Although this is a bill related to ending the consumption of dog meat, the issue of stabilizing the prices of our agricultural products is actually very important. Due to the instability of agricultural product prices, there are actually various concerns about the sustainability of agriculture and rural areas. Moreover, rice prices have been falling recently, so a bill to stabilize agricultural product prices is very necessary. Also, related legislation is a very important issue for a sustainable Korean beef industry. In addition, the bill related to the Chamber of Agriculture and Fisheries is also a very important issue in that it creates a kind of representative organization that can represent the agricultural community. Right now, the livelihood of our farmers and rural communities is almost at the brink. As you well know, the price of agricultural products and rice has already fallen from the 200,000 won level promised by the government, and now the price of cabbage and kimchi is dropping steadily and is almost being scrapped. To resolve this, we submitted a revision to the Grain Management Act and an amendment to the Agricultural Product Price Stabilization Act, and although most of them accepted the ruling party and the government’s plan and eased our position as much as possible, it is very regrettable that the government and the ruling party are delaying it like this and acting passively. As for the Chamber of Agriculture and Fisheries Act, most of the proposals submitted by the government are accepted, and a revised bill is being proposed again, so I think the government should responsibly present its position on this issue as well.

I believe that the government’s unilateral refusal to participate in the bill review subcommittee if there is some difference of opinion on the bill between the ruling and opposition parties or if the ruling party does not want it is an infringement on the National Assembly’s practice and legislative authority. So I cannot help but think that the government, including Minister Jeong Hwang-geun, who will participate here today, is irresponsible. ◯Expert member Gong Chun-taek: I am an expert member. First, it will be the first volume of so-called review materials. There are a total of 8 bills related to ending dog eating, including 5 enactments and 3 amendments. So, because there is some content, we prepared condolence materials separately from the so-called review materials as reference materials. I think you could use it as a reference. I would like to tell you that the revised opinions in the condolence material were prepared based on the government’s opinions. This is page 1 of the so-called screening material. This is the background and purpose of the proposed amendment. I will omit this part because it is something the committee members are familiar with. This is page 3. We have summarized how the current laws related to dog meat consumption are structured and in place. This is page 4. This is a summary of overseas legislative cases related to dog meat consumption. Taiwanese cases worth particular reference are presented in the table below. This is page 5. We have summarized how the government established and operated a committee to discuss dog eating issues as a social discussion body to end dog meat consumption. For reference, if you look at the survey details, there are 1,156 farms involved in breeding dogs for meat, and the number of dogs involved is 520,000. This is page 6. I will briefly explain the structure and main contents of the five enactments and three amendments.
As shown in the table below, the five enactments explicitly prohibit the slaughter and processing of dogs and use or sell them for food, punishing violations or prohibiting the ownership of dogs, and based on fact-finding surveys, establish a policy to end the use of dogs as food. By preparing a basic plan containing matters related to the closure and closure of dog farms, the necessary support will be provided to owners of closed dog farms for closure or change of business, while prohibiting and punishing the breeding, slaughter, and sale of dogs for food purposes. The main content is to postpone the implementation of the provisions for 3 or 5 years. Meanwhile, the three amendments to the Animal Protection Act have the same purpose as the enactment, prohibiting the sale of dogs for food purposes, prohibiting or restricting the breeding of dogs in case of violation, and providing necessary support when dog breeding farms close. Like similar legislation, the enactment provides for expulsion, purpose, definition, responsibilities of the state, and relationships with other laws. The second definition clause only defines edible dog farms and farm owners. However, the enactment not only prohibits the breeding and propagation of dogs for the purpose of eating, but also distribution and sale, so it does not apply to slaughterers, distributors, food service providers such as restaurants, etc. It seems like that part needs to be added as well. This part is reflected on page 3 of the revised opinion in the reference material just mentioned. In addition, the responsibilities of the state and local governments include not only measures to end dog meat consumption, but also administrative and administrative measures necessary for this. Since financial support is needed, it seems necessary to further regulate this part as well. This is page 8.
This section establishes mandatory sanctions prohibiting the breeding and slaughter of dogs for the purpose of eating them. The enactment bill generally prohibits the breeding, propagation, and slaughter of dogs for the purpose of food, and even the distribution or sale of food, etc. using dogs. Violations of this are subject to criminal punishment, and those with a history of such criminal punishment are subject to dog ban. Possession itself is prohibited. For reference, the amendment to the Animal Protection Act adds cats in addition to dogs to the list of prohibited items.
However, among these enactments, there is a ban on the breeding, slaughter, and distribution of dogs for food purposes, and the consumption of food used by dogs in addition to the distribution and sale. As for criminal punishment for violating the prohibited acts, the enactments each provide different levels of sanctions. It is being decided. Meanwhile, in the case of a ban on dog ownership based on criminal punishment, the target and the period of ban on ownership are set differently. In addition, in the case of Rep. Park Seong-min’s plan, regulations are also being prepared to restrict employment in animal-related facilities. This is page 9.
The enactment and amendment seem to be intended to legislatively guarantee the enforceability of the law by stipulating various prohibitions necessary to end dog meat consumption and establishing sanctions for the same, but additional discussion is needed on the following matters. First, it appears that there is a need to specifically determine the scope of prohibited acts related to dogs for food purposes and food made from dogs. In particular, Rep. Han Jeong-ae’s bill and Rep. Yoon Mi-hyang’s bill ban the consumption of food, etc. made from dogs, which comprehensively covers the current status of dog breeding for food purposes, public acceptance of the issue of ending the consumption of dogs, and the appropriate level of legal regulation for individual eating habits. It appears that this will need to be taken into consideration before making a decision. For reference, page 6 of the revised opinion excludes the intake part.
Second, it will be related to the ban on dog ownership by those who have been sentenced for eating dogs. In this regard, it seems necessary to review both the practical benefits of animal protection, which can be strengthened by restricting the ownership of dogs for a certain period of time for those who have been criminally punished, and the adequacy of regulations to achieve the purpose of the law. .
For reference, it seems necessary to consider the opinion of the Ministry of Justice that banning the future ownership of dogs by those who have been criminally punished for violating the ban on eating dogs would also limit their constitutional rights and could possibly violate the principle of prohibition of excess. For reference, it seems necessary to note that the revised bill’s content for Rep. Tae Young-ho’s ban on animal breeding has similar content, but was not enacted at the Legislative and Judiciary Committee stage due to opposing opinions from the Ministry of Justice. In addition, it seems that the court’s order to restrict employment at animal protection-related facilities for violations such as slaughtering and selling dogs for food purposes requires careful discussion in consideration of the principle of prohibition of excess, which is the limit of basic rights restrictions. For those who slaughter dogs for the purpose of eating, the bill stipulates imprisonment for up to 3 years or a fine of 30 million won, and imprisonment for up to 5 years or a fine of 50 million won. It seems necessary to take into account that in cases where death is caused, the punishment is imprisonment of up to 3 years or a fine of up to 30 million won. In addition, for those who breed or multiply dogs for the purpose of eating, it seems appropriate to relax the statutory penalty rather than slaughtering dogs, considering the proportional relationship between the violation and the level of punishment and the balance in the punishment system.
