다.

– 허가 없이 음식쓰레기를 수집/운반하여 개에게 급여하는것은 사료관리법 제 14조 1항 및 2항의 위반입니다.

– 불법으로 난립된 개농장에서 배출되는 분뇨로 인한 환경위해는가축분뇨법 제 11조의 위반입니다. 개농장의 배설물은 인근 지역 환경 피해를 유발합니다.

– 식용하기 위한 개도살은 동물보호법 제 8조 1항 4호의 위반입니다. 개도살은 수의학적 처치의 필요나 동물로 인한 사람의 생명, 신체, 재산의 피해를 입은 경우 같은 정당한 사유 없이 동물을 죽이는 행위로 명백한 법 위반 행위입니다.

– 전기감전으로 개를 도살하는 행위는 동물보호법 제 8조 1항 1호의 위반입니다. 도구, 약물 또는 열, 전기, 물을 이용한 상해 행위마저 법적 처벌의 대상인 만큼 당연히 상기 방법에 의한 도살 행위는 위법이며 특히 전기도살은 그 잔인함으로 인해 국제적으로 금지되고 있습니다.

– 무허가 도살장에서 개를 도살하는 행위는 축산물 위생관리법 제 7조 1항 위반입니다. 개는 축산물 위생관리법에서 규정한 ‘도살, 식육으로의 유통이 불가능’한 동물로서 허가받은 도살장이 존재할수가 없습니다. 따라서 개 도살장을 운영하는 공급업체는 법의 매개 변수를 벗어나 법을 위반하고 있는 것입니다.

– 자가소비를 목적으로 개를 도살하는 행위는 동물보호법 제 10조와 축산물 위생관리법 제 7조 1항 2호의 위반입니다. 모든 동물은 잔인한 방법으로 도살되어서는 안되는데, 개도살의 경우 인도적인 방법은 약물주사 외에는 없으므로 현재 한국에서 자행되는 모든 식용 목적 개도살은 잔인한 도살에 해당합니다. 축산물 위생관리법의 ‘자가소비를 위한 도살 허용’은 고시로 정한 축산물 위생관리법상 가축에 한하며 개는 해당사항이 없습니다.

– 재래시장에서 개의 지육을 전시/판매하는 행위는 식품위생법 제4, 5조의 위반입니다. 불결한 불법도축과 지육 전시과정에서의 오염으로 ‘위해식품 등의 판매금지’ 조항에 위배됩니다. 개의 지육이 병을 일으키는 미생물에 오염된 경우 인체의 건강을 해칠 우려가 있습니다. 또 유기견이나 개농장의 병든 개체가 도살돼 판매될 가능성을 배제하지 못하므로 ‘병든 동물의 고기 등의 판매금지’ 조항에 위배됩니다.

– 보신탕집에서 출처 불명의 개고기를 이용한 보신탕을 판매하는 행위는 식품위생법 제44, 1항 1호의 위반입니다. 검사를 받지 않은 축산물은 운반, 보관, 진열, 판매하거나 식품의 제조, 가공에 사용해서는 안됩니다.

사회적 합의는 끝났다, 정부는 개식용을 금지하라!

동물의 참혹한 희생이 집중되는 복날, 정부는 언제까지 개식용 문제를 방치할 것인가. 국내 코로나19 사태가 장기화되며 종식될 기미가 보이지 않고 있다. 코로나바이러스 확산의 원인으로 중국 우한시 야생동물 고기 밀거래 시장이 지목되며, 중국은 지난 5월 29일 목축법 상 가축·가금의 목록에서 개를 제외하는 개식용 금지 계획안을 발표했다. 개 지육의 메카 중국의 개식용 금지에 대한 방향성 제시는 전 세계 개식용 종식 역사의 쾌거이며, 비위생적 환경에서 자행되는 동물의 불법 도살이 가진 위험성을 인지한 중국 정부의 적극 결단이 아닐 수 없다.

