Sharing for Gyeyang Rescue Dog Shelter Civil Society Organization (Volunteers To Save The Dogs At The Lotte Dog Farm)

180 dogs rescued from slaughter by Coexistence of Animal Rights on Earth (CARE) and volunteers, are about to be evicted from their shelter with nowhere to go. Please help these dogs by signing and sharing the official Korean government petition.

Saving 253 dogs of Mt. Gyeyang Dog Farm results in Criminal Charge with $6,500 fine

1. 180 dogs still in the facility must be protected and the facility must be legally designated as an animal shelter.
2. Remove the criminal charge and fines on Gyeyang Animal Shelter.
3. Urge 4 Lotte Corps inheritors who own the land to carry out what they had promised.

The Lotte dog farm was discovered in March 2020 after illegally operating for 40 year. Supporters, CARE and volunteers rescued 253 dogs. They had founded and have been operating the non-profit Lotte Farm Dog Rescue Civil Society Organization (CSO).

In July 2020, one of the supporters had paid compensation to the owner of the farm to surrender ownership and to immediately stop the slaughter of the dogs. The CSO has been giving care to the dogs for over 9 months including veterinary clinic service and vaccinations. So far, 49 of the dogs were adopted overseas and 22 of them had been moved to other shelters, awaiting adoption.

The CSO and volunteers removed the raised wire cages and built new covered structures at the site to give them a better life.

In addition to the brutal environment at the area, they had to fight municipal authority which tried to shut down the shelter. For instance, the Gyeyang District Office tried to stop us from building the covered cage complex in progress while the dogs were exposed to rain for 3 days straight.

The CSO funded the construction of structures around the area which were covered with plastic so the dogs can survive through the winter. Then, Gyeyang District Office added criminal charges and fines about $6,500 and ordered the removal of the facility. The District claimed that the CSO was “breeding” and “not caring”, like the previous farm owner. The District then sent a mandatory order to demolish the facility by 23rd of May 2021, and threatened with criminal charge if not in compliance with their orders.

The Animal Protection Department of the District rejected to approve designating the facility as an animal shelter. Therefore, the CSO filed a municipal petition with 4,034 petition signatures in Incheon, requesting approval, but the municipal office has not responded.

The volunteers visited the District Office several times asking to give more time or find another location but the answer is always NO. The chief of the District refused a meeting we requested and blocked us with district guards.

The dogs in the farm had, with the previous owner, been fed food garbage, confined in raised wire cages without shelter from harsh weather, inbred, abused, developed deformed paws due to the wire cage, then slaughtered when they get their first step out of the cage.

The Gyeyang District did nothing but respond with criminal charges, fines, and bullying the CSO. Lotte Corp. promised on media interviews, that they will “save the dogs”, but they did nothing.

Mr. President, Lotte Corp.’s 4 inheritors did nothing for the abused dogs while the volunteers were trying to do everything to help the dogs. Please make the inheritors act on what they promised.

The District claims the nonsense that Gyeyang Animal Shelter cannot be a shelter because an animal shelter only has animals without ownership, but the dogs at the facility belong to the CSO. Although the Federal Animal Protection Office agrees that the role of a private animal shelter is to rescue and protect animals handed over from another facility, person or farm owner when the ownership issue was finalized legally.

We have been giving care to the dogs and finding adopters since the previous owner terminated his ownership. Gyeyang Animal Shelter CSO is a licensed organization that has accountability to our activities. No one can use, sell or dispose of the dogs, which confirms that they are not “owned”.

The CSO has been providing the best for the dogs, as volunteers serve fresh food and water every day, clinic service and vaccination as needed, overseas adoption and so on. We have been working together as a team to help those abused dogs. We are an Animal Shelter. We have faith in the federal government that they will not ignore this situation where a group consisting of citizens who work hard toward the Good, and bettering the lives of innocent animals, gets bullied by a district office.

계양산 개농장 개들 253마리 살렸는데, 돌아온 건 ‘형사 고발’입니다. 724만원도 내라고 합니다.