On page 10 of the revised opinion, it is summarized as imprisonment for up to 3 years or a fine of up to 30 million won for slaughter, and imprisonment for up to 2 years or a fine of up to 20 million won for breeding, propagation, distribution, and sales. The enactment is based on fact-finding surveys, and although the contents of each enactment are different, a basic plan is established and implemented through deliberation by the committee, such as by forming a separate dog meat breeding committee for deliberation or utilizing the existing animal welfare committee.
Each enactment shows some differences in content depending on the detailed items of the basic plan and fact-finding survey on the end of dog meat consumption and whether or not a discussion body on the end of dog meat consumption has been established. Please refer to the table below. This is page 13.
It is understood that the purpose of the enactment is to establish a basic plan to end the consumption of dogs, so that related policies can be promoted more systematically. It also collects and analyzes necessary information and data through fact-finding surveys, and organizes and operates a committee. It is expected that we will be able to gather opinions from various stakeholders through this.
However, it appears that additional review is necessary for the following matters:
First, with regard to the basic plan to end dog meat consumption, it appears that there should be a basic plan at the central government level that reflects a roadmap to end dog meat consumption, as in the enactment. However, there is discussion on the effectiveness of the annual implementation plan established by local governments in the enactment. appears to be necessary.
For reference, on page 15 of the revised opinion, the local government’s implementation plan has been deleted.
In addition, in relation to the fact-finding survey, in order to closely understand the operation status of the dog meat-related industry, it seems appropriate to additionally specify ‘operation status of slaughter, distribution merchants, and food service businesses’ in the survey items. In addition, it seems necessary to establish a legal basis so that relevant public officials can enter and investigate for the purpose of fact-finding. The revised opinion has been reflected on page 22.
Second, the regulations for the establishment of a separate deliberation committee appear to be reasonable in terms of allowing food dog farm workers and experts to participate and in terms of the need for temporary operation, but the Animal Welfare Committee, which was formed and operated in accordance with the current Animal Protection Act, has some functions. The opinion was presented that it is necessary to prepare additional institutional measures to prohibit the establishment of new dog breeding farms. The enactment bill provides that, in cases where certain requirements, such as business registration, are met, a farm owner closes or closes an edible dog farm, a business closure subsidy and additional business closure subsidy can be provided, and a farm owner who closes or closes an edible dog farm converts the type of business. If you look at the contents of Rep. Tae Young-ho’s bill, penalties for animal abuse crimes are being strengthened. The content stipulates that the sentence will be imprisonment for not less than 1 year but not more than 10 years without a fine. In this case, only imprisonment without a fine is stipulated as a penalty and the lower limit of imprisonment is set, thereby limiting the sentencing discretion of judges and allowing the court to determine the nature of the crime in specific cases. It seems necessary to take into account the difficulty of imposing a sentence commensurate with responsibility.
Therefore, I think it is necessary to carefully review the strengthening of penalties for those who commit cruel acts that lead to the death of animals. This part was not reflected in the revised opinion. Finally, page 17. This is a supplementary provision.
In principle, the enforcement date of the law is to be implemented 6 months after the promulgation for the purpose of preparing subordinate laws, etc., but it is subject to factors such as fact-finding surveys to complete early preparations for the implementation of the end of dog meat consumption, reports from related industries, and submission of implementation of the end of dog meat consumption, etc. It seems necessary to implement this law immediately after its promulgation. However, it seems necessary to determine the actual timing of application of the penalty provisions for violations of the prohibition on eating dog meat, taking into account the realistic preparation period required for the closure of dog breeding farms and change of business. For reference, reflecting the government’s opinion, page 34 of the revised opinion states that the period is 3 years. Lastly, even after the expiration of the validity period of the law, it is necessary to continue processing affairs related to business closure and change-of-business support, so from the perspective of legal stability, it seems reasonable not to have a separate validity period like the enactment. . Only when we are clear, we believe that this can be an alternative that allows us to achieve the goal of dog meat consumption while also minimizing the impact on related companies. In that respect, I hope the compensation standards become clearer.
So, when it comes to compensation, the so-called general principle is that fair compensation is a common legal term that allows the government to follow the standards before specifically entrusting it to ensure fair compensation. The same term is used in the Constitution. So, I hope to set the basic direction for compensation standards through terms related to fair compensation. In addition, the recipients of support when closing a business or changing jobs are currently limited to edible dog farms. Not only edible dog farms, but also restaurant businesses related to edible dogs are included, and there will be additional parties involved. Since we cannot specify the contents, I think it would be good if the contents were delegated to a presidential decree and made clear in the text to make it possible to further expand the target. And it can be supported within the budget. At first glance, if the government does a good job, compensation for stakeholders and other such content can be achieved even if it is expressed in the content or legislated, but now, looking at past examples, the government has made such discretionary provisions. Since there is a problem that it cannot be implemented properly when it is put in, I need to convert it to a mandatory regulation regarding compensation, and regarding support for business closure and full-time job support. So, for that, we put such mandatory regulations, and instead, we stipulate the scope and how to do it as something concrete, stipulated by Presidential Decree under the compensation standard of fair compensation, so that actual compensation can be made mandatory, such as business closure and change of job. Regarding this, I think it would be nice if legislation like this were prepared with such contents.

So, from what I can see, if you look at page 24, it seems that the scope of support for business closure is currently limited to dog breeders. However, people in the food industry, distribution and sales, etc. must also be included in order to be viewed this way. I think it needs to be clearly stated. The same applies to full-time support, see page 29. Full-time support should also be provided. Because this is a forced termination by the government, there are issues with the survival and livelihood of the workers currently working here, so I think it is necessary for the government to do something about this accurately. So, it seems that it should be made clear, not by saying that it can be done, but by saying that it must be done, that national responsibility must be made clearer, and compensation must be provided. The same goes for full-time support. That also has to be done, and the target is forced termination, so in this free market situation, depending on certain changes and dynamics in the market, exits and new industries come, and this is not the flow of the process. I hope that this is clearly reflected. Let me tell you. Next, in fact, in the punishment clause, I believe that because this is a forced end, because it has history, culture, and roots, and because it is a punishment clause that affects people, the punishment clause is a little step by step, and milder punishment rather than high-intensity punishment from the beginning. The right way to do it is to increase it as you go. This is how I see it.

◯윤준병 위원: 그럼에도 불구하고, 정부 여당에서 개식용 금지법과 관련된 입법안을 조기에 처리하고 또 국민의힘에서도 그동안 누차에 걸쳐서 민생법안을 조기에 처리해서 일하는 국회의 위상을 제대로 정립하자 이런 주장을 계속해 왔는데 오늘 이미 공지돼 있고 또 본인들이 법안을 신속히 처리해 달라고 요청한 사안을 다루고자하는 법안소위임에도 불구하고 여당 위원들께서 오늘 불참하신 내용에 대해서는 심히 유감스럽게생각하고요.