개식용 금지에 대한 국제적 변화의 흐름 속 우리는 오늘 여전히 개 지육 대량 소비국으로 위세를 떨치고 있는 대한민국 국민임이 부끄러운 마음으로 이 자리에 섰다. 1950년 홍콩을 시작으로 대만, 필리핀, 태국 등 아시아 각국에서 개식용 제한 및 금지 조치가 단행되고 있다. 2020년 중국 선전시의 개·고양이 식용 금지령에 이어 지난 4일 인도 나갈란드 주의 개고기 판매 및 식용 목적의 개 수입·거래 금지 소식이 전해지는 사이, 해묵은 개식용 논쟁 해결에 영 속도를 내지 못하는 정부는 대체 문제를 타개할 의지가 있는 것인지 과히 의심스럽다.

식용을 목적으로 사육되는, 소위 ‘식용견’이라 불리는 개들은 삶의 시작부터 끝까지 끔찍한 동물 학대를 경험한다. 밀집 사육에 오랜 뜬 장 생활로 발이 붓고 피고름이 차며, 상처와 질병으로 인한 폐사를 막기 위해 항생제를 과다 투여받는다. 두 눈 뜨고 볼 수 없는 비인도적이고 잔혹한 방법으로 이루어지는 개 도살은 두말할 필요도 없는 동물 학대다. 개의 목을 매달아 죽이거나 물을 뿌려 전기 쇠꼬챙이로 기절시키는데, 때로는 개의 의식이 있는 상태에서 감전으로 죽음에 이르기도 하며 이는 온몸 근육이 다 찢어지는 수준의 극심한 고통을 야기시킨다. 이는 동물보호법 제8조를 위반하는 동물 학대 행위임이 명백하다. 개식용의 금지야말로 식용을 목적으로 희생되는 개들의 짧은 삶의 전 과정에서 마주하는 모든 끔찍한 학대를 멈추는 유일한 길이다.

오랜 악습이자 동물 학대의 결정판인 개식용을 종식하라는 국민적 요구는 더욱 치열해지고 있다. 반려동물 양육 인구 천만 시대를 넘어 국민 20% 이상이 반려동물과 가족으로 살아가는 지금 국민의 생명존중 의식도 보다 성숙해지고 있다. 매년 복날이면 수많은 이들이 타오르는 뙤약볕 속 거리로 나와 개식용 종식을 부르짖는다. 어디 이뿐이랴.

지난 2018년 이미 40만 이상의 국민이 개식용 금지를 요구했고 개식용 종식을 위한 트로이카 법안이 20대 국회에 올랐다. 2016년 성남 모란시장에서는 개도살이 금지되고, 2019년 7월에는 수십 년 개 도살로 인한 피의 역사를 가진 부산 구포 개시장이 거센 개식용 종식의 물결 속에 사라졌다. 청와대마저 “이제는 반려동물로 자리매김한 개를 축산법에서 제외할 때가 되었다”며 개를 가축에서 제외하는 축산법의 정비를 약속했다. 또한 사법부 최고기관 대법원도 지난 4월 개 전기도살이 사회 보편적 가치에 반하는 잔혹한 방법이자 동물 학대라는 사실을 만천하에 공표했다.

그럼에도 불구하고 작금의 상황은 통탄스럽기만 하다. 개를 가축에서 제외하겠다는 청와대의 약속은 말뿐인 약속으로 남았고, 개식용 종식의 국민적 열망이 담긴 트로이카 법안은 국회 휴짓조각으로 사라졌다.

정부와 국회는 개를 가축의 범위에서 제외해야 한다는 방향성에 동의하면서도 늘 ‘사회적 합의가 필요하다’는 변명으로 개식용 종식의 흐름에 찬물을 끼얹어왔다. 그러나 40만 이상 국민이 개식용 종식을 염원하여 청원하고 매년 수백 명의 사람이 거리로 뛰쳐나와 개식용 종식을 외치며, 전국 대표 개시장과 개 도살장이 철거되고 한국의 개식용 산업이 이미 몰락의 길을 걷고 있는 지금 개식용 금지를 위한 사회적 합의는 이미 끝난 지 오래다. 정부와 국회는 더 이상 비겁하게 ‘사회적 합의’라는 방패 뒤에 숨어 민의를 저버려서는 안된다.