1. 계양산 개농장에서 구조한 뒤 남겨진 180여마리의 개들을 보호 대상으로 인정하고 동물보호시설로 유권해석 해주십시오.
2. 계양산시민보호소 개들 관련한 이행강제금 부과와 형사 고발을 취하하고 중단해주십시오.
3. 계양산 개들이 있는 땅을 상속받은 ** 상속인 4명이 개들을 살리는 도덕적 책무를 다하도록 촉구해주십시오.
2020년 3월에 40여년간 운영되온 계양산 개농장을 발견하였고 개인후원자와 동물보호단체 케어, 시민봉사자들이 함께 하여 253마리의 개들을 구조하였습니다. 개들을 지키기 위해 **목장개살리기시민모임으로 비영리단체를 결성하여 개들을 돕고 있습니다.

2020년 7월부터 개농장 주인에게 독지가의 도움으로 육견사업포기위로금을 지급하였고, 개농장 주인이 개들을 포기하여 도살을 막고 시민들의 후원으로 개들을 9개월 넘게 돌봐오고 있습니다. 병원치료와 접종을 하고 49마리는 해외입양을 갔고, 22마리는 위탁처에서 입양을 준비하고 있습니다.

저희 시민들은 계양구청에 협조하고자 뜬장을 철거하고 새 견사를 지어 개들을 돌봐오고 있습니다. 그대로 두면 도살장에 끌려가 죽을 걸 알기에, 열악한 상황에서도 어떻게든 살리려 애썼습니다.

그 과정은 고난의 연속이었습니다. 특히 담당 지자체인 계양구청은 오직 불법이란 점만 내세우고, 개들을 살릴 아무런 대책도 제시하지 않은 채 압박을 해왔습니다.

3일 연속 비가 오는 날이었습니다. 개들이 속수무책으로 비를 맞아 천막을 쳐주려고 했습니다. 그런데 어느새 알고 온 계양구청 ****과장이 이를 막으려고 했습니다.

지난겨울 영하의 날씨 맹추위에 개들이 동사하지 않도록 시민들의 힘으로 어렵게 모금해 비닐하우스를 쳐주었습니다.

그랬더니 계양구청 ****과는 무단형질변경이라며, 시민모임에 강제철거명령을 하고 이행강제금(724만 5000원)을 부과하고 형사 고발까지 했습니다. 계양구청 환경과도 저희가 ‘보호’를 하지 않고 개농장 주인과 같이 ‘사육’을 하고 있다며, 5월 23일까지 강제철거명령을 내렸습니다. 미이행시 형사고발을 하겠다고 합니다.

계양산 개들은 개농장 주인이 소유를 포기했습니다. ‘유기유실동물’임으로 구조와 보호의 대상으로 인정받아야 마땅합니다.

그런데 계양산 동물보호과는 “개농장 개는 보호의 대상이 될 수 없다.“ 며 보호대상으로 인정해주지 않아 계양산시민보호소는 동물보호시설로 유권해석을 받지 못하였습니다. 이에 시민모임은 인천청원을 통해 ‘***보호소’의 사례와 같이 동물보호시설로 유권해석을 요청하였고 4034명이 공감을 했음에도 인천시에서는 별 수 없다는 무성의한 답변만 했습니다.

시민모임 봉사자들은 수차례 계양구청을 찾아가 개들이 입양갈 때까지 유예기간을 주거나, 이전할 땅을 임대해달라고 부탁했습니다. 어떻게든 살리고 싶다는, 애타고 간절한 호소였습니다. 그러나 항상 안된다는 대답뿐이었고 계양구청장은 시민모임이 수차례 찾아가서 만남을 요청했으나, 청원경찰을 10명 이상 세우고 항상 문전박대했습니다.

40여년간 계양산에서 불법적으로 운영되던 개농장에서 수많은 개들이 썩은 음식물쓰레기를 먹고, 평생 뜬장에서 고통받고, 강제로 근친교배당하고, 학대받고 골병이 들고 발가락이 휘고 뜬장을 처음 나온 날 개고기로 도축되어 죽었습니다.