특히 여당이 참여하지 않았다고 해서 입법과 관련돼 있는 행정부처에서 1명도 참석하지 않은 점에 대해서는 위원장님께서 이런 부분에 대한 조치를 좀 명확하게 해 주시고 다음에는 이런 사례가 반복되지 않도록 하기 위한 노력을 좀 해주셨으면 좋겠고요.
저는 오늘 이와 같이 여당 자기들이 원하는 입법안임에도 불구하고 또 요구했던 입법안임에도 불구하고 이렇게 보이콧 비슷한 행태를 보이는것 이건 반복되지 않도록 하기 위해서는 우리가 민생법안으로 처리해야 될 사안들에 대해서는 단독이라도 처리해서 앞으로는 불참한다고 그래서 법안소위가 파행되지 않는다 이런 위상을 제대로 정립하는 그런 계기로 오늘 법안소위를 운영해 주십사 하는 부탁을 드리겠습니다.
◯소위원장 어기구: 예, 알겠습니다. 민생법안이 우리 법안소위에 많이 있는데요 오늘 여당 위원님들께서 안 오셔 가지고 유감이고요. 안 위원님도 말씀해 주시기 바랍니다.
◯안호영 위원: 방금 법안소위 위원장님께서도 말씀하셨습니다마는 오늘 법안소위에서 다루어야 될 법안들은 민생과 관련해서 대단히 중요한 법안들입니다. 개 식용 종식에 관련된 법안이지만 실제로 우리 농산물가격 안정 문제가 대단히 중요합니다. 농산물가격이 안정되지 않음으로 인해서 실제로 농업․농촌의 지속가능성에 대한 여러가지 우려들이 있고 또 더군다나 최근에 쌀값도 떨어지고 있는 추세여서 농산물가격 안정에 대한 이런 법안이 대단히 필요하고. 또 지속가능한 한우산업을 위해서도 그에 관련된 법안도 대단히 중요한 문제입니다. 뿐만 아니라 농어업회의소에 관련된 법안 역시 농업계를 대변할 수 있는 일종의 대의기구를 만든다는 점에서 대단히 중요한 문제고. 또 이런 법안이 오래전부터 발의가 되었고 관련해서 여당의 입장 또 정부의 입장을 반영해서 실제로 여야가 합의가 가능할 정도로 대폭 수정해서 그 안을 나름대로 준비를 했다고 알고 있는데 그러면 당연히 여당이나 또 정부가 와서 원만하게 법안심사가 될 수 있도록 서로 협의를 하는 것이 우리 국회의 위상이나 의회민주주의 입장에서 봤을 때는 당연히 필요한 일이다 이렇게 생각을 합니다. 그럼에도 불구하고 지금 여당이 참여하지 않고 특히 정부가 참여하지 않은 점에 대해서는 대단히 유감스럽다 이렇게 말씀을 드리고요.
여당이 참석 안 하고 정부가 참석 안 한다고 그래서 법안 처리를 언제까지 미룰 수 있는 것은 아니기 때문에 이 법안에 대한 신속한 처리가 될수 있도록 위원장님께서 회의 진행을 각별하게해 주시기를 요청합니다.

◯신정훈 위원: 나주․화순 신정훈 위원입니다. 정부가 책임 있는 정부로서의 자기 역할을 다해야 된다 하는 것을 다시 한번 촉구합니다. 지금 개 식용 금지법, 그동안 수많은 반대와 찬성 간에 국민들의 갈등이 있었고 또 여기 국회에서도 많은 논의가 있었습니다. 최종적으로 정부가 제시한 개 식용 종식을 위한 특별법은 거기에 반드시 따라야 될 정부의 대책이 또 예산에 대한 대책이 꼭 필요합니다. 정부의 입장이 없이 이 문제가 진행될 수는 없는 것이기 때문에 정부가 반드시 이 자리에 와야 되는데도 불구하고 본인들의 욕심만 다 채우겠다 하는 이 발상은 절대로 용납될 수 없다는 말씀을 드립니다. 저는 그것보다도 오늘 이 법안소위에 올라와 있는 사안들에 대해서, 그 절박성에 대해서 다시한번 말씀드리고 싶습니다.
지금 우리 농민들, 농촌 현장의 민생은 거의 벼랑 끝입니다. 잘 아시다시피 농산물가격이 쌀값도 정부가 약속한 20만 원선이 이미 무너졌고 지금 배춧값 또 뭇값 이런 김장용 채솟값이 하염없이 떨어지고 있습니다, 거의 폐기되고 있고. 이것을 해결하고자 해서 양곡관리법 개정안과 농산물가격안정법 개정안을 우리가 냈는데, 그리고 대부분 다 여당과 정부안을 수용해서 저희들의 입장을 최대한 완화했는데도 불구하고 이렇게 차일피일 미루고 정부나 여당에서 소극적으로 대하는 것은 대단히 유감스럽다는 말씀을 드립니다. 농어업회의소법 역시 마찬가지로 정부가 제출한 대부분의 안들을 수용해서 다시 개정안을 상정하고 있기 때문에 이 문제 역시 책임 있게 정부가 정부의 입장을 내놓아야 된다고 생각합니다.
더 이상 민생을 정쟁의 볼모라든가 정치적 이해의 볼모로 삼아서는 안 된다 하는 점들을 다시 한번 강력히 밝히고요. 간사님께서는 이 문제에 대해서 비상한 각오로 이 임시회에서 이런 민생법안, 절박한 민생법안을 꼭 통과시킬 수 있도록 여당과 정부와 협의를 좀 해 주셨으면 좋겠다 이런 말씀을 드립니다.

◯소위원장 어기구: 예, 그렇게 하도록 하겠습니다. 이원택 위원님 발언해 주시기 바랍니다.
◯이원택 위원: 일단 정부 측에 조금 쓴소리를 안 할 수가 없습니다. 여야 간 법안에 조금 이견이 있거나 또는 여당에서 원하지 않으면 정부 측이 법안심사소위에 일방적으로 참여하지 않는 것은 국회의 관행 또 국회의 입법권에 대한 침해라고 저는 보고 있습니다. 그래서 정황근 장관을 비롯한 오늘 이 자리에 참여할 정부 측이 정말 무책임하다는 생각을 하지 않을 수 없습니다. 그다음에 여당도…… 사실 개 식용 금지법은 여당이나 야당이나 함께 추진하자는 것이었고 또 충분한 보상대책을 마련해서 하자는 것이었습니다. 특히 개 식용 금지법은 여당이 자랑도 하고있는 형국인데 오늘 첫 번째 안건으로 상정되어 있음에도 불구하고 참여하지 않은 것은 이것은 말로는 법안을 처리하겠다고 하는 것이고 실제행동은 따로다, 말 따로 행동 따로의 전형을 보여 주고 있는 게 아니냐 이렇게 보고 있습니다. 그래서 정부의 각성이 필요하고, 앞으로도 정부가 법안심사 때 여당의 눈치를 보고 또는 여당이 다른 의견을 갖고 있으면 참여하지 않는 이런행태에 대해서는 정말 각별한 주의와 대책 또는 국회법을 좀 바꿔서라도 징계 조치가 필요하지 않을까 이런 판단을 해 봅니다. 간사님께 그런것을 좀 강력하게 요청드리고요. 두 번째는 사실 작년과 올해 농민들이 참 힘듭니다. 고물가, 고유가 또 고환율 상황 속에서 농민들의 실질소득이 1200만원대에서 940만원대로 떨어졌습니다. 아마 올해도 도시 자영업자, 근로자를 포함해서 실질소득이 엄청나게 하락하고 있는 과정에서 농민들의 민생 문제가 있습니다. 물가를 잡겠다고 농산물에 대한 가격을 관리하고있으면서 사실 농민들의 생존 또 농민들의 소득에 대한 대책을 등한시하는 것은 저는 민생 문제에 있어 핵심이라고 보고 있습니다. 쌀값 문제 또 여러 가지 배추, 무, 대파, 양파, 밀, 콩, 다양한 가격에 대해서 농민들의 생존이 걸린 문제기때문에 정말 적극적으로 참여해서 의견을 교환해야 되는데 그러지 못한 점에 대해서는 정말 안타깝게 생각을 합니다.
