2. 귀하의 민원내용은 ‘개의 사육농장부터 개고기를 판매하는 식당까지 광범위한 부분에 걸친 불법 행위에 대한 단속 요청’에 관한 것으로 이해됩니다.

3. 귀하의 질의사항에 대해 검토한 의견은 다음과 같습니다.
가. 국내 현행법상 “개”의 법적 지위는 매우 다양합니다. 축산법에서는 가축(「 축산법」 제2조제1호 및 동법 시행규칙 제2조제1호)으로, 동물보호법에서는 학대등의 행위에서 보호를 받아야 하는 등록대상동물(「동물보호법」 제2조제2호 및 동법 시행령 제3조)로 분류되어 있습니다. 하지만, 가축의 도살 및 육류 등의 처리를 규정하고 있는 「축산물 위생관리법」에서는 가축의 범위에 언급이 되어 있지 않습니다. 이러한 모순된 개의 법적 지위는 항상 개식용 논란으로 이어져 왔으며, 이 문제는 장기적인 관점에서 사회적 합의 도출과 법적 보완이 먼저 이루어져야 할 사안으로 사료됩니다.
나. 귀하가 언급하신 여러 법령의 위반행위에 대해서는 우리 곡성군의 각 법령 소관 부서에서는 상시 단속을 실시하고 있습니다만, 동물학대, 밀도축 등의 불법행위는 대부분 음지에서 이루어지고 있기 때문에, 단속인원의 부족 등 우리 군의 여건상 적발이 쉽지 않은 상황입니다.
다. 앞으로도 우리 군에서는 동물에 대한 고의적인 학대 등 불법적인 행위가 일어나지 않도록 지속적으로 의심 현장 점검과 고발 등 후속조치를 시행할 것이며, 복합적인 문제는 각 법령 소관부서와 협력하여 해결해 가도록 하겠습니다. 감사합니다.

Results 1. Greetings! Thank you for your petition that interest in Gokseong and animal welfare. We have reviewed the petition(NO.1AA-2008-0639730) you submitted through the E-portal, which is understood to be related to the ‘problem of slaughtering dogs, selling dog meat and cooking dog meats’.
2. The legal status of dogs in domestic law is very diverse. It is livestock in ‘Livestock industry act’ and registered animal (protected by abuse) in ‘Animal protection act’. But dog is not livestock in ‘Livestock products sanitary control act’ that regulate slaughter of livestock and disposal of meat, etc. The contradictory legal status of dogs has always led to controversy of dog meat. This controversy will be considered as sensitive issue which will need more social consensus and legal supplementation in a long-term perspective.
3. Many department in our county has been cracking down on any breach of law you mentioned. But most breach of laws like animal abuse and secret slaughter are taken secretly in our situation of staff shortage, it is hard to find breach of laws.
4. From now on, our county will conduct inspections and accusations to prevent any illegal acts such as animal abuse and so on. And the complex problem will be solved in cooperation with various departments.
