1. 귀하의 질의 중 우리 부서에서는 축산물위생관리법과 동물보호법 소관사항에 대해
다음과 같이 답변드립니다.
a. 개는 축산물위생관리법 제2조(정의)에 의거한 가축 및 식육의 범주에 포함되지 않아 축산물 관리법이 적용되지 않습니다.
b. 하지만 동물을 학대하는 행위는 동물보호법 8조(동물학대 등의 금지) 위반사항으로 동물보호법 제46조(벌칙) 1항에 의거 3년 이하의 징역 혹은 3000만원 이하의 벌금형에 처해질 수 있습니다.
c. 동물보호법 위반 행위를 목격하시면 이는 수사가 필요한 사항이므로 관할 경찰서에 신고하시기 바랍니다.
d. 기타 동물보호 및 축산물위생 관련 문의사항이 있으시면 중구청 일자리경제과(053-661-2644)로 연락주시면 성실히 답변 드리도록 하겠습니다.

1. 귀하의 질의 중 우리 부서에서는 식품위생법 소관사항에 대해 다음과 같이 답변하여 드립니다.
a. 식품위생법 제44조 1항 1호에서는 ‘축산물 위생관리법 제12조에 따른 검사를 받지 아니한 축산물 또는 실험 등의 용도로 사용한 동물은 운반, 보관, 진열, 판매하거나 식품의 제조, 가공에 사용하지 말 것’으로 규정되어 있으나, 이 규정의 근거가 되는 법률인 축산물 위생관리법 상 개는 가축의 범위에 해당되지 않으므로, 상기 규정을 위반한 것으로 보기에는 어려움이 있습니다.
b. 상기 내용과 같이 개고기는 가축에 해당되지 않으며, 법령 상 사각지대에 놓여있어 위생적 관리 등에 미흡한 점은 존재하나, 관련 법령 미흡 및 관습적인 문화 등으로 인해 개고기를 판매하는 행위 자체에 대해서는 법적 제제에 한계가 있습니다.
c. 다만, 우리 부서에서는 관련 음식점들에 대해 통상적으로 음식점이 준수하여야할 위생적 취급 사항 등 대해 지도, 점검을 진행하여 문제점이 최소화되도록 지도, 점검을 실시하고 있으니, 양해하여 주시기 바랍니다.

1. Regarding your inquiry, hereunder is the reply of our department concerning matters related to the Livestock Products Sanitary Control Act and the Animal Protection Act.
a. Dogs are covered by the Livestock Products Control Act because they are not included in the category of livestock and edible meat pursuant to Article 2 (Definitions) of the Livestock Products Sanitary Control Act.
b. Note, however, that the act of abusing animals is in violation of Article 8 of the Animal Protection Act (prohibition of animal abuse, etc.) and may be subject to imprisonment for up to three years under Paragraph 1, Article 46 (Penalty Provisions) of the Animal Protection Act or fine of up to 30 million won.
c. If you witness a violation of the Animal Protection Act, please report to the relevant police station so that an investigation can be conducted.
d. Should you have any questions about other animal protection and livestock products sanitation, please contact the Employment Economy Promotion Division of Jung-gu Office (053-661-2644),
and we will reply to you as best we can.

Sanitation Division :
1. Our department will respond to matters regarding the Food Sanitation Act as stated in your inquiry as follows:
a. According to Clause 1, Section 1, Article 44 of the Food Sanitation Act, animals used for livestock products or experiments not subject to inspection under Article 12 of the Livestock Products Sanitary Control Act shall be neither transported, stored, displayed, nor sold nor produced as food. Since dogs are not within the scope of livestock under the Livestock Products Sanitary Control Act, which is the legal ground for this regulation, the production and sale of dog meat can hardly be considered a violation of the foregoing regulations.
b. As stated above, dog meat is not considered livestock, and there are deficiencies in sanitary management since it is a blind spot of the law. Moreover, there are limitations to the legal restrictions on the sale of dog meat due to the lack of relevant laws and the customary culture.
c. Nonetheless, please note, that our department is conducting guidance and inspections for related restaurants on the sanitary handling items that they should normally follow to minimize problems.