그리고 간사님께 요청드리는 것은 어떻든 개식용 종식과 관련해서는 여야가 의견 차이가 없었던 것으로 제가 기억을 합니다, 법안심사 하는 과정에서. 그래서 오늘 개 식용 종식과 관련해서는 여야 간에 의견 차이가 별로 없기 때문에 이법안 처리는 꼭 진행될 수 있도록 위원장님께서 적극 임해 주실 것을 촉구합니다.
◯소위원장 어기구: 예, 위원님 말씀 잘 유념해서 법안소위 잘 운영하도록 하겠습니다.
그러면 의사일정 제1항 및 제3항 개 식용 종식을 위한 특별법안, 의사일정 제2항 개식용 금지 및 폐업 지원 등을 위한 특별법안, 의사일정 제4항 개식용 금지 특별법안, 의사일정 제5항 개 식용 금지를 위한 특별법안, 의사일정 제6항부터 제8항까지 동물보호법 일부개정법률안, 이상 8건의 법률안에 대해 전문위원께서 주요 사항을 설명해 주시기 바랍니다.
◯전문위원 공춘택: 전문위원입니다. 먼저 소위 심사자료 제1권이 되겠습니다. 개 식용 종식 관련 법안은 제정안 5건 그다음에 개정안 3건, 총 8건입니다. 그래서 내용이 좀있기 때문에 소위 심사자료와 별도로 조문자료는 저희가 참고자료로 준비했습니다. 참고해 주시면 될 것 같습니다. 조문자료에 있는 수정의견은 정부 의견을 중심으로 준비했다는 말씀을 드리도록하겠습니다. 소위 심사자료 1페이지입니다. 제․개정안의 발의 배경 및 취지인데요. 이 부분은 위원님들 알고 계시는 부분이기 때문에 생략하도록 하겠습니다. 3페이지입니다. 개 식용과 관련된 현행법이 어떻게 구성되어있는지, 마련되어 있는지에 대한 내용을 정리하였습니다. 4페이지입니다. 개 식용 관련된 해외 입법사례를 정리한 내용입니다. 특히 참고할 만한 대만 사례는 아래 하단에 표로 제시되어 있습니다. 5페이지입니다. 정부가 개 식용 종식을 위한 사회적 논의기구로 개 식용 문제 논의를 위한 위원회를 구성하고 운영한 경과를 저희가 정리한 내용입니다. 참고로 조사 내용을 보시면 개 식용 관련된 사육농가는 1,156농가이고 관련 개체수는 52만 두로 정리되어 있습니다. 6페이지입니다. 5건의 제정안과 3건의 개정안에 대한 구성 체계 및 주요 내용을 간략하게 말씀드리겠습니다.
5건의 제정안은 아래 표에서 보시는 것처럼 개를 도살․처리하여 식용으로 사용하거나 판매하는 명시적으로 금지하면서 이를 위반하는 경우 처벌하거나 개의 소유 자체를 금지하고, 실태조사를 기반으로 개 식용 종식을 위한 식용개농장의 폐쇄 및 폐업에 관한 사항을 담은 기본계획을 마련함으로써 이를 통하여 폐업한 식용개농장 농장주에 대한 폐업 또는 전업에 필요한 지원을 하도록 하는 한편 식용 목적의 개 사육․도살․판매 등의 금지 및 처벌 조항의 시행을 3년 또는 5년으로 유예하는 것을 주요 내용으로 하고 있습니다. 한편 3건의 동물보호법 개정안은 제정안과 동일한 취지에서 개의 식용 목적 판매를 금지하고 위반 시 개의 사육을 금지하거나 소유를 제한하고 개 사육농장 폐업 시 필요한 지원을 할 수 있도록 하는 내용으로 이하에서는 함께 제정안과 검토를 하도록 하겠습니다. 7페이지입니다. 총칙입니다. 유사 입법례처럼 제정안은 제명, 목적, 정의,국가 등의 책무, 타 법과의 관계 등을 마련하고있습니다. 먼저 제명은 표에서 보시는 것처럼 5건의 제정안마다 다소 차이가 있습니다만 이 부분에 대해서는 법안 심사 내용을 반영하여 정할 필요가 있겠습니다.
두 번째 정의 조항은 식용개농장 및 농장주에 대해서만 정의하고 있습니다만 제정안은 식용 목적의 개 사육․증식을 금지하는 것뿐만 아니라 유통․판매 등도 금지하고 있으므로 도축․유통상인, 음식점 등 식품접객업자 등에 대한 부분도 추가될 필요가 있어 보입니다. 이 부분은 방금 말씀 참고 자료의 수정의견 3페이지에 반영되어 있습니다. 또한 국가와 지자체의 책무에는 개 식용 종식을 위한 시책뿐만 아니라 이에 필요한 행정적․ 재정적 지원이 필요하기 때문에 이 부분도 마찬가지로 추가로 규정할 필요가 있다고 보여집니다. 8페이지입니다.
개 식용 목적의 사육․도살 등의 금지 의무화제재 조항을 마련하고 있는 내용입니다. 제정안은 공통적으로 식용 목적으로 개의 사육․증식 및 도살을 금지하고 개를 사용한 음식물 등을 유통 또는 판매하는 행위까지 금지하고 있으며, 이를 위반 시 형사처벌할수 있도록 하고 이러한 형사처벌 전력이 있는 자에 대해서는 개의 소유 자체를 금지하고 있습니다. 참고로 동물보호법 개정안에서는 그 금지 대상에 개 외에 고양이도 추가하고 있습니다.
다만 이런 제정안 내용 중에서 식용 목적의 개의 사육․도살 외에 유통까지 금지하고 개가 사용된 음식물의 유통․판매 외에 섭취까지 금지하는 내용이 있으며, 금지행위 위반에 따른 형사처벌에 대해서도 제정안은 각각 제재 수준을 달리정하고 있습니다. 한편 형사처벌 전력에 따른 개소유 금지의 경우에도 그 대상자와 소유 금지 기간 등을 달리 정하고 있으며, 이에 더하여 박성민 의원안의 경우에 동물 관련 시설 등에 취업을 제한하는 규정도 마련하고 있습니다. 9페이지입니다.
