1. 안녕하십니까? 귀하께서 국민신문고를 통해 신청하신 민원에 대한 검토 결과를 다음과 같이 알려드립니다.

2. 귀하께서 제출하신 민원의 내용은 “개고기 불법 사육 및 도축”에 관한 것으로 이해됩니다.

3. 귀하의 민원에 대한 검토결과는 다음과 같습니다.
가. 동물보호법 제8조와 관련하여 학대를 수반하는 도축현장을 찾을 수 없었으며, 동법 시행규칙 제4조(학대행위의 금지)에서, 농림축산식품부령으로 정하는 행위에 식용을 위한 개의 도축이 명시되어 있지 않기 때문에 개의 도축 자체를 처벌할 수 있는 근거가 없습니다. 축산물 위생관리법상 “개”는 가축의 범위에 해당하지 않기 때문에 개의 도축방식에 관하여 축산물위생관리법의 규정으로는 처벌을 할 수 없습니다.

나. 아울러, 개고기를 조리·판매하는 음식점 영업자는 「식품위생법」제3조 및 같은 법 시행규칙 제2조 관련 [별표 1]에서 정하는 위생적 취급기준에 따라 위생적으로 취급할 의무가 있습니다. 이와 관련한 위반사항 발견시 순천시에서는 현장조사 및 단속을 통해 행정처분, 벌칙 등을 부과하고 있으며, 개고기를 조리·판매하는 업소에 대한 위생점검을 지속적으로 실시하고 있음을 알려드립니다.

다. 가축분뇨의 배출에 따른 환경피해에 대해 검토한 의견은 다음과 같습니다. 개 사육시설은 사육면적이 60㎡이상일 경우 「가축분뇨의 관리 및 이용에 관한 법률」 제11조 제3항에 따라 가축분뇨 배출시설 설치 신고를 하여야 합니다. 또한 배출시설을 설치·운영하려는 자는 「가축분뇨의 관리 및 이용에 관한 법률」 제17조에 규정된 바에 따라 배출시설을 청결하게 관리할 의무가 있으며, 동법 제10조에 따라 가축분뇨를 유출하여 공공수역에 유입하는 행위를 해서는 안 됩니다. 만약 위와 같은 사항을 위반한 자는 「가축분뇨의 관리 및 이용에 관한 법률」 제50조제4호 및 제5호에 의거 처벌될 수 있습니다. 우리 시에서는 위와 같은 불법행위로 인해 환경피해가 없도록 지속적으로 지도·점검을 실시하겠으며, 불법행위가 적발될 경우 관련법에 의거 조치할 계획임을 알려 드립니다.

라. 음식물류폐기물과 관련하여 순천시는 음식물류폐기물을 전용용기에 배출 수거하여 음식물자원화시설로 반입 퇴비화 처리하고 있으며, 다량배출사업장(음식점, 급식단체 등)은 위탁처리를 통해 퇴비화 및 사료화 하고 있습니다. 이와 관련하여 불법행위가 이루어지지 않고 있음을 알려드립니다.

마. 식용을 목적으로 하는 개의 도살 자체에 대하여는, 현재 시‧군에서 해결할 수 없으며 귀하께서 요청하신 부분과 관련하여서는 농림축산식품부 혹은 식품의약품안전처에 문의하시기 바랍니다.

1. Thank you for contacting us. We will inform you of the results of the review of the complaint you have filed.

2. It is understood that the content of the complaint you filed relates to “Illegal breeding and slaughter of dog meat”.

3. The results of the review of your complaint are as follows.
– Regarding Article 8 of the Animal Protection Act, no slaughterhouses related to abuse could be found. Since Article 4 (Prohibition of Abuse) of the enforcement regulations of the same law does not specify dog slaughter, there is no basis for punishing dog slaughter. In addition, in the Livestock Products Sanitation Control Act, because’dogs’ do not belong to the scope of livestock products, it is difficult to punish dogs in relation to the slaughter method according to the Livestock Products Sanitation Control Act.
– In addition, restaurant business owners who cook and sell dog meat are obligated to handle it hygienically in accordance with the sanitary handling standards stipulated in Article 3 of the Food Sanitation Act and [Appendix 1] related to Article 2 of the Enforcement Regulations of the same Act. In the event of any violations in this regard, Suncheon City imposes administrative dispositions and penalties through on-site investigations and crackdowns, and is informed that hygiene inspections are continuously conducted at businesses that cook and sell dog meat.
– The opinions reviewed on environmental damage caused by the discharge of livestock manure are as follows. For dog breeding facilities, if the breeding area is more than 60㎡, it is required to report the installation of livestock manure discharge facilities in accordance with Article 11, Paragraph 3 of the 「Livestock Manure Management and Use Act」. In addition, a person who intends to install and operate discharge facilities is obligated to cleanly manage the discharge facilities as stipulated in Article 17 of the 「Livestock Manure Management and Use Act」. In accordance with Article 10 of the same Act, livestock manure must not be spilled into public waters. If a person violates the above matters, he/she may be punished pursuant to subparagraphs 4 and 5 of Article 50 of the 「Act on the Management and Use of Livestock Manure」. We inform you that the city will continue to conduct guidance and inspections to ensure that there is no environmental damage due to the above illegal activities, and if illegal activities are detected, we are planning to take measures in accordance with the relevant laws.
– The results of the review regarding food waste are as follows. Suncheon City discharges and collects food waste into exclusive containers and carries them into the food recycling facility for compost treatment, and large-discharge business sites (restaurants, food service organizations, etc.) are composting and converting them into feed through consignment treatment. Please be advised that there is no illegal activity in this regard.
– Regarding the slaughter of dogs for edible purposes, the current city/county cannot solve the problem. Please contact the Ministry of Agriculture, Food and Rural Affairs or the Ministry of Food and Drug Safety regarding your request.