그러나 계양구청은 개들을 위해서 아무것도 하지 않았습니다. 오히려 이 개들을 불쌍히 여겨 발 벗고 나선 시민단체를 형사고발하고 이행강제금 부과하며 범법자 취급하며 괴롭히고 있습니다.

**그룹은 ‘개들을 살리겠다’고 멋지게 기사만 내고, 아직까지 사료 한 푸대 주지 않고 아무런 도움도 주지 않고 있습니다.

대통령님, 시민들이 갖은 노력을 하는 동안 그 땅의 소유자 ** 상속인 4인은 죽을 위기에 처한 이 동물들의 구조를 위해 아무런 조치도 취하지 않았습니다. 자신의 마당에 누군가가 위험에 빠져 있을 때 그를 구조하는 것은 땅 주인의 도덕적 책무입니다.

대통령님, 이들이 각성하도록 적절한 조치를 취해 주십시오. 전화를 해서 꾸짖어 주시든, 특별 세무조사를 지시하시든, 책임을 촉구해주십시오.

국민들을 상대로 사업을 하여 축적된 막대한 부를 상속받아 놓고 자신들의 책무는 이행하지 않는 이런 행태를 방치하지 말아주십시오. 저들이 시민들과 함께 이 개들을 구조하는데 나서도록 압박해 주십시오.

대통령님, 동물보호소는 환경부의 유권해석에 따라 가축분뇨법의 적용대상에서 제외됩니다. 그런데 계양구청과 인천시청은 계양산 개 보호소가 동물보호소가 아니라고 주장합니다.

‘주인이 있는 동물이 모인 곳은 동물보호소가 아닌데 계양산 개는 동물보호단체가 주인이다’는 것을 그 근거로 내세우고 있습니다. 사설동물보호소의 역할에 대해 동물보호법 주무부서에서는 ‘동물보호센터에서 보호 중인 동물을 기증받거나, 개인· 개농장 등에서 동물을 인도받는 경우 등 소유권이 명확한 동물의 구조·보호 담당’이라고 설명하고 있습니다. 즉 기증·인도가 완료됨으로써 소유권 문제가 명확해져 원소유주가 더 이상 주인행세를 할 수 없는 동물을 돌보는 곳이 사설동물보호소라는 것입니다.

계양산 개들은 농장주가 농장운영을 포기할 시점에서 농장에 남아 있던 개들을 시민들이 인도받아 돌보고 입양 보내고 있습니다. 시민모임은 고유번호증이 있는 독자적인 단체로서 이러한 행위를 자신의 이름과 자신의 책임 하에 진행하고 있습니다. 보호소를 관리하는 시민모임 외에 누구도 이 개들을 사용·수익·처분하지 못합니다. 즉 소유하지 않고 있습니다.

2018년 환경부에서 유기동물보호시설은 가축분뇨법 적용을 받지 않게 유권해석을 하였습니다. 그래서 사설보호소인 *** 보호소는 무허가 건물에 있었지만 철거되지 않았고, 가분법 적용도 받지 않게 되었습니다. 사설보호소도 이 유권해석에 해당되며 *** 보호소와 대부분의 사설보호소는 등록되지 않은 보호소입니다. 계양산 시민 보호소에 대해서도 유기동물보호시설, 사설보호소로 유권해석 신청합니다.

저희 **목장개살리기시민모임은 작년 7월부터 시민들이 모금을 하여 사료와 물을 공급하고 치료와 접종을 해주고 해외입양을 보내고 있습니다. 또한 계양산보호소에서 아이들이 최대한 잘 지낼 수 있도록 함께 힘에 부치도록 노력하고 있습니다. 시민들이 일구어낸 이 보호소가 동물보호시설이 아니라면 대체 무엇이란 말입니까. 지자체가 하지 못한 일을 시민들이 하고 있는데 계양구청으로부터 범법자 취급당하는 이 상황을 국가에서 도와주십시오.