제정안과 개정안은 개 식용 종식에 필요한 각종 금지의무를 규정하고 이에 대한 제재 규정을 마련함으로써 법의 실행력을 입법적으로 담보하려는 취지로 보입니다만 다음과 같은 사항들에 대해서는 추가적인 논의가 필요하겠습니다. 첫째, 식용 목적의 개와 개를 사용한 음식물등과 관련된 금지행위의 범위에 대해서 구체적으로 결정할 필요가 있다고 보여집니다. 특히 한정애 의원안과 윤미향 의원안은 개를 사용한 음식물 등의 섭취까지 금지하고 있는데 이에 대해서는 식용 목적의 개 사육 현황, 개 식용 종식 문제에 대한 국민적 수용성, 개인 식생활에 대한 적정 수준의 법적 규제 측면 등을 종합적으로 고려하여 결정해야 할 것으로 보입니다. 참고로 수정의견 6페이지에서는 섭취 부분은 제외하였습니다.
둘째, 개 식용 관련 형벌을 받은 자의 개 소유금지와 관련된 내용이 되겠습니다. 이 부분에 대해서는 형사처벌을 받은 자에 대해 일정 기간 동안 개의 소유권 자체를 제한함에 따라 강화될 수있는 동물보호의 실익 측면과 법 목적 달성을 위한 규제의 적정성 측면 등을 함께 검토할 필요가 있다고 보여집니다.
참고로 개 식용 관련 금지규정 위반으로 형사처벌을 받은 자에 대하여 장래에 개의 소유를 금지하는 것은 헌법상의 권리까지 제한하는 것으로 과잉금지원칙에 위배될 가능성이 있다는 법무부의견도 고려할 필요가 있다고 보여집니다. 참고로 개정안의 태영호 의원안 동물사육금지처분의 내용은 유사한 내용으로 법무부의 반대 의견이 있어서 법사위 단계에서 입법화되지 못하였다는 부분을 참고할 필요가 있다고 보여집니다. 또한 식용 목적의 개 도살․판매 등의 위반행위에 대한 법원의 동물보호 관련 시설의 취업제한 명령은 기본권 제한의 한계인 과잉금지원칙등을 고려하여 신중한 논의가 필요하다고 보여집니다. 이 부분은 수정의견 9페이지에서 삭제하였다는 말씀을 드리도록 하겠습니다. 10페이지입니다. 각각의 금지행위별 제재 수준과 관련된 내용이되겠습니다.
제정안 등의 ‘식용 목적으로 개를 도살한 자에 대해서는 제정안은 3년 이하 또는 3000만 원 벌금, 5년 이하 징역 또는 5000만 원의 벌금을 각각 규정하고 있습니다만 현행 동물보호법 등에서는 동물을 학대하여 죽음에 이르게 하는 경우에는 3년 이하의 징역 또는 3000만 원 이하의 벌금으로 하고 있다는 점을 고려할 필요가 있다고 보여집니다. 아울러 식용을 목적으로 개를 사육 또는 증식한 자에 대해서는 위반행위와 처벌 수준의 비례관계, 형벌체계상의 균형 등을 고려하여 개를 도살하는 경우보다는 법정형을 완화하는 것이 타당하다고 보여집니다.
수정의견 10페이지에서는 도살의 경우에는 3년이하 징역 또는 3000만 원 이하 벌금, 사육․증식, 유통․판매의 경우에는 2년 이하의 징역 또는 2000만 원 이하의 벌금으로 정리하였습니다. 추가적으로 개 식용 종식에 필요한 실태조사 및 이행점검 등의 과정에서 농장주 등의 방해 또는 거부행위가 예상될 수 있기 때문에 관계 공무원의 출입․조사의 실효성을 확보하기 위해서는 과태료 부과 조항을 신설하는 것이 필요하다고 보여집니다. 11페이지입니다.
이와 관련하여 농림축산식품부는 식용 목적으로 개를 도살하는 등 위반행위 및 시설에 대한 제재의 실효성을 제고하기 위해서는 지자체장의이행조치명령 및 시설 폐쇄 조치와 같은 제도적관리 수단 마련이 필요하다는 의견을 제시하였고, 수정의견 13페이지에 이와 같은 내용들이 반영되어 있습니다. 이와 관련 유사 입법례로는 동물보호법이 있다는 말씀을 드리도록 하겠습니다. 12페이지입니다.
제정안은 실태조사를 거쳐, 제정안마다 내용이다르긴 합니다만 개식용종식위원회를 별도로 구성하여 심의하거나 또한 기존 동물복지위원회를 활용하여 심의하는 등 위원회의 심의를 통하여 기본계획을 수립․시행하도록 하고 있습니다.
각 제정안은 세부적으로 개 식용 종식 기본계획 및 실태조사의 항목과 개 식용 종식 논의기구의 설치 유무에 따라 일부 내용에 차이를 보이고 있습니다. 아래 하단 표를 참조해 주시면 되겠습니다. 13페이지입니다.
제정안은 개의 식용을 종식하기 위하여 기본계획을 수립하도록 함으로써 관련 정책이 보다 체계적으로 추진될 수 있도록 하려는 취지로 이해가 되고 실태조사를 통하여 필요한 정보와 자료를 수집․분석하도록 하는 한편 위원회 구성․운영을 통하여 다양한 이해관계자들의 의견수렴을 할 수 있을 것으로 기대가 됩니다.
다만 다음과 같은 사항들에 대해서는 추가적인 검토가 필요하다고 보여집니다.
먼저, 개 식용 종식 기본계획과 관련하여는 제정안처럼 개 식용 종식을 위한 로드맵이 반영된 중앙정부 차원의 기본계획이 있어야 할 것으로 보이고 다만 제정안의 지자체가 수립하는 연도별시행계획에 대해서는 효과성 등에 대한 논의가 필요할 것으로 보입니다.
참고로 수정의견 15페이지에서는 지자체의 시행계획에 대해서는 삭제하였습니다.
또한 실태조사와 관련하여 개 식용 관련 업계의 운영 현황을 면밀히 파악하기 위해서는 그 조사 항목에 ‘도축․유통상인․식품접객업자의 운영현황’ 등을 추가적으로 규정하는 것이 타당하다고 보여집니다. 아울러 실태조사를 위한 관계공무원이 출입․조사할 수 있도록 그 법적 근거를 마련하는 것도 필요하다고 보여집니다. 수정의견 22페이지에 반영하였습니다.
둘째, 별도의 심의위원회 설치 규정에 대해서는 식용 개 농장 종사자 및 전문가 등이 참여할수 있다는 측면과 한시적 운영 필요성 측면에서 타당한 측면이 있다고 보여집니다만 현행 동물보호법에 따라 구성되어 운영 중인 동물복지위원회에 일부 기능을 추가하거나 분과위원회를 구성하는 방안도 함께 논의할 수 있다고 보여집니다.