○ 3번 및 5번 질의에 대하여, 동물보호법 제8조1항은 동물에 대하여 목을 매다는 등의 잔인한 방법으로 죽음에 이르게 하는 행위, 노상 등 공개된 장소에서 죽이거나 같은 종류의 다른 동물이 보는 앞에서 죽음에 이르게 하는 행위, 고의로 사료 또는 물을 주지 아니하는 행위로 인하여 동물을 죽음에 이르게 하는 행위, 그 밖에 수의학적 처치의 필요, 동물로 인한 사람의 생명·신체·재산의 피해 등 농림축산식품부령으로 정하는 정당한 사유 없이 죽음에 이르게 하는 행위를 금지하고 있고, 법 제8조제1항을 위반하여 동물을 죽음에 이르게 하는 학대행위를 한 자는 법 제46조제1항제1호에 따라 3년 이하의 징역 또는 3천만원 이하의 벌금에 처하고, 법 제8조제2항은 도구ㆍ

Results 1. Thank you for your interest in Ministry of Agriculture, Food & Rural Affairs (MAFRA). We hereby provide you the answer to your inquiry (Application No. 1AA-2107-0572901) requested to Anti-corruption & Civil Rights Commission and transferred to Ministry of Agriculture, Food & Rural Affairs (MAFRA).

2. We understand that your inquiry is regarding the ‘Questions on the Animal Welfare Policy & Work’.

3. Please find below the result of handling your inquiry.

○ Regarding your Question No. 1 and 4, MAFRA is operating the 「Animal Protection Act」 (hereafter referred to as the “Act”) for cultivating the national sentiment on protecting the lives, guaranteeing the safety and enhancing the welfare of animals, and on respect for animal lives, etc. In addition, 5-year general plan on animal welfare was established last year, and main promotion tasks include ① animal protection and improvement of awareness on animal welfare, ② reinforcement of companion animal sales management, ③ improvement on the level of protection on the abandoned and abused animals, ④ improvement of welfare on farm animals, ④ enhancement of ethicality on animal testing, and ⑤ establishment of animal protection & welfare governance. We also inform you that our ministry is promoting the establishment of the revised plan on the Animal Protection Act centrally of the details included in this plan.

○ Regarding the Question No. 2, our ministry of promoting the 「Animal Protection & Welfare Training and PR Project」 for cultivating mature animal protection & welfare culture, and to improve the awareness on animal protection by performing PR to the people on animal protection and welfare policies based on Article 4(1)4 in the Animal Protection Act. Details of the project include training on animal protection for each subject such as legal training per training participant, PR on the policy for the people such as producing public service advertisement on animal protection & welfare for transmission to each media, operation of the counseling center for animal protection & welfare, and events on animal protection through cooperation with relevant agencies, etc.

○ Regarding the Question No. 3 and 5, Article 8(1) in the Animal Protection Act prohibits any actions such as killing the animals through cruel methods such as hanging, etc., killing the animals in public place such as on the street or in front of other animals, killing the animals by not giving feed or water intentionally, or killing the animals by not providing any required veterinary treatment or without any justifiable reasons set by the ordinance of MAFRA including the damage to the lives, physical or property damage on people due to the animals. Those violating Article 8(1) in the Act to result in death of the animal or violating Article 46(1)1 in the Act to result in cruelty to animals shall receive prison sentence of 3 years or less, or fine of KRW 30 million or less. Article 8(2) in the Act prohibits any actions such as harming the animals through physical or chemical methods such as tools or drugs, etc. (however, those set by the ordinance of MAFRA such as prevention or treatment of diseases are excluded), damaging the body of the live animal, collecting the body fluid or installing the device for collecting the body fluid (however, those set by the ordinance of MAFRA such as treatment of diseases and animal testing, etc. are excluded), harming the animals for purpose of gambling, advertisement, entertainment and amusement, etc. (however, those set by the ordinance of MAFRA such as folk games, etc. are excluded), causing injury or disease by violating the obligation of breeding and management set by the ordinance of MAFRA such as providing minimum breeding space for the companion animal, etc. injuring the animals by not providing any required veterinary treatment or without any justifiable reasons set by the ordinance of MAFRA including the damage to the lives, physical or property damage on people due to the animals. In this case, those violating the law shall result in prison sentence of 2 years or less or fine of KRW 20 million or less according to Article 46(2) 1 in the Act, and Article 46(5) specifies that those committing the crime habitually relevant to Paragraph 1 to 3 shall result in additional punishment up to 1/2 of the sentence on the relevant crime. However, relevance on cruelty to animals and punishment are judged by the judicial authority through comprehensive consideration of the circumstances and aspect of the actions, etc.