수정의견에서는 별도 위원회 설치 부분에 대해서는 18페이지에 반영돼 있고, 기존 위원회를 활용하는 부분에 대해서는 15페이지에 각각 반영돼있습니다. 이 부분은 논의해 주시면 결과에 따라 각각 반영하도록 하겠습니다.
이와 관련하여 농식품부는 개사육농장 등이 보유 중인 개의 개체 수 감축, 폐업 및 전업 등 종식 이행상황을 효율적으로 점검하고 관리할 수있도록 관련 업계의 신고 및 종식 이행계획서 제출 제도를 신설할 필요가 있고, 개사육농장 등의 신설을 금지하는 내용의 추가적인 제도 방안 마련이 필요하다는 의견을 제시하였습니다. 이 부분은 22페이지에 별도로 수정의견으로 제시했습니다. 14페이지입니다.
제정안 등은 사업자 등록 등 일정한 요건에 해당하는 경우에 농장주가 식용 개 농장을 폐쇄 또는 폐업하는 경우에 폐업지원금 및 추가 폐업지원금 등을 지원할 수 있도록 하고 식용 개 농장을 폐쇄 및 폐업한 농장주가 업종을 전환하는 경우 취업알선이나 금융지원 등 행정적․재정적 지원을 하려는 내용입니다.
다만 윤미향 의원안은 추가 폐업지원금의 범위에 농장주가 소유권을 포기한 개의 처분에 대한 부분은 제외하고 농장주가 폐업지원 신청 시 지자체가 해당 개의 소유권을 취득하도록 하고 있는 내용이 다른 부분입니다.

제정안과 개정안은 농식품부 주도하에 식용 목적의 개사육농장을 폐업한 농장주에게 폐업지원금을 지급하고, 고용정보 제공이나 취업알선 등전업에 필요한 지원을 함으로써 개식용 산업의 자발적인 구조조정이 이루어지도록 유도하는 한편 개고기 식용과 관련된 사회적 갈등을 조속히 원만하게 해소하려는 취지로 이해됩니다. 개 식용 종식 관련 특별법이 제정되는 경우 개사육농장 등의 전․폐업이 불가피한 관련 업계와 종사자가 안정적인 경제활동을 이어갈 수 있도록 개사육농장 철거나 폐업 및 전업에 필요한 부분에 대해서는 합리적인 범위 내에서 지원할 필요가 있다고 보여집니다.
이 부분은 수정의견 24페이지와 29페이지에 폐업 지원 및 전업 지원으로 각각 분리하여 마련하였고 그 내용을 보시면 신고․이행계획서를 제출한 자에 대해 한정하여 이러한 지원을 할 수 있도록 마련이 되어 있습니다.
다만 이에 농식품부는 개사육농장 철거 등에 소요되는 경비는 원칙적으로 지원이 가능하나 별도의 농장 시설물 잔존가액이나 폐업 이후 전업까지 생계 안정에 필요한 자금 지원 등은 추가적 재정 소요가 수반되기 때문에 재정 당국과의 추가적인 협의가 필요하다는 입장입니다. 또한 제정안이 실제 시행되는 경우에도 법 시행의 유예기간 동안 식용 개의 출하 등이 가능하다는 점등을 고려하여 지원 수준을 결정할 필요가 있다는 입장을 가지고 있습니다. 또한 제정안과 개정안 모두 폐업 및 전업 지원의 대상을 ‘식용개 농장’으로 한정하고 있습니다
만 이 외에 개 식용 관련된 도축․유통상인, 관련 음식점 등에 대해서도 원활한 개 식용 종식의 이행이 이루어질 수 있도록 적절한 지원 방안이 마련될 필요가 있다고 보여집니다. 이 부분은 24페이지와 29페이지에 수정의견으로 제시하였습니다. 16페이지입니다.
태영호 의원안에 관련된 내용을 보시면 동물학대범죄에 대해서는 그 벌칙을 강화하고 있습니다. 내용은 벌금형 없이 1년 이상 10년 이하의 징역에 처하도록 하는 내용인데, 이 경우 벌금형없이 징역형만을 벌칙으로 규정하면서 징역형의 하한을 설정하여 법관의 양형재량이 제한되고 법원이 구체적 사안에 대한 죄질과 책임에 상응하는 형을 선고하기 어렵다는 측면을 고려할 필요가 있다고 보여집니다.
따라서 동물을 죽음에 이르게 한 학대행위를 한 자에 대한 벌칙을 강화하는 부분에 대해서는 신중한 검토가 필요하다고 생각됩니다. 이 부분은 수정의견에 반영하지 않았습니다. 끝으로 17페이지입니다. 부칙입니다.
법 시행일은 하위법령 마련 등을 위해 원칙적으로 공포 후 6개월이 경과한 후 시행하도록 하되 개 식용 종식 이행을 위한 준비를 조기에 완료하기 위한 실태조사나 관련 업계의 신고 및 종식 이행 제출 등 이런 부분에 대해서는 이 법 공포 즉시 시행할 필요가 있다고 보여지고요. 다만 개 식용 관련 금지의무를 위반한 경우에 적용하는 처벌조항의 실제 적용 시점에 대해서는 현실적인 개사육농장 폐업 및 전업에 필요한 준비기간 등을 고려하여 결정할 필요가 있다고 보여집 니다. 참고로 정부 의견을 반영하여 수정의견 34페이지에는 3년으로 하였습니다. 끝으로 법의 유효기간은 동 기간이 종료된 이후에도 폐업․전업 지원과 관련하여 진행된 사무는 계속 처리하게 할 필요가 있기 때문에 법적안정성 측면에서 제정안과 같은 별도의 유효기간은 두지 않는 것이 타당하다고 보여집니다. 34페이지 수정의견에서 이 부분은 삭제하였다는 말씀을 드리겠습니다.

◯안호영 위원 전문위원 설명을 잘 들었는데요. 조금 애매한 부분이 있어서 질문을 좀 하고 또 의견을 얘기할까 하는데요. 지금 현재 중요한 것은 이렇다고 봅니다. 그러니까 개 식용을 종식해야 될 필요가 있고 또 이부분에 대해서는 여야 간에 또 정부도 같은 입장을 표명한 것으로 알고 있는데, 문제는 실제로 이것을 종식을 하게 될 때 많은 이해관계인들이 있는데 예를 들어서 사육을 하는 농장주라든지 아니면 관련 도축업자라든지 유통하는 유통업자그리고 또 관련 식품업자들 많은 분들이 있을 것으로 보입니다.
그래서 이 부분들에 대해서는 만약에 종식을 하게 되면 결국 폐업하거나 또 전업하게 되는데 그 경우에 여기에 보면 예산 범위 내에서 행정적․재정적으로 지원할 수 있다 지금 이렇게 되어 있잖아요?

◯안호영 위원 그런데 그런 경우에 예산 범위내에서 할 수 있다 이렇게 되어 있으면 보상의 범위도 애매할 뿐만 아니라 그리고 또 할 수 있다로 되어 있으면 할 수도 있고 안 할 수도 있기때문에 상당히 관련된 사람들에 대한 피해의 회복이, 회복에 대한 대책으로는 상당히 미흡하다,이 법안의 내용으로 보면. 그래서 이 농장주라든가 또 여기 도축 또 유통업자 그다음에 식품업자에 대한 보상을, 그분들이 입는 피해에 대해서 정당한 보상 내지 지원이 반드시 되어야 된다. 할 수 있다, 예산 범위 내에서 할 수 있다는 게 아니라 실제로 그게 보상이, 정당한 보상 내지 지원이 되어야 한다라는 취지가 이 법조문에 반드시 들어갈 필요가 있다 이말씀을 드리고 싶고요.
그다음에 이러한 지원을 해 나감에 있어서 관련된 여러, 아까 말했던 그런 분들의 어떤 의견들을 수렴해서 정책을 만들고 시행할 수 있도록하는 내용들이 이 법안에 들어가야 된다는 그런 의견을 저는 꼭 드리고 싶고. 그리고 그런 측면에서 전문위원님께서 이런 취지가 반영될 수 있는 그런 내용으로 법안의 문구를 성안을 같이 좀 하는 제안을, 그 부분에 대한 성안의견을 주시면 좋겠다 이런 말씀을 드립니다.
◯전문위원 공춘택 예, 알겠습니다. 결정해 주시면 저희가 반영을 하도록 하고요. 그런데 입법례를 보면 지원하여야 한다는 부분도 있고, 지원할 수 있다 부분도 있는데 그 부분은 입법 정책의 문제라 생각을 하고. 의견을 듣는 부분에 대해서는 저희 생각은, 그러니까 기본계획을 수립할 때 폐업 및 전업에 관한 지원 내용이 들어가 있습니다. 그래서 보통 입법례를 따라서 기본계획 수립 단계에서 관련 이해관계자의견을 듣도록 그렇게 하는 게 어떨까 싶습니다.

◯윤준병 위원 저도 안호영 위원님 말씀 주신내용과 같은 생각인데요. 일단 여기서 핵심이 되고 있는 내용은 우리가 식용 개에 대해서 금지를 또는 이렇게 하고자 하는, 종식을 시키고자 하는 취지의 일반적인 내용은 꽤 많이 다듬어졌다고 생각합니다. 다만 관련 이해당사자들이 실제 우리 개 식용 종식을 시키려고 하면 소위 임의단체이기는 하지만 육견협회나 이런 단체들에 또는 요식업이나 이런 단체들에 실제 보상이, 폐업이나 전업할 때 보상이 적정하냐 여부에 대한 기준이 명확해야 서로 우리가 가고자 하는 개 식용종식도 시키면서 또 관련 업체들의 충격도 최소화시킬 수 있는 이런 대안이 될 수 있다고 판단됩니다. 그런 측면에서 보상 기준도 명확하게 됐으면 좋겠다.
그래서 소위 일반적인 원칙이 보상과 관련해서는 정당한 보상이 이루어지도록, 구체적으로 위임하기 전에 정부로 하여금 그 기준에 따를수 있도록 하는 통상 법률적인 용어가 정당한 보상이잖아요, 헌법에도 같은 용어를 쓰고 있는데. 그래서 정당한 보상과 관련된 용어를 통해서 보상기준에 대한 기본 방향을 정했으면 좋겠고. 또 폐업이나 전업할 때 지원받을 대상에 대해서도 지금 여기서는 식용 개 농장 이렇게 한정되어 있는데 식용 개 농장뿐만이 아니고 식용 개에 관련해서 하고 있는 요식업 이것 관련되어 있는 내용도 함께 포함되고 추가적으로 관련되고 있는 당사자들이 있을 텐데 그 내용은 우리가 구체화할 수 없으니 그 내용은 대통령령으로 위임해서 대상을 좀 더 확대가 가능하도록 만드는 문안 이렇게 명기가 됐으면 좋겠다 이런 생각이 듭니다. 그리고 예산 범위 내에서 지원할 수 있다 이런내용은 일견 정부가 잘 하면 그 내용에 그런 표현으로 해도, 입법화해도 이해당사자들의 보상이나 이런 내용이 이루어질 수는 있는데 지금은, 과거 또 예로 보면 정부가 그렇게 재량규정으로 넣었을 때 제대로 이행되지 못하는 문제가 있기때문에 저는 보상과 관련해서는 의무규정으로 전환해야 된다, 폐업 지원과 전업 지원에 대해서는. 그래서 거기에 대해서는 그런 의무규정을 넣고 대신에 어떤 범위 내에서 어떻게 할 것인지에 대해서는 정당한 보상이라는 보상 기준하에서 대통령령으로 정하는, 좀 구체화할 수 있는 이런 내용으로 명문화해서 실제 보상이 의무적으로 이루어질 수 있도록 폐업과 전업과 관련해서는 그런내용으로 이렇게 입법안이 마련됐으면 좋겠다 이런 생각이 듭니다.
그런 측면에서 소위 24쪽부터, 지금 소위심사참고자료 24쪽부터 이렇게 죽 조문 비교를 해 놓으셨잖아요.

◯윤준병 위원 24쪽 그다음에 나와 있는 내용이29쪽 두 가지, 그 두 조문. 그러니까 폐업 지원과 전업 지원에 대해서 조문 정리를, 그런 내용이담기도록 수정안을 조문 정리를 해 가지고 이렇게 심의를, 더 진도를 나갔으면 좋겠다 이런 바람을 말씀드립니다. 이상입니다.

◯이원택 위원 저도 사실 개 식용과 관련해서, 저는 개인적으로 식용을 하지는 않지만 그 나라의 역사와 문화가 있다고 보고 있습니다. 그러나 그 역사와 문화를 배경으로 하고 있기 때문에 이게 사실 시장에서의 이렇게 정상적이고 합리적인 어떤 종식, 자율적인 종식이 되는 것이 사실 제일 바람직한데 그것은 현재 시점에서 일정한 시간이 앞으로도 좀 더 지나야만이 시장에서 어떤 자율적 종식이 미치는 단계인데 이것을 지금 법을 통해서 강제적으로 종식을 시키겠다는 것 아니겠습니까.
그렇기 때문에 이게 시장의 어떤 균형과 질서에 따라서 종식되는 게 아니고 법을 통해서 강제적 종식을 하겠다는 거기 때문에 이와 관련된 대책은 정부가 의무적 대책을 가져야 된다고 봅니다. 이것은 국가가 책임지고 강제적으로 종식하겠다는 거기 때문에, 특히 농식품부도 이 개 식용 금지에 대해서 적극 찬성하고 있기 때문에 이부분에 대해서는 국가의 책임을 의무화해야 된다 저는 이렇게 보고 있습니다.
그래서 제가 볼 때, 24페이지에 보면 폐업 지원 대상에서 지금 개 사육 농장주로 국한하고 있는 것 같아요, 제가 보면. 그런데 여기 관련 식품업계라든가 유통․판매라든가 이런 쪽에 오는 쪽도 저는 포함의 대상이 되어야 이렇게 보여집니다. 그것을 분명하게 넣어야 될 것 같고. 또 전업 지원에서도 마찬가지다, 29페이지에보면. 전업 지원에서도 넣어 줘야 된다. 왜냐하면 이것은 정부가 강제 종식을 하는 것이기 때문에 여기에 현재 종사하고 있는 종사자들의 생존과 또 생계 문제가 뒤따르는 부분이 있기 때문에 정부가 이 부분에 대해서는 정확하게 해주는게 필요하다 이렇게 보고 있고요. 그래서 할 수 있다가 아니라 해야 한다, 국가책임을 좀 더 분명하게 해서 보상도 해야 한다라는 것으로 분명히 해야 된다 이렇게 보여집니다. 전업 지원도 마찬가지입니다. 그것도 해야 한다라는 거고 대상도 강제 종식이기 때문에 시장에서 이렇게 자유로운 상황에 따라서 시장의 어떤 변화와 역동성에 따라서 퇴출되고 새로운 산업이 오고 이런 과정의 흐름으로 가는 게 아니라는 점에서 저는 분명하게 그것을 반영해 주셨으면 좋겠다 이런 말씀을 드립니다. 그다음에 사실 처벌 조항에서는 저는 이게 강제 종식을 하는 것이기 때문에, 이게 역사와 문화와 뿌리가 있기 때문에, 사람에게 영향을 주는 처벌 조항이기 때문에 처벌 조항은 조금 단계적으로, 처음부터 고강도 처벌보다는 완화된 처벌을 하고 가면서 높이는 방식이 맞겠다 저는 이렇게 보고 있습니다.
그래서 항목별로 그러면 어느 수준은 어떻게 할 거냐, 이것은 어떤 다른 동식물에 대한 제재조항도 상호 연구․비교를 해야 될 것 같고 또 선진국 사례, 다른 나라 사례도 있을 것 같고 해서, 왜냐하면 역사와 문화가 있는 과정이 있기때문에 아무래도 강제 종식한다 하더라도 아직인식과 문화의 차이가 시장에서는 갭이 있을 수있다고 봅니다. 그래서 저는 그런 의견을 좀 냅니다. 그렇게 검토를 해 주셔야 될 것 같아요.
◯전문위원 공춘택 예, 제가 두 가지만 말씀드리겠습니다.
윤준병 위원님과 이원택 위원님 말씀하신 지원대상 관련되는 부분은 참고자료 24페이지에 보면9조에 따라 신고하고 이행계획서를 제출한 자인데 그 대상에, 지금 참고자료 22페이지 보시면 제 9조에 있습니다. 즉 농장주 외에도 도축․유통․판매, 그다음에 식품접객업 포함되어 있기 때문에 그 부분은 포함되어 있다는 말씀을 드리고요. 다만 실질적으로 어떤 그런 지원 기준이라든가내용 이런 부분에 대해서는 법률에 담기는 좀 제한이 있어서 위원님 말씀하신 것처럼 그것을 시행령으로 담되 정부가 내부 협의를 해서 적정한 보상이 이루어질 수 있도록 하는 게 맞다고 보여집니다.
또 하나는, 처벌 조항 말씀하신 부분은 저희도 그런 부분을 고민했던 부분이고요.
그래서 지금 보시면 아까 말씀드린 것처럼 동물보호법에도 유사한 조항이 있습니다. 그래서 그런 부분과 체계를 맞추었다는 말씀을 드리도록 하겠습니다.

◯안호영 위원 그럴까요. 그 검토를 잠깐, 어차피 전문위원님께서 이것을 검토하려고 그러면 잠깐 휴회했다가 아마 다루어야 되지 않을까 저도 생각이 들고. 검토하실때 제가 보니까 지금 참고자료 4쪽의 3조 보면 국가 등의 책무, 1항에 관련된 부분이 있는데요. 여기에 필요한 행정적․재정적 지원을 할 수 있다라고 되어 있는데, 이것은 할 수 있다라고 되어 있는데 이것을 하여야 한다라는 것으로 바꿔야 되지 않을까 하는 생각이 들고요. 나머지 대상에 관련돼서는 아까 전문위원님께서 말씀하신 대로, 내려오면 농장주, 개 식용 관련 도축․유통상인 및 개 식용 관련 식품접객업자라고 법문에 나와 있으니까……

◯안호영 위원 그것 그렇게 특정을 하면 될 것같고요. 그다음에 보상 기준에 관련해서는 어쨌든 하위법령으로 위임을 하되 적정한 기준은 또 명확히 밝혀야 되니까 정당한 보상, 보통 정당하다고……정당한 보상이다고 할지 적당한 보상이 될지는 모르겠습니다만 정당한 보상의 그 내용 기준이정리될 필요가 있겠다 그런 생각이 듭니다. 그것을 참고해서 정리를 하면 좋겠습니다.

◯전문위원 공춘택 말씀드리겠습니다. 제3조의 아까 말씀하신 것처럼 현행은 ‘행정적․재정적 지원을 할 수 있다’로 되어 있는데 ‘이에 필요한 행정적․재정적 지원을 하여야 한다’ 이렇게 수정을 했고요. 그다음 6조의 아까 말씀하신 내용 중에 기본계획을 수립하는 단계에서 ‘농림축산식품부장관은 시․도지사 및 개사육농장 등 관련 단체의 의견을 들은 후 제8조에 따른 개식용종식위원회의 심의를 거쳐야 한다’ 이렇게 수정을 하였습니다. 또한 제8조의 개식용종식위원회의 구성에 대한 법적 근거를 별도로 마련했고. 그다음 11조와 12조의 폐업과 전업에 관련된부분입니다. 폐업 등의 지원에 대한 부분은 국가 및 지자체는 제9조1항에 따른 신고를 하고 이행계획서를 제출한 자에 대하여 정당한 보상이 이루어질 수있도록 폐업 등에 필요한 사항을 지원하여야 한다, 이렇게 정리를 했고. 2항에 ‘제1항에 따른 지원의 내용과 대상․기준 및 절차 등에 관하여 필요한 사항은 대통령령으로 정한다’ 이렇게 정리했습니다. 제12조의 경우 전업 지원 규정도 국가 및 지자체는 제9조1항에 따른 신고를 하고 이행계획서를 제출한 자에 대하여 마찬가지로 정당한 보상이 이루어질 수 있도록 전업에 필요한 시설 및 운영자금 등의 지원을 하여야 한다.
2항에 ‘제1항에 따른 지원의 내용과 대상․기준, 절차 등에 관하여 필요한 사항은 대통령령으로 정한다’ 이렇게 정리를 했습니다. 이상이고, 마지막으로 아까 논의 안 된 부분중에서 법률 제명이 약간씩 차이는 있습니만 그부분에 대해서 정리를 해 주시면 마무리가 될 것같습니다.
참고로 정부 입장에서는 ‘식용개’라는 표현에 대해서 좀 부정적이어서 정부 의견으로는 제명을 ‘개의 식용 목적의 사육․도살 및 유통 등의 금지에 관한 특별법’ 이렇게 제안을 하였습니다.
